WEDNESDAY, OCTOBER 15, 1980 8 P.M.
City Attorney Narusis announced that the record show that late in
the afternoon of October 15, 1980, his office received a call from Mr. James
De Rose, agent for the McHenry Group, petitioners who were to appear, at this
meeting, regarding presentation of an Annexation Agreement. He indicated to
Narusis that they were not prepared to proceed with the hearing this evening
because their petition for annexation and the proposed annexation agreement
were not in the form required by statute. In other words, they were not signed
by the owner of record of the property in question which was the LaSalle
National Bank. Nor did they have an appropriate affadavit in compliance with
the trust disclosure act ready for this evening's hearing. Therefore, they
were not in compliance with the statue on at least three counts and could not
proceed this evening. DeRose was not even aware that we had a meeting this
evening on the annexation matter. He asked Narusis to obtain a general con-
tinuance or postponement of the meeting. The next meeting on this matter will
be set by the City Council at a subsequent time. DeRose apologized for their
inability to proceed this evening.
When Narusis received that information, he contacted the City Clerk's
office and advised her. She, in turn, notified the Mayor and City Council
indicating to them that there would be no meeting this evening because the
petitioners would not be available.
For that reason the only persons present at this time were Attorney
Narusis, City Clerk Gilpin and McHenry Plaindealer reporter Tony Oliver. There
were no other persons present from the general public.
