The Regular Meeting of the McHenry City Council was called to
order by Mayor Busse on Wednesday, October 1, 1986 at 8 P.M. at City Council
Hall. At roll call the following Aldermen were present: Bolger,
McClatchey, Nolan, Smith, Snell, Serritella, Teta. Absent: Lieder. Meeting
City staff in attendance were Supt. Batt, Attorney Narusis, Clerk Gilpin, Attendance
Chief Joyce. Park Director Merkel arrived at 8:22 P.M.
Attorney Narusis reported that he had sent a letter to the
Illinois Commerce Commission concerning the request by the McHenry Shores
Water Company for a rate increase. He advised the ICC that the City of
McHenry requested that it be permitted to intervene in the rate increase
proceedings for the purpose of objecting to any increase in the water
rates of McHenry Shores Water Company. He asked the ICC to send copies
of the annual reports that have been filed by the McHenry Shores Water
Company for the years 1982, 1983, 1984 and 1985. The ICC sent the audit
reports and also informed him that a new simplified rate procedure was
used for companies that have revenue less than $50,000 per year. The new
procedure is very informal and may not infact have a procedure for the
City to intervene in the rate request. He said that customers of the
McHenry Shores Water Company had only ten days to present their input to
the ICC. If enough letters in opposition are received to the rate
increase, a Public Hearing could be set up at McHenry City Hall. If not
enough complaints are received, the staff of the ICC would make a recom-
mendation and present it to the ICC Board for final decision. Narusis
said it was important that customers and possibly Aldermen submit their
complaints or comments to the ICC within the next week. If enough com-
plaints are received at the ICC, a meeting will be scheduled otherwise a
decision will be made by the ICC Board without any local input.
Bill Jakomovich, Plant Supervisor of Lakes Cablevision, appeared
before the Council to answer complaints and inquiries regarding the
operation of the Cablevision System authorized under a non-exclusive
franchise with the City of McHenry dated May 31, 1978. One of the points
of concern was that the agreement called for cable television lines to be
installed throughout the entire City within five years of the date of
the FCC certification. Areas within the City such as Whispering Oaks
Subdivision, Glacier Ridge, Woodcreek and certain areas of Winding Creek
are still without cable service. The lack of local origination capabi-
lities for local programming was another concern. Numerous residents in
Whispering Oaks have complained of not receiving service. Others
complained of non -restoration of their property after the cablevision
lines were installed in certain areas. Jakomovich stated that they could
complete Whispering Oaks during October and November since they had only
11,000 feet of cable left to install in that area. He offered to pickup
copies of the complaints that have been received by the City and respond
to them. He said he will also notify the City of his responses to the
complaints.

comment on the Cable Television service.

Mr. Graham commented that a month ago Station WYCC which is the
only educational station on the cablevision system was taken off the
air. Alderman Teta asked the Mayor to set up some sort of timetable for
compliance by Lakes Cablevision regarding these complaints and the Mayor
agreed to do so.

Charlene Svihlik, Director of the City of McHenry Emergency
Services and Disaster Agency, addressed the Council to report on the
recent flooding conditions in the area. She said that the Fox River had
not crested as yet because it must stop raining for 24 hours before ESDA
cresting occurs. The water is two feet over flood stage at McHenry Dam
and the Superintedent of Assessments for the State was at the Woodstock
Court House taking estimates of damage since the State had declared
McHenry County a State disaster area. Federal Assessors were also at the
County to take estimates and would decide later whether McHenry County
could be declared a Federal disaster area. She stated that sand bags
were available at the McHenry Locks and at the City of McHenry Garage.
Sand was free at the City Garage as well as at the McHenry Sand and
Gravel pit west of the City. McHenry Sand & Gravel had donated all the
sand for use in attempting to stop the flood waters,

Rob Gaither of 4911 Flanders Road, McHenry, presented a letter
to the Council requesting additional mechanical devices to be used in his
proposed game room facility at 4611 W. Elm Street.
Motion by Smith, to allow Gaither to install an additional 21
machines for a total of 25 on his premises. The motion failed for lack
of a second.
City Motion by McClatchey, seconded by Snell, to allow Gaither to
Licenses install an additional 11 machines in his game room making a total of 15
contingent upon his following the same guidelines as were enforced for a
previous game machine business known as "Another Galaxy".

A large group of residents from the Anne Street and Grove
Street Street were present to address the Council concerning flooding problems
Maint. & in their area. Tom Burke, Leroy Welter and Raymond Kunz were spokesmen
Repair for area residents. The Council assured the residents it was were look-
ing into the drainage problem and was working with the State to clear up
problem caused by the storm water ditches recently installed on the east
side of Route 31 by the State.
Mayor Busse called for a recess at 10:07 P.M. The meeting
reconvened at 10:25 P.M. with everyone still in attendance.
Building
& Zoning Motion by Smith, seconded by Serritella, to direct the City
Violations Attorney to immediately begin taking legal action against Hendrika Fliege
at 1504 N. Park Street for a zoning violation.

Serritella, Teta.

Sewer Plant Harold Warren of Warren Associates addressed the Council con -
South cerning various financing options available for installation of lateral
sewers in McHenry Shores. Following lengthy discussion by the Council,
it was decided to set up an informational open house type meeting so that
residents can address their individual concerns in the McHenry Shores
area.
Water Dept. Motion by Snell, seconded by McClatchey, to authorize and
Improv. approve the following final payments: $21,493 to Driessen Construction
Company for Well No. 7 Iron Removal Plant, $3,015.80 to Paul May & Sons
Sewer Dept.for the Front Street Water Main Addition, $8,550 to William Zeigler & Son
Improv. for the Riverside Drive Sanitary Sewer Replacement Force Main and Lift
Station.

Motion carried.
A proposal was submitted by William Tonyan & Sons for $22,379 to
Bridges build bridge abutments in back of City Hall for placing of the Pearl
Street bridge. It was decided to reject the Tonyan proposal because it
was tao high .
Motion by Bolger, seconded by Teta, to pass a resolution
Resolutions requesting the closing of Route 120 for a short period of time during the
Parades Christmas parade on November 29, 1986.

Proclamatio siMayor Busse proclaimed the week of October 5 - 12 as "Respect
fe Week" in McHenry to remind the American people of the dignity of
human life.
Motion by Teta, seconded by Snell, to grant the request of St.
Building Mary's Church to install a stair climbing elevator in Montini School for
Misc. use by elderly and handicap people.

Motion by Smith, seconded by Bolger, to reduce Winding Creek III
Letter of Credit from 163,313 to $23,976.13 as recommended by Baxter &
Woodman and Superintendent Fred Batt.

Serritella, Teta.

Motion by Serritella, seconded by McClatchey, to authorize and
approve picnic beer permits and special use park permits as requested.

Motion by Serritella, seconded by Bolger, to authorize the Mayor
to sign a trust agreement at McHenry State Bank for five lots donated by
Pheasant Valley and Lancer Corporation.

Motion by Smith, seconded by Bolger, to pass an ordinance allow-
ing parking on the south side of Waukegan Road from the White House
Kindergarten east to Green Street.
