Tne Regular Meeting of the McHenry City Council was called to order by Mayor Busse on October 18, 1989 at 8:00 P.M. At roll call the following Aldermen were present: Bolger, Donahue, Smith, McClatchey, Patterson, Lieder, Serritella. Absent: Teta. City staff in attendance were: Director of Public Works Batt, Attorney Narusis, Chief Joyce, Building & Zoning Officer Halik, Assistant to City Clerk Marth. Absent: Park Director Merkel, City Clerk Gilpin. The Mayor asked if anyone from the audience had signed in to make a public statement. There being no response, the Mayor proceeded to the next agenda item. Attorney Tom Rausch representing Meyer Material Co. gave an informational presentation for annexation of 40 acres adjacent to the west of their Sherman Hill operations. The property is presently owned by Meyer Material and they would like to annex the property to the City under the same terms and conditions as a previous annexation agreement just recently completed. This new 40 acre parcel would be used for moving the processing equipment there within a six month period after the area is mined out. This would take the processing equipment further away from the residential homes in the area. Answering a question from Mayor Busse, Rausch stated that they were ahead of schedule on the plan for a 20 year build -out that was presented to the Council about a year ago. In that case, Busse said, possibly during the annexation process on this parcel, an adjustment in the timing of the sliding scale of fees per tonage of gravel mined would have to be made. Narusis also said that if the previous annexation agreement plan -phasing is moved up because of this new annexation, then the previous annexation agreement would have to be amended. Motion by Patterson, seconded by McClatchey, to instruct Meyer Material Company to proceed with annexation of the additional 40 acre parcel by appearing before the Zoning Board of Appeals and then the Plan Commission. Voting Aye: Bolger, Donahue, Lieder, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: Teta. Motion carried. Motion by Lieder, seconded by Bolger to approve the minutes of the Regular Meetings of October 4 and October 11, 1989 as presented. Voting Aye: Bolger, Donahue, Lieder, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: Teta. Motion carried. Motion by McClatchey, seconded by Lieder, to advertise for bids on the following trucks based on the specifications preseneted by Director of Public Works Batt and Parks' Director Merkel: Public Works: 1. Replacement for truck #439 (Street Division) a 1972 Chevrolet light snow plow. 2. Additional vehicle to be used for cul-de-sac plowing and other general hauling purposes (Street Division), a drop -side 1 ton dump truck. 3. Additional service vehicle (Water Division) to be used for water meter repair and replacement. 4. Additional pickup truck (Wastewater Division) to service additional transportation needs required because of the South Wastewater Treatment Plant. Parks: 1. Replacement for vehicle #126 which is a 1980 Ford 4 wheel drive pickup truck. Voting Aye: Bolger, Donahue, Lieder, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: Teta. Wednesday, October 18, 1989 Page 2 Busse announced that the Transportation Committee of the Chamber of Commerce has asked him to speak at their meeting Friday, October 20, 1989 at noon at Land's End Restaurant in Sunnyside on the Green and Elm traffic-flow/parking problems. Busse said that the feedback he was getting was that a majority of residents felt the previous decision by the Council not to eliminate parking at Green and Elm was premature. Busse believed that some of the parking problems now will be eased with the addition of the Jepsen building purchase and conversion to a parking lot and that possibly another public hearing should be held to re-examine the issue with different alternatives being considered. He also said that IDOT was now freeing up money to take care of the intersection and that IDOT would have someone at a public hearing if reouested. Busse said he will report back at the next meeting on how the Transportation Committee meeting went and would know better at that time if another public nearing was necessary. Motion by Patterson, seconded by Bolger, to approve the September Treasurer's Report as presented. Voting Aye: Bolger, Donahue, Lieder, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: Teta. Motion carried. Motion by Smith, seconded by Patterson, to approve the September Clerk's Report as presented. Motion by Patterson, seconded by Serritella, to approve payment of the bills as presented, with the amendment of the Carmichael Construction Company's bill for sidewalks, retaining wall, curb & gutter, from $23, 616.11 to $20,162.31 which leaves $1,963.00 being retained for completion of some work. Voting Aye: Bolger, Donahue, Lieder, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: Teta. Motion carried. Mayor Busse reported on a letter he received from Zion Evangelical Lutheran Church asking the Council to reconsider the building permit fees they paid recently on the construction of an addition and remodeling project in the amount of $697.64. Busse said that unless the Council felt otherwise, ne would respond back to them that other churches and not -for -profit organizations have paid permit fees and that the City does not want to set a precedent by reducing or eliminating these fees. The Council agreed. Busse read a National Federation of Parents for Drug Free Youth Proclamation proclaiming October 22 - 29, 1989 as "Red Ribbon Week" in the City of McHenry. The wearing or displaying of red ribbons during the week-long campaign is to present a unified and visible commitment toward the creation of a Drug -Free America. Lieder stated that the McHenry Area Youth Commission has purchased, and will distribute, enough red ribbons for every school -age youngster in the entire area. A snort discussion took place on the preliminary plan and estimate of cost prepared by Smith Engineering on the Front Royal/Route 120 reconstruction and relocation project. The cost estimate of between $5UU,000 - $600,000 was more than double what had been anticipated. It was hoped that if and when IDOT does work in that area, the cost to the City would then be considerably less. Motion by Bolger, seconded by Serritella, to put the Front Royal/Route 120 project on hold until IDOT does work in that area. Wednesday, October 18, 1989 Page 3 The matter of allowable truck width from 8' to 8'6" on State highways (Routes 31 and 120), which can be regulated by the City, was table to the next regular Council meeting for Chief Joyce to investigate and make a recommendation to the Council. The request to allow 8'6" trucks on Routes 31 and 120 in the City was made to the Mayor by two local truck businesses. Busse announced that he had received a letter from the Chairman Of the McHenry County Board asking him to meet with her and other community officials to discuss areas of mutual interest, a format for addressing those areas cooperatively and possible end products such as memoranda of agreement because of the rapid growth in the County. This meeting is scheduled for November 1 at 7:30 p.m, which is the next Regular City Council Meeting. Busse asked if the Council Meeting could be moved to November 2. Motion by Bolger, seconded by Lieder, to move the November 1, 1989 Regular Council Meeting to Thursday, November 2, 1989 at 8:00 p.m. Voting Aye: Bolger, Donahue, Lieder, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: Teta. Motion carried. Busse stated that the McHenry County Defenders want to appear before the Council to discuss the Illinois Groundwater Protection Act but he was not sure when that would be. He would keep the Council advised. Narusis reported on the City's request for a sewer easement along the Chicago & North Western right-of-way running north from Route 120, that has been back and forth in negotiations for the last four years. After writing to the President of the company, Narusis said it now seems as though they are willing to enter into an option agreement for a price of $4,350.00. The option must be exercised within three years or we would loose the $500.00 deposit. Motion by Lieder, seconded by Donahue, to authorize the Mayor and City Clerk to sign the Option Agreement with the Chicago and North Western Transportation Company and to pay the $500.00 deposit. Voting Aye: Bolger, Donahue, Lieder, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: Teta. Motion carried. The Mayor stated that if there were no objections, he wanted to appoint Building & Zoning Officer Andy Halik to act as temporary interim Development Director under his supervision until a successor is appointed or the position eliminated or modified. Serritella said that if this did not interfere with his duties as Building & Zoning Officer, especially in getting the building permits out, she thought it a good idea. Halik assured the Council that he would do his best at both. There were no objections. Under committee reports, McClatchey made a motion to have the Personnel Committee start working on a job description for the City Administrator position. Serritella thought the motion was a little premature since the Council had not previously discussed the position at all. McClatchey withdrew his motion. Busse suggested putting the matter on the November 2, 1989 agenda to review and discuss the information presented to them at yesterday evening's Personnel Committee meeting where Dr. James M. Banovetz, Professor and Director of Public Administration at Northern Illinois University, spoke. Lieder gave a short summation of the McHenry Area Youth Commission Summer Program stating that 809 young people participated in 34 activities and he hoped next year would be bigger and better. Lieder also reported on the Finance Committee meeting held last week and one of the items discussed was the remaining benefits requested Wednesday, October 18, 1989 Page 4 by the employees. Although the salaries had been established last spring, the Committee was waiting for a survey and recommendation to be completed by the Finance 8 Personnel Director on the benefits given by other communities of comparable size. Unfortunately, it was not completed before he resigned. Lieder said that in reviewing the requests, one benefit request was being recommended to the Council to be approved this year and that was to increase the number of holidays by one-half day. The one-half day would be added to the Christmas Eve one-half day holiday, making it a whole day off for employees. The remaining requests will have to be taken up again when the salaries are reviewed again next year. Motion by Lieder, seconded by Donahue, to increase the holidays for City employees by one-half day making the day before Christmas a full 8 hour holiday. Voting Aye: Bolger, Donahue, Lieder, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: Teta. Motion carried. Director of Public Works Batt asked for direction from the Council on brush pickup in Glacier Ridge, Woodcreek and Martin Woods since there seemed to be some question on whether there was a covenant recorded somewhere that stated brush pickup would be the lot owners responsibility. After researching the City's records, no recorded instrument stating this was found, yet no brush has ever been picked up in these subdivisions and only a few inquiries from residents in those areas have been made. Batt said he did not know where the order came from not to pick up brush in these subdivisions. Busse and Narusis recalled reading it in some documentation but could not recall where. Busse believed the logic behind not picking it up at that time was because of all the wooded areas located in these subdivisions, the City would be unable to keep up. Motion by Smith, seconded by Patterson, to provide a brush pickup service for all residents in the City for the next year until we can clear up the matter of the covenant that may be riding on some development. Voting Aye: Bolger, Donahue, Lieder, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: Teta. Motion carried. Serritella said she would like to see a review of the brush and leaf pickup program next year in view of the new landfill law taking effect then. Motion by Serritella, seconded by Donahue, to approve payment of the 1988 Water/Sewer Revenue Bond interest and paying agent fees in the amount of $95,932.03 to LaSalle National Bank and the 1986 Water/Sewer Revenue Bond interest in the amount of $130,812.50 to American National Ban::. Voting Aye: Bolger, Donahue, Lieder, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: Teta. Motion carried. Busse asked Narusis to explain the Resolution before the Council authorizing the transfer of interest in the RAE Corporation Industrial Revenue Bond (IRB) Memorandum/Agreement to the Illinois Development Finance Authority (IDFA). Narusis said that at the last meeting the Council passed an Inducement Resolution authorizing the execution of the Memorandum/Agreement for the issuance of the IRB but because cities, as of now, do not have the authority to make the request for the allocation of IRB funds, the authority has been shifted to IDFA and they have to issue the RAE Corporation IRB. Motion by Bolger, seconded by Lieder to pass the Resolution authorizing the transfer of interest in the RAE Corporation Memorandum/Agreement to IDFA. Motion by Lieder, seconded by Donahue, to authorize the City Attorney to write a letter to an ordinance violator notifying him to resolve the complaint within 7 days from receipt of the Attorney's letter and if not resolved within that time, the Attorney is authorized to file suit against the individual.
