At roll call the follow- Meeting ing aldermen were present: Meurer, Serritella, Smith, Datz, Busse, Nolan, Attendance Pepping. Absent: Wieser. Other city personnel in at endance were: Supt. Halvensleben, Attorney Narusis, Clerk Gilpin, Chie Pasenelli, Park Director Merkel. Motion by Datz, seconded by Pepping, to accept the minutes of the October 4, 1982 Regular Meeting as presented. Voting Aye: Meurer, Serritella, Smith, Datz, Busse, Nolan, Pepping. Voting Nay: None. Absent: Wieser. Motion carried. James Berg, vice president of Residential Development Group, Boone addressed the Council regarding the final acceptance of improvements in Creek Boone Valley Units 12 and 13. Three items were discussed. 12 & 13 Motion by Pepping, secondec by Datz, that Residential Development Group be required to 1) Payment to bE made to the water sewer fund for fire hydrant replacements in the amount o $3,600.00 because twelve of the initial hydrants installed in Units 12 & 13 were not the required break -away types; 2) Set up a $3,000.00 escrow account for a period of 5 years regarding the shallow water mains and if no problem arises during that first 5 year period, the $3,000.00 would be refunded to R G. If a problem should occur, RDG must extend the period for an additional El years from the date of the occurence and must refund the escrow so as to maintain the $3,000.00 balance; 3) Adjusting ring height on the three m nholes in question must be brought up to the city specifications as out ined in Baxter & W'oodman's letter dated July 15, 1982. Voting Aye: Meurer, Serritella, Smith, Datz, Busse, Nolan, Pepping. Voting Nay: None. Absent: Weiser. Motion carried. The Mayor announced his appointment of Alderman Busse to serve on Appointments! the Police Committee. Mrs. Dorothy Hollander req ested assistance from the Council in feeding the ducks which remain in th area during the winter. She said it Donations costs about $200.00 a winter. Duck Feeding! Motion by Pepping, seconde by Nolan, that the city donate $200.00 Campaign this year to the "Feed the Ducks Cam�aign". Motion by Smith, seconded y Datz, to amend the motion that this year only, the city assist the campa gn by donating up to $200.00 to assure there will be $200.00 available for feeding the ducks. Monday, October 18, 1982 Page 5 Motion by Nolan, seconded by Datz, to authorize and approve payment Boone Creek of $25,000.00 to Lakeland Construction Company for the first payment request Dredging on the dredging of Boone Creek with payment to be made from the $100,000.00 Grant Money received from the State of Illinois. Voting Aye: Meurer, Serritella, Smith, Datz, Busse, Nolan, Pepping. Voting Nay: None. Absent: Wieser. Motion carried. Attorney Narusis announced that the closing on the city's purchase Land of the Ralph Freund Lot at 3902 W. Maple Avenue had taken place Saturday, Acquisitions October 16, 1982. It was the consensus of opinion of the Council that the $14,000.00 payment for the lot should be taken from the General Fund. Motion by Datz, seconded by Meurer, to authorize and approve payment to Baxter & Woodman in the amount of $18,666.00 for partial payment of engineer- ing fees on the sewer treatment centrifuge improvement project. Voting Aye: Meurer, Serritella, Smith, Datz, Busse, Nolan, Pepping. Voting Nay: None. Absent: Wieser. Motion carried. Motion by Nolan, seconded by'Smith, to authorize and approve install- ing an overlayment of 12 inches on the alley between West and Clearbrook Drives in Millstream Subdivision with the work to be done by the city crew. Voting Aye: Meurer, Serritella, Smith, Datz, Busse, Nolan, Pepping. Voting Nay: None. Absent: Wieser. Motion carried. Sewer Improvements Street Repair Chairman Meurer of the Purchasing Commitee reported the following price quotations were received for two 1983 22 ton dump trucks: Hershberger Truck Co. of Mundelein - without trade-in $37,758 - with trade-in $35,758; Freund Equipment Co. of Huntley - without trade-in $38,295 - with trade-in $36,175; Mitchell Buick of McHenry - without trade-in $42,013.78 - with trade-in $40,013.78; Buss Ford Sales of McHenry - without trade-in $36,860 - with trade-in $34,950 Motion by Meurer, seconded by Datz, to tion of the Purchasing Committee and purchase two lowest price quote submitted by Buss Ford Sales, allowance, depending upon whether or not the city outright before delivery of the 1983 trucks. Motion by Meurer, seconded by Nolan, to authorize and approve repair of 1980 Buick squad car #316 at an approximate cost of $1,500.00 with the work to be done by city mechanics. The matter of installation of pay phones in city parks was submitted to the Park Committee for recommendation. Smith, Chairman of the Street and Sidewalk Committee reported that he and Serritella had reviewed the condition of Shepherd Hill Lane and recommended that it not be resurfaced this year. The Mayor read a letter from Tom Engle of A.C. Pavement Striping Company of DesPlaines who resurfaced Front Royal and Oakwood Drive with slurry seal this fall. Engle, in his letter dated October 11, 1982, stated that if three areas on the resurfaced streets did not prove satisfactory, the company would repair the areas in the Spring of 1983. Motion by Smith, seconded by Datz, that no action be taken on the request of McHenry County Association for the Retarded that the city amend its zoning ordinance relating to allowance of group homes for the develop- mentally disabled in R-1 and R-2 Single Family Districts until the Building and Zoning Committee and the Council Could study the matter further and come back with a recommendation within 90 days. Motion by Datz, seconded by Busse, to deny the request of Modine Misc. Manufacturing Company of Ringwood for permission to dump sludge into city sewer lines on a one-time basis. Voting Aye: Meurer, Serritella, Smith, Datz, Busse, Nolan, Pepping. Voting Nay: None. Absent: Wieser. Motion carried. Meadow Lane Motion by Nolan, seconded by Serritella, to authorize and MFT approve payment of $18,489.61 to Hampton, Renwick and Lenzini for partial payment on the Meadow Lane Project. Voting Aye: Meurer, Serritella, Smith, Datz, Busse, Nolan, Pepping. Voting Nay: None. Absent: Wieser. Motion carried. Bond Motion by Smith, seconded by Meurer, to authorize and approve Payments payment to American National Bank & Trust Company of Chicago for 1956 Water/Sewer Bonds in the amount of $960.00 interest and $30.00 paying agent fees for a total of $990.00. Voting Aye: Meurer, Serritella, Smith, Datz, Busse, Nolan, Pepping. Voting Nay: None. Absent: Wieser. Motion carried. Bond Motion by Busse, seconded by Pepping, to authorize and approve Payments payment to McHenry State Bank for 1979�Water/Sewer Revenue Bonds in the amount of $29,250.00 interest and $25.00 paying agent fees for a total of $29,275.00: Voting Aye: Meurer, Serritel'la, Smith, Datz, Busse, Nolan, Pepping. Voting Nay: None. Absent: Wieser. Motion carried. Authoriza- Motion by Datz, seconded by Meurer, to authorize and approve tions payment to Baxter & Woodman in the amount of $18,551.02, for the balance due on engineering fees for preparation of the Step I McHenry McHenry Shores Facility Plan for the federal grant, 75 percent of which is Shores reimbursable from the federal government. Voting Aye: Meurer, Serritella, Smith, Datz, Busse, Nolan, Pepping. Voting Nay: None. Absent: Wieser. Motion carried. Lawsuits Motion by Datz, seconded by Meurer, to authorize and approve payment to Norbert C. Sauers and W. Randall Baudin, Attorney, in settle - McHenry ment of the lawsuit filed by Norbert C. Sauers against the Village Shores of McHenry Shores as follows: Judgement $1,164.80; Court costs $66.50; Total $1,231.30. Voting Aye: Meurer, Serritella, Smith, Datz, Busse, Nolan, Pepping.
