Regular Meeting of the City Council was called to Order by Mayor Council Stanek on Monday, September 19, 1983 at 8:00 P.M. At roll call the follow- Meeting ing aldermen were present: Bolger, Nolan, Busse, Datz, McClatchey, Smith, Snell, Serritella. Absent: None. City Staff in attendance were Supt. Attendance Halvensleben, Attorney Narusis, Clerk Gilpin, Chief Pasenelli, Park Director Merkel. Motion by Snell, seconded by Datz, to accept the minutes of the September 7, 1983 Regular Meeting as presented. Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. Mike Cajthaml of the McHenry Area Chamber of Commerce addressed Chamber of the Council to inform them of the crime stoppers program which the Chamber Commerce plans to sponsor in the McHenry area. Motion by Snell, seconded by Nolan, to pass a resolution support- ing the Chamber and its proposal for the crime stoppersprogram in McHenry. Resolutions Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. Mr. and Mrs. Joseph Nowak of 5112 Cambridge Drive approached the Fence Council to request a fence variation. After discussion they withdrew their variation request. Motion by Nolan, seconded by Datz, to authorize and approve the ex- Rt. 120 penditure of approximately $12,000.00 for the installation of seven street Bridge lights in connection with the Route 120 bridge reconstruction. Recon. & Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Smith, Snell, St. Maint. Serritella. & Repairs Voting Nay: None. Absent: None. Motion carried. Park Director Merkel reported on the bid opening for a garage/ concession stand and washroom building in Petersen Park. Two bids were received as follows: William Tonyan & Sons, McHenry bid total $66,700.00 — alternate bid total $68,500.00; Decker Construction Inc. of McHenry bid total $69,700.00—alternate bid total $74,600.00. Motion by Datz, seconded by Nolan, to award the bid for the Petersen Bid Park garage/concession stand and washroom building to the low bidder William Openings Tonyan & Sons for the alternate bid of $68,500.00. Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Serritella. Parks Voting Nay: Smith, Snell. Auth. Absent: None. Motion carried. Motion by Busse, seconded by Nolan, to pass an ordinance amending Ordinances the Driving Under the Influence Ordinance as presented. Traffic Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Serritella, Regulation Smith, Snell. Voting Nay: None. Absent: None. Motion carried. Bill Thomas and Terry Lock of the McHenry Lions Club informed the Council that on October 18 from 1:00 P.M. to 3:00 P.M. the Lions Club would install seat restraint items in support of the Child Safety Regulations. Motion by Nolan, seconded by Snell, to pass a resolution proclaiming Resolution October 1.8, 1983 as McHenry Lions Club Safety Restraint Day. Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Serritella, Smith, Snell. Voting Nay: None. Absent: None. Motion carried. Monday, September 19, 1983 Page 2 Cleanup Motion by Smith, seconded by Datz, to authorize advertisement Days and notification to the citizens of McHenry that the last branch pick- up in the City of McHenry for this year will be the first week in October with emergency storm branch pickuptobedone whenever necessary. Committees The Purchasing Committee was instructed to work with the Finance Auth. Committee and study the request of the Water Department for a new van. Instructions They are to report back at the next meeting with their recommendation. Bldg. Code Motion by Busse, seconded by Nolan, to amend the City of McHenry Amendments Building Code as follows: Exterior construction of multi -family dwell- ings in the "R-4", "R-4A", and "R-4B" Multi Family Zoning Districts shall Ordinances be a minimum of 75% brick, brick veneer, stone or masonry material. Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. Bldg. Code Motion by Busse, seconded by Datz, to amend the City of McHenry Amendments Building Code as follows: Every dwelling unit in the "R-4", 11R-011, "R-4B", "R-511, "R-5A" or any other similar Multi -Family or Condominium Zoning Ordinances District which may be created after the effective date of this section shall contain smoke/fire detection devices with an audible warning signal. Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. Bldg. Code Motion by Nolan, seconded by Datz, to amend the City of McHenry Amendments Building Code as follows: A minimum one car garage shall be required for all single family residences. Motion by Busse, seconded by Serritella, to amend the City of McHenry Building Code as follows: Garages presently existing on existing structures in any Zoning District shall not be converted into living space unless another one car garage is provided on the premises. Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Smith, Serritella, Snell. Voting Nay: None. Absent: None. Motion carried. Motion by Smith, seconded by Serritella, to amend the City of McHenry Building Code as follows: Storm water drains or foundation drain- age lines regardless of location shall not be drained into Sanitary Sewers. Sump pumps will also be required for below grade drainage. Overhead sanitary sewers will be required. Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Smith, Serritella, Snell. Voting Nay: None. Absent: None. Motion carried. Motion by Smith, seconded by Datz, to authorize Supt. of Public Works to advertise for bids on the Summer Sidewalk Replacement Program with bids to be opened October 10, 1983. Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Smith, Serritella, Snell. Voting Nay: None. Absent: None. Motion carried. Motion by Smith, seconded by Busse, to authorize and approve pay- ment of $8,928.36 from the MFT Fund as the City's share of the Bull Valley Road (from the west corporate limits to the Fox River) intermittent resurfac- ing project. Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Smith, Serritella, Snell. Voting Nay: None. Absent: None. Motion carried. Motion by Nolan, seconded by Datz, to authorize and approve City Clerk's attendance at the 1983 Municipal Clerk's Institute and Academy in Champaign, Illinois from October 24-28, 1983. Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Smith, Serritella, Snell. Voting Nay: None. Absent: None. Motion carried. Clerk Gilpin distributed copies of the 1982-83 audit as presented by YapelliKetchmark. The aldermen are to review the audit and Mr. Yapelli will appear at the October 17 meeting to answer any questions. Motion by Nolan,seconded by Busse, to authorize and approve the purchase of a set of soccer goals from Parkland Junior High School at a cost of $550.00. Code Amendments Ordinances Bid Auth. Sidewalks Motor Fuel Tax St. Maint. & Repairs Authorization. City Clerks Office Audits Purchases Park Dept. September 19, 1983 Page 8 Alderman Datz, Chairman of the Insurance Committee, advised Insurance that the city had received its renewal proposal on the workmans compensa- tion insurance. Our new carrier will be Optimum Ideal Inc. and the cost will be 15 to 20% lower than our present premium. Effective date of the renewal is October 7, 1983.
