The regular meeting of the McHenry City Council was called to order by Mayor Stanek on Monday, October 17, 1983 at 8:00 P.M. in city hall. At roll call the following aldermen were present: Bolger, Nolan, Busse, Datz, McClatchey, Smith, Snell, Serritella. Absent: None. City staff in attendance were Supt. Halvensleben, Attorney Narusis, Clerk Gilpin, Chief Pasenelli, Park Director Merkel. Motion by Nolan, seconded by Bolger, to accept the minutes of the October 3, 1983 regular meetingand the Oct. 3, 1984 Public Hearinq. Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. McHenry and Johnsburg Rescue Squad members Phil Gust, Phil Bartman and Bob Zujewski were present along with James Althoff, president of the McHE?nry Township Fire Protection District to address the council concerning the proposed referendum which is up for vote at the November 8, 1983 election which would establish a special ambulance tax to support the operations of both the Johnsburg and McHenry Area Rescue Squads. A slide presentation was presented to the Council. Motion by McClatchey, seconded by Nolan, to pass a resolution supporting passage of the referendum to establish a special ambulance tax. Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. Anna Wheelock addressed the council and presented a petition to urge the council to pass an ordinance prohibiting smoking in retail food establishments. Motion by Nolan, seconded by Snell, to instruct Attorney Narusis to draft an ordinance prohibiting smoking in retail food stores. Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. Benjamin Madey, Vice President of Chroma Corporation, appeared before the council to request issuance of Industrial Revenue Bonds for the purpose of enlarging their present operation, Tonyan Industrial Park. Motion by Bolger, seconded by Nolan,to pass an inducement reso- lution to issue Industrial Revenue Bonds in the amount of $1,000,000 to Chroma Corporation and to authorize the mayor and clerk to sign the memorandum of agreement as presented. Voting Aye: Bolger, Nolan, Busse, Datz, McClatchy, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. John Brittain, representing Elgin Federal Savings & Loan, appeared before the council to request an extension of a Letter of Credit and agreement with the City regarding sidewalks for Phase I in McHenry Lakes Estates,also known as Millcreek Subdivision, which were to be in- stalled as of November 9, 1983. He requested an extension of time to June 15, 1984 so that sidewalks in Phase I and II could be completed at the same time. Motion by Bolger, seconded by Datz, to grant Elgin Federal Savings &Loans request for an extention of time to June 15, 1984 at which time installation of sidewalks in Phase I and II of Millcreek Subdivision would be installed. Council Meeting Attendance Resolution Petitions Ordinances Industrial Revenue Bonds Letters of Credit & McHenry Lakes Estates Monday, October 17, 1983 Page 2 Brittain also requested that lot 22 in Phase III of Nlillcreek Subdivision be given a building permit for construction as a model home and that the provision in the Letter of Credit and Agreement with Elgin Federal Savings & Loan which stated that the issuance of a building permit in a phase would trigger the one year sidewalk requirement be waived. Building Permit Motion by Smith, seconded by Snell, to authorize and approve Request the request of Elgin Federal Savings & Loan and to authorize the building inspector to issue a building permit for lot 22 in Phase III for use as a Letters of model home and that the City waive the provision in the agreement which 'Credit would trigger the one year sidewalk requirement for Phase III by reason of the construction of this model and that the same not be triggered until such time as any other permit might be applied for in Phase III or unless an occupancy permit is issued for the model home on lot 22. (Audits Thomas Yapelli, of Yapelli Ketchmark Certified Public Account- ants, appeared before the council to discuss the 1982-83 fiscal year audit as prepared by his firm. The management letter prepared by his firm was also presented. Following discussion the audit was accepted as presented. Mayor Stanek called for a recess at 9:55 P.M. The meeting reconvened at 10:07 P.M. with everyone still in attendance. Jack Schaffer of Liberty Outdoor Advertising addressed the council to request zoning variances for three signs in the City, of McHenry. Following discussion it was decided to turn the matter over to the Building & Zoning Committee for further study. '!Sign Permits Motion by Busse, seconded of Liberty Outdoor Advertising for next meeting. by Serritella, to table the request three sign variations until the Voting Aye: Nolan, Busse, Smith, Snell, Serritella. Voting Nay: Bolger, McClatchey, Datz. Absent: None. Motion carried. Supt. of Public Works Halvensleben reported that two bids had been received for the sidewalk program on October 10, 1983. Bids were received from Alliance Contractors of Woodstock at a cost of $4,945.22 and from ART Fleet Leasing Service of Mundelein at a cost of $5,670.00. ,Sidewalk Motion by Smith, seconded by Serritella, to accept the low bid of Alliance Contractors Inc. of Woodstock at the low bid price of 'Bid Opening $4,945.22 for the sidewalk repair and replacement program. Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. Park Director Merkel reported on the bid openings for tree purchase for the Parks as follows: Berthold Nursery & Garden Center, $1,392; Clavey's Woodstock Nursery, $1,650; Flowerwood of Crystal Lake, $1,545; Klehm's Nursery, $1,846; Schroeder's Nursery Inc., $2,130; Synnestvedt Nursery,$947; Williamson Nursery, $1,860. Clavey's, Flowerwood, Klehm's, Schroeder's and Williamson were the only ones who met all of the specifications. (Bid Opening Motion by Smith, seconded by Nolan, to accept the recommendation of the Park Director and award the bid for tree purchase to Flowerwood of Purchases Crystal Lake at the low price of $1,545. !Park Dept. Motion by Busse, seconded by Datz, to pass an ordinance amending the City of McHenry Building Codes Section 7-19, Section 7-20 and Section 7-22 as presented. Motion by Snell, seconded by Busse, to authorize and approve purchase of an Adler 1005 Typewriter for the Police Department at a cost of $739.00 with the money to be taken from the Police Department budget line item number 484 as recommended by the Purchasing Committee. Motion by Nolan, seconded by Snell, to authorize and approve paint- ing of a clarifier and other pipes at the Sewer Plant at the low bid proposal submitted by K & D Painting of St. Charles in the amount of $7,100.57. Motion by Nolan, seconded by Busse, to authorize the Park Department and the Police Department to work on designation of trick -or -treating hours for Halloween preferably from 4:00 P.M. to 7:00 P.M. on Sunday, October 30. Smith reported that outside security lights had been installed at the city garage to protect any equipment that must be left outside. At the same time this work was done additional wiring was hooked up to a panel so that in emergency situations when there is no electricity at the building an existing city generator can be plugged in to a panel which will give power at the city garage to operate garage doors, lights and other needed equipment in times of emergencies. Alderman Nolan reported that Chief Pasenelli had done a one week survey and a traffic count on the section of Green Street from Shepherd Hill Drive to Knox Park. During that one week the survey showed 5,960 vehicles had traveled that route. The average speeds ran from 18 to 30 miles per hour. Considering all the information he had compiled from the survey it was Chief Pasenelli's opinion that the present speed limit of 30 MPH should be maintained in the area. Alderman Nolan expressed her opinion that because the cars travel at that rate of speed it didn't seem a valid reason not to lower the speed limit when the safety of the children who reside in the area should be the first consideration. Purchases & Repairs Traffic Regulations In response to a inquiry on the dog litter ordinance, License Committees - Committee Chairman Serritella reported that her committee would meet before Auth. etc. the next council meeting and prepare recommendation on a dog litter ordinance. Supt. Halvensleben was instructed to install park entrance signs Parks-Auth. south and north of the Knox Park entrance and to extend the 30 MPH speed limit signs -to the south boundary of the Knox Park property.
