The Regular Meeting of the McHenry City Council was called to order by Mayor Stanek on Monday, October 1, 1984 at 8:00 P.M. At roll call the following Aldermen were present: Bolger, Busse, Datz, McClatchey, Nolan, Smith, Snell, Serritella. Absent: None. City staff in attendance were Supt. Halvensleben, Attorney Narusis, Clerk Gilpin, Chief Pasenelli, Park Director Merkel. Motion by Nolan, seconded by Bolger, to accept the minutes of the September 17, 1984 Regular Meeting as presented. Voting Aye: Bolger, Busse, Datz, McClatchey, Nolan, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. Council Meeting Attendance Motion by Bolger, seconded by Nolan, to accept the recom- Zoning mendation of the Zoning Board of Appeals and pass an ordinance Ordinance granting the variation request of Henry & Alice Buch. Voting Aye: Bolger•, Busse, Datz, McClatchey, Nolan, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. Attorney Daniel Curran addressed the Council concerning the Zoning Board recommendation for the Carl Johnson property located near State Route 31 in Meadow Lane Subdivision. Robert Kuglin of 4018 W. Lillian Street also addressed the Council as an objector to the Johnson Petition. Motion by Busse, seconded by Nolan, to concur with the Zoning Board of Appeals recommendation and deny the petition of Carl Johnson for a variation of the R-4 multi -family district zoning classification. Voting Aye: Bolger, Busse, Datz, McClatchey, Nolan, Smith, Snell,, Serritella. Voting Nay: None. Absent: None. Motion carried. A letter sent by Donald Gerstad, President of Residential Development Group, dated September 24, 1984 regarding curb and sidewalk escrow account for Winding Creek Unit I was discussed by the Council. Motion by Datz, seconded by Smith, to accept the conditions outlined in the September 24, 1984 letter from Donald Gerstad, President of Residential Development Group, concerning the curb and sidewalk escrow money for Winding Creek Unit I with the additional stipulations that the improvements must be completed within a two year time frame, and that additional funds must be presented to the City for improvement of curb cuts on five vacant pieces of property in said Unit I. Voting Aye: Bolger, Datz, McClatchey, Nolan, Smith, Snell, Serritella. Voting Nay: Busse. Absent: None. Motion carried. Motion by McClatchey, seconded by Bolger, to grant a request of Elgin Federal Savings 8, Loan for a one year extension to June 15, 1985 on their letter of credit for installation of sidewalks in Phases I & II of Millcreek Subdivision (McHenry Lakes Estates) with the stip- ulation that sidewalks be installed on Lot 62 & 66 in Phase II immediately. Voting Aye: Bolger, Busse, Datz, McClatchey, Nolan, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. Zoning Matters Winding Creek Letters of Credit McHenry Lakes Estates Letters Credit Monday, October 1, 1984 page 2 The Council authorized the Mayor to send a letter to bene- Si dewal ks fited property owners along the FAU Sidewalk Route concerning voluntary participation in the cost of the sidewalk installation. Tom Stropoli of 319 Brookwood Trail, McHenry, addressed the Sludge Council to express his objection to the placement of a landfill exper- Management imental test lot anywhere in Boone Valley and in particular to the potential site on the Shamrock Farm along Curran Road. Twenty persons from the Winding Creek Area accompanied Mr. Stropoli and also expressed their objections. Mayor Stanek called for a recess at 9:02 P.M. The meeting re convened at 9:13 P.M. with everyone still in attendance. Parks Auth.- Park Director Merkel reported that two price proposals had & been received for construction of two piers at Petersen Park. The Pub. Prpty. price proposals were from 3 R's Pier Builders of Fox Lake for Purch. & $4,985.00 and D & D Seawall, Inc. of McHenry for $4,000.00. Repairs Motion by Bolger, seconded by Busse, to accept the proposal of D & D Seawall, Inc. at the low price proposal of $4,000.00 for construction of two piers at Petersen Park. Voting Aye: Bolger, Busse, Datz, McClatchey, Nolan, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. Park Director Merkel reported that price proposals had been received from eight nurserys concerning the purchase of trees for the Park Department. 'arks, Auth. Prpty. proposal of Clavey's Nursery in Woodstock at the price proposal of lurch. & $2,391.00 with delivery to be made by October 17, 1984. Voting Aye: Bolger, Busse, Datz, McClatchey, Nolan, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. tesignation Mayor Stanek read a letter of resignation from Chief of & Police, George Pasenelli, effective November 1, 1984. He accepted the 'ol. Dept. Chief's letter with regret and commented that the Chief had done a Misc. commendable job during his 6 1/2 years with the City. 'ol. Dept. Mayor Stanek read a letter of commendation for Officer Misc. & William Brogan concerning an incident which occurred on September 8, .ommendations 1984 and which resulted in the arrest of two subjects who confessed to the crime because of Officer Brogan's dedication to duty. The letter will be made a permanent part of his personnel file. .and Mayor Stanek reported that Mr. Henry Sadowski, President of kcquisition the Lakeland Park Property Owner's Association, had informed him by telephone that all of the titles and deeds had been signed and were en route to Attorney Narusis for final action. When all of the paper work is completed, the Lakeland Park Beaches and community house property will be turned over to the City. 'roclamation Mayor Stanek proclaimed October 16 - 23 National Lupus Week. sidewalks Motion by Smith, seconded by Snell, to grant a variation on the starting time for construction of the FAU Sidewalk Program from 7 a.m. to 6:30 a.m. Voting Aye: Bolger, Busse, Datz, McClatchey, Smith, Snell, Serritella. Monday, October 1, 1984 page 3 Motion by Nolan, seconded by McClatchey, to authorize and approve the reimbursement of $153.00 to Dawn Ferguson of the City Clerk's Office for Business Education Courses. Voting Aye: Bolger, Busse, Datz, McClatchey, Nolan, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. Motion by Nolan, seconded by Datz, that all payouts concern- ing the Chroma Corp. Industrial Revenue Bond Project be handled directly between Chroma and McHenry State Bank and exclude the City from the payout procedure process. Voting Aye: Bolger, Busse, Datz, McClatchey, Nolan, Smith, Snell, Serritella. Voting Nay: None.. Absent: None. Motion carried. Motion by Snell, seconded by Nolan, to go into executive session at 9:51 p.m. for the purpose of discussing acquisition, personnel, and pending litigation. Voting Aye: Bolger, Busse, Datz, McClatchey, Nolan, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. Motion by Snell, seconded by Busse, to go back into open session at '12:28 A.M. Voting Aye: Bolger, Busse, Datz, McClatchey, Nolan, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion by Nolan, seconded by Bolger, to pass an ordinance stating that the position of Chief of Police will be an annual appointment made by the Mayor upon the advice and consent of the Council with the screening and recommendation process for the Chief of Police position to be handled by the Police Commission Board. Voting Aye: Bolger, Busse, Datz, Nolan, Smith. Voting Nay: McClatchey, Snell, Serritella. Absent: None. Motion carried. Motion by Serritella, seconded by Snell, to authorize the Chief of Police to schedule a new patrolman for schooling immediately. Voting Aye: Bolger, Busse, Datz, McClatchey, Nolan, Smith, Snell, Serritella. Voting Nay: None Absent: None. Motion carried. Motion by Smith, seconded by McClatchey, to adjourn.
