The Regular Meeting of the McHenry City Council was called to order by Mayor Busse on Wednesday, October 15, 1986 at 8 P.M. at City Hall. At roll call the following Aldermen were present: Bolger, Lieder, Council McClatchey, Nolan, Smith, Snell, Serritella, Teta. Absent: None. City Meeting staff in attendance were Supt. Batt, Attorney Narusis, Clerk Gilpin, Park Attendance Director Merkel, Chief Joyce. Motion by McClatchey, Seconded by Serritella, to accept the minutes of the September 17, 1986 Regular Meeting and the, October 1, 1986 Regular Meeting as presented. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Mayor Busse introduced Landmark Commission Chairman Nancy Fike who presented the first two Landmark Commission plaques to the following Landmark people: Plaque No. 1 was presented to Sandy Eckert for the Northwestern Commission Hotel at 3939-41 W. Main Street which was built in 1901. McHenry Landmark Commission Plaque No. 2 was presented to Mrs. Mary E. Weber for the Count's House at 3803 W. Waukegan Road which was built in the 1870's. Motion by Bolger, seconded by Lieder, to pass an ordinance granting the variation requested by Whispering Oaks Condominium Associa- tion No. 1 so as to allow the construction of two buildings on one lot with four units in each building having the square foot coverage of 31,860 square feet, parking consisting of eight inside garage stalls and eight exterior parking spaces, and a side lot reduction to a 5 foot variation on the west side of the property in question; to instruct the Condominium Association to investigate the possibility of buying land from School District 156 on the west side of the property; that condo- minium buildings built on the property in question be constructed with the same architecture and exterior elevations as adjoining condominiums and to instruct the petitioner's attorney to present a revised ordinance to the City Attorney for final approval prior to signing by the Mayor and City Clerk. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Voting Nay: None. Absent: None. Motion carried. Snell, Serritella, Teta. Jerry Allen of Weatherfields Inc. made a presentation to the City Council regarding a proposal for development of the 242 acres of the McDonald property located on the west side of 31 between the railroad tracks and the highway. As soon as he obtains an option on the property, he will again appear before the Council to ask for Industrial Revenue Bonds in the amount of $10,000,000 for construction of a diagnostic treatment center on 40 acres of the property fronting Bull Valley Road. The Council told him to proceed with the project and in return at a later meeting for passage of an inducement resolution contingent upon his obtaining an option on the property. George Lane a resident on Ellen Road addressed the Council and reported that 19 residents along Ellen Road are interested in annexing to the City of McHenry. Ordinances Zoning Ords. Industrial Revenue Bonds Motion by Bolger, seconded by Nolan, to provide the residents of Ellen Road with information and assistance in proceeding with annexation to the City without expenditure of City money for this assistance. Annexations Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Numerous residents of Lakewood Subdivision were in attendance at the meeting to present their feelings on the proposed forced annexation of Lakewood Subdivision. Jim Thennes, a resident of Lakewood Subdi- Annexations vision, appeared as spokesman for the group. He said the residents were unanimous in their feeling that they did not want to be annexed to the City and presented a petition with the names of residents in that area expressing their oppisition. Wednesday, October 15, 1986 page 2 Motion by Bolger to forcibly annex the islands of land as pre - Failed sented at this meeting with the exception of Lakewood Subdivision. Motions Motion failed for lack of second. Motion by Serritella, seconded by McClatchey, to pass the Ordinances ordinances forcibly annexing all the islands of land which are contiguous Annexations as presented at this meeting. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Mayor Busse called for a recess at 9:58 P.M. The meeting reconvened at 10:12 P.M. Motion by Bolger, seconded by Snell, to pass an ordinance annex - Ordinances ing the property at 712 N. Country Club Drive as presented and to bill Annexations the owners of the property for attorney fees for preparation of the ordinance. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Parking Motion by Bolger, seconded by Nolan, to establish a "no parking" Regulations area along the southside of John Street from Green Street east to Allen Avenue. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Aldermen Bolger left the meeting at 10:15 P.M. Building & Motion by Serritella, seconded by Snell, to direct the City Zoning Attorney to start immediate legal action and file a law suit against Mary Violations Maulch of 4904 Willow Lane, Lakeland Park for zoning and health viola- tions. Voting Aye: Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: Bolger. Motion carried. Motion by Smith, seconded by Teta, that the Council finds the Sewer special assessment program to be the method to follow for financing of Plant the McHenry Shores Sewer Project and that the City Attorney, City South Engineers, and Warren Associates be directed to develop the program for presentation to the residents of McHenry Shores and to proceed with pre - Sewer Line paration of the special assessment program if the response is favorable Extensions from the residents of McHenry Shores. Voting Aye: Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: Bolger. Motion carried. Ordinances Motion by McClatchey, seconded by Lieder, to pass an ordinance Limousine including Limousine Service in the Taxi Cab Ordinance Section of the Service Municipal Code. Voting Aye: Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: Bolger. Motion carried. Ordinances Motion by Teta, seconded by McClatchey, to pass an ordinance Subdivision amending the Subdivision Con-:rol Ordinance relating to tentative plat Control Procedures and procedures regarding final plans, specifications and Ord. reports as presented. Voting Aye: Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: Bolger. Motion carried. He also proclaimed October 24 - 25, 1986 as orations "Knights of Columbus Days" in the City of McHenry. Mayor Busse acknowledged with gratitude a donation from Ace Hardware for Christmas lights to decorate the Gazebo in Veteran's Donations Memorial Park for the Christmas Holidays and a donation from the North- west Herald for $4,000 for the purchase and installation of memorial plaques at Veteran's Memorial Park. The Public Property Committee recommended that the low bid of McHenry Paint, Glass and Wallpaper be accepted to replace the drapes in the Council Chambers and to provide window coverings in the upstairs offices in the Clerk's side of the Building. They also recommended that the low bid of Office Equipment Company of Chicago be approved for wall dividers in the City Clerk's office. Motion by Serritella, seconded by Nolan, to accept the recom- public mendation of the Public Property Committee and award the bid for window Property - blinds in the Council Room and Clerks Office to McHenry Paint, Glass and Improvement! Wallpaper in the amount of $2,326.86 and to award the low bid for wall p dividers and panels to the low bidder, Office Equipment Company in the amount of $19,615. Voting Aye: Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: Bolger. Motion carried. The Environmental Advisory Committee Chairman Liz Nolan requested that a pilot program for leaf collection be undertaken in the City the third week of October as recommended by the Environmental Advisory Committee. Motion by Smith, seconded by Serritella, that the City take no Environ- action since the City is not in a position to do the pilot leaf compost- mental ing program this year because of cost and no available man power for the Adv. Ctte. project. Voting Aye: Lieder, McClatchey, Smith, Snell, Serritella. Leaf Voting Nay: Nolan, Teta. Composting Absent: Bolger. Motion carried. Bond Motion by Nolan, seconded by Snell, to authorize and approve Payments payment to American National Bank and Trust Company of Chicago for y interest on the 1956 Water Sewer Bonds as follows: Interest $200, Bank Fees $30, Total $230. Voting Aye: Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: Bolger. Motion carried. Motion by Teta, seconded by Nolan, to grant the request of Employees Judith A. Cook, a long time dispatcher in the Police Communications Department and grant her special dispensation to live in her home town of Genoa City, Wisconsin while still maintaining her employment as a dispatcher in the McHenry Police Department. Motion by Serritella, seconded by Lieder, to accept the recom- Parks- mendation of Park Director Merkel and purchase trees for the 1986 tree Purchases program from the low bidder, Flowerwood of Crystal Lake. Voting Aye: Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: Bolger. Motion carried. Motion by Serritella, seconded by McClatchey, to accept the low Parks- price proposal for landscape improvements at Veteran's Memorial Park and Purchases award the contract to Think Green Landscaping for the low bid amount of $2,375.35. Voting Aye: Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: Bolger. Motion carried. Motion by Lieder, seconded by Smith, that the project to install Bridges the old Pearl Street bridge the rear of the parking lot at McHenry City Hall and refurbish it for the 1986 Sesquicentennial Year be postponed until such time as the City has financing to complete the project. Voting Aye: Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: Bolger. Motion carried.
