At roll call the follow- ing aldermen were present: Pepping, Nolan, Datz,, Wieser, Smith, Serritella, Meurer. Absent: None. All other city department heads were present. Motion by Pepping, seconded by Nolan,lto accept the minutes of the September 20, 1982 Regular Meeting and the September 29, 1982 Public Hearing as presented. Voting Aye: Pepping, Nolan, Datz, Wieser, Smith, Serritella, Meurer. Voting Nay: None. Absent: None. Motion carried. Motion by Datz, seconded by Smith, to concur with the Mayors appoint- ment of William Busse of 107 Augusta as alderman of Ward 2 to fill the unexpired term of George Harker. Voting Aye: Pepping, Nolan, Datz, Wieser, Smith, Serritella, Meurer. Voting Nay: None. Absent: None. Motion carried. Mayor Stanek declared a recess at 8:23 P.M. The meeting reconvened at 8:28 P.M. with everyone still in attendance. Council Meeting Attendance Appoint- ments Mayor Stanek gave the oath of office o William Busse who will serve Appoint out the term of George Harker which expires in ay of 1983. Busse was also appoint -Appoint ed to serve as a member of the Finance Committee to replace Harker on that Committee. Bill Thomas, representing the McHenry Lions Club, announced that a carnival was being planned by the Club for October 22, 23, & 24 on a vacant lot on Crystal Lake Road between McHenry State Bank Weber Building and Oaks Marathon Gas Station. He requested permission from the Council for a beer permit and carnival permit. The proceeds would go to benefit the Hornets Junior Football team and the McHenry Rescue Squad. Motion by Wieser, seconded by Nolan, to grant permission to the Lion's Club to conduct a carnival and serve beef~ on the condition they meet all city rules and regulations. Voting Aye: Pepping, Nolan, Datz, Wieser, Smith, Serritella, Meurer, Busse. Voting Nay: None. Absent: None. Motion carried. Motion by Smith, seconded by Wieser, to waive the $25 carnival license fee for the Lion's carnival. Voting Aye: Pepping, Nolan, Datz, Wieser, Smith, Serritella, Meurer, Busse. Voting Nay: None. Absent: None. Motion ccarried. Motion by Nolan, seconded by Serritella, to authorize Attorney Narusis to send a letter to McHenry Hospital regarding inspections for new construction of the hospital facilities in which he informed the Hospital that the city was exempting itself from any and'all building inspections at the hospital except for footing inspections and water & sewer connections. Voting Aye: Pepping, Nolan, Datz, Smith, Serritella, Meurer, Busse. Voting Nay: Wieser. Absent: None. Motion carried. Amusement Licenses Authorizations McHenry Hospital Meurer, Chairman of the Purchasing Committee, reported the committee Public had reviewed the price proposalsof four vehicle dealers for 2 22 ton dump trucks Works but they would not make any recommendation until further study on a new type Purchases truck body had been made. They will report back at the next meeting. Snow Motion by Smith, seconded by Nolan, to continue the policy of Plowing snowplowing Fegers Subdivisionlnorth of St. Patricks Church, Park Street and Country Club Drive at a preliminary season cost of $400 for Fegers Subdivision and Park Street andl$250 for Country Club Drive with extra fees to be charged if additional time is spent in those subdivisions due to an unusually heavy snowfall dulring the season. Voting Aye: Pepping,"Nolan, Datz, Weiser, Smith, Serritella, Meurer, Busse. Voting Nay: None. Absent: None. Motion carried. Authoriza- Motion by Pepping, seconded by Nolan, to authorize and approve tions the written bond purchase documents from McHenry State Bank, First National Bond Issue Bank of McHenry, McHenry Savings & Loan, Home State Bank of Crystal Lake and State Bank of Cary Grove for purchase of Special Service Area Number McHenry One Bonds in the amount of $6171,000.00 and purchase 'of City of McHenry Hospital 1982 G.O. Bonds in the amount of $205,000.00. Voting Aye: Pepping, Nolan, Datz, Smith, Serritella, Meurer. Voting Nay: Wieser. Not Voting: Busse. Absent: None. Notion carried. i McHenry Motion by Nolan, seconded by Busse, to take no action on the Hospital hospital's request to release all city's rights on an easement across Easements their property on Waukegan Road. Public Motion by Meurer, seconded by Smith, to authorize and approve Property the purchase of a floor scrubbed -buffer -carpet cleaning machine at a cost of $1,134.00 from Diamond Chemical Company of Mundelein. Purchases Voting Aye: Pepping, Nolan, Datz, Wieser, Smith, Serritella, Meurer, Busse. Voting Nay: None. Absent: None. Motion carried. Voting Attorney Narusis was asked to submit a written opinion on the Procedure recent Supreme Court Ruling regarding Council Voting procedure and also what constitutes a majority or alquorum. Committees The Street and Sidewalk Committee was instructed to inspect Street Shepherd Hill Drive as to the necessity for possible overlayment. Repair Executive Motion by Datz, seconded by Wieser, to go into Executive Session Session at 10:11 P.M. for the purpose ofdiscussing pending litigation.
