HomeMy WebLinkAboutMinutes - 09/19/1990 - City CouncilREGULAR MEETING WEDNESDAY, SEPTEMBER 19, 1990 The Regular Meeting of the McHenry City Council was called to order by Mayor Busse on Wednesday, September 19, 1990 at 8 P.M. at City Hall. At roll call the following aldermen were present: Bolger, Donahue, Teta, Lieder, Smith, McClatchey, Patterson, Serritella. Absent: None. City staff in attendance were Attorney Narusis, Clerk Gilpin, City Administrator Peterson, Public Works Director Batt, Chief Joyce, Park Director Merkel, Building and Zoning Officer Halik. Absent: None. During the 10 Minute Public Input Session Anton Rebel of 4009 West Maple Avenue expressed his concern about the way the last City Council Meeting was run on the subject of grass seeding proposals. He also suggested that the Council deny any future requests for gas station permits. Curtis Pepe of 3609 Cornell Court expressed his concern about permitting a gas station to operate at the corner of Route 31 and McCullom Lake Road. Since the ground water table is high in that area, and if the underground tanks should leak, he was concerned that the gas or the fumes would get into the underground water system and affect some of the basements in the Mill Creek subdivision. 'Motion by Patterson, seconded by Bolger, to approve the consent agenda items as follows: Minutes of the August 23, 1990 Special City Council Meeting, the September 10, 1990 Special City Council Meeting,the September 12, 1990 Regular City Council Meeting, the Regular and Supplemental list of bills as presented, the August Treasurers Report and the August Budget Report as presented. Voting Aye: Bolger, Donahue, Lieder, Teta, Smith, Patterson, Serritella, McClatchey. Voting Nay: None. Absent: None. Motion carried. Motion by annexing 1.2 acres Bridge as presented. Voting Aye: Voting Nay: Absent: Motion carried. Motion by limiting parking in as presented. Voting Aye: Voting Nay Absent: Motion carried. Bolger, seconded by Serritella, to pass an ordinance of land at the West Abutment of the Bull Valley Road Bolger, Donahue, Lieder, Serritella, McClatchey. None None Teta, Smith, Patterson, Bolger, seconded by Donahue, to pass an ordinance city parks to areas designated as parking areas only Bolger, Donahue, Lieder, Serritella, McClatchey. None. None. Teta, Smith, Patterson The agenda item concerning the snow plowing agreement for Fegers subdivision and Country Club subdivision was referred to the Public Works Committee for further discussion. The Zoning Board of Appeals held a hearing on a request by Mobil Oil Corporation for issuance of a conditional use permit to allow the building and operation of an automobile service station, a convenience mart, and a car wash at the northwest corner of Richmond and McCullom Lake Roads. The Zoning Board of Appeals denied the request on a vote of three to two. Charles Wagner, Dennis Huffaker, and Vitas Maciukevicius appeared on behalf of Mobil Oil to answer questions of the council. Their attorney, Thomas Rupp, was also in attendance. Lengthy discussion followed on underground tank installation and detectors for leaks, soils analysis, EPA requirements, screening and landscaping, size and height of signs, curb cuts on Route 31, and measures to adequately protect the residential neighborhood adjacent to the proposed station. Motion by Lieder, seconded by Serritella, to utilize the Retained Personnel Account of Mobil Oil and 1) Direct the City Engineers to review the Engineering Reports of the Mobil Oil Company Engineers and authorize the City Engineers to take whatever tests are necessary to assure that the environment of the Mill Creek neighborhood is protected; 2) To get a review back from IDOT as to where the curb cuts should be on Route 31, and on McCullom Lake Road; 3) Direct the City Administrator to Wednesday, September 19, 1990 73 work with the petitioners to have them meet the same standards that were imposed recently on the new Mobil and Amoco gas stations as to hours of operation, closing doors on the car wash, hours of operation of the convenience center, and the type of sign to be installed. Voting Aye: Serritella, Smith, Lieder, Teta, Donahue, Bolger. Voting Nay: Patterson, McClatchey. Absent: None. Motion carried. Mayor Busse called for a recess at 9:44 P.M. The meeting reconvened at 9:55 P.M. with everyone still in attendance. Motion by Donahue, seconded by Serritella, to authorize the expenditure of $4,774 to install drainage improvements on McHenry Avenue near the salt storage building to handle the heavy water run-off which comes from the North and West, as recommended by Baxter and Woodman. Voting Aye: Bolger, Donahue, Lieder, Teta, Smith, Patterson, Serritella, McClatchey. Voting Nay: None. Absent: None. Motion carried. Motion by Smith, seconded by Patterson, to authorize and approve the issuance of Picnic Beer Permits as presented. Voting Aye: Bolger, Donahue, Lieder, Teta, Smith, Patterson, Serritella, McClatchey. Voting Nay: None. Absent: None. Motion by McClatchey, seconded by Patterson, to appoint Public Works Director Fred Batt to serve as the City's delegate on the McHenry County Solid Waste Advisory Committee, with Mayor Busse and City Administrator Peterson to serve as alternates. Voting Aye: Bolger, Donahue, Lieder, Teta, Smith, Patterson, Serritella, McClatchey. Voting Nay: None. Absent: None. Motion carried. The following Open House Meetings were announced by the Aldermen: Ward 2, September 20, 1990 at Whispering Oaks Community Center, Ward 3 at the City Council Chambers, Ward 4 November 17, 1990 at the Lakeland Park Community House. Motion by Smith, seconded by McClatchey, to adjourn Voting Aye: Bolger, Donahue, Lieder, Teta, Smith, Patterson, Serritella, McClatchey. Voting Nay: None. Absent: None. Motion carried.
