The Regular Meeting of the McHenry City Council was called to order by Mayor Stanek on Monday, September 17, 1984 at 8:00 P.M. Council At roll call the following Aldermen were present: Bolger, Busse, Meeting Datz, McClatchey, Nolan, Smith, Snell, Serritella. Absent: None. City staff in attendance were Supt. Halvensleben, Attorney Narusis, Attendance Clerk Gilpin, Chief Pasenelli, Park Director Merkel. Motion by Smith, seconded by Serritella, to accept the minutes of the September 5, 1984 and September 10, 1984 Regular Meetings as presented. Voting Aye: Bolger, Busse, Datz, McClatchey, Nolan, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. Discussion was held on the Zoning Board of Appeals recom- mendation regarding a petition from McHenry County Association for the Retarded requesting a special use under the Zoning Ordinance to operate a residential living facility for no more than six develop- mentally disabled persons on property located at 3904 W. West Avenue. Attorney James Bishop addressed the Council as a repre- sentative of objectors to the granting of the special use petition. Attorney James Militello and Executive Director Robert Lambourn also addressed the Council representing McHenry County Association for the Retarded. Albin Marrow addressed the Council speaking in his own behalf. A question and answer period took place between the Aldermen and the Attorneys concerning the petition. Mayor Stanek asked that it be entered into the records that all of the Aldermen had received the report and recommendation of the Zoning Board of Appeals concerning the petition and had read the findings. Motion by Busse, seconded by Nolan, to concur with the ZB Recomm. Zoning Board of Appeals recommendation and pass an ordinance grant- & ing a special use permit to McHenry County Association for the Zon. Ord. Retarded as requested in the petition. Voting Aye: Bolger, Nolan, Busse, Datz, Snell. Voting Nay: McClatchey, Smith, Serritella. Absent: None. Motion carried. Motion by Nolan, seconded by Datz, to authorize and approve Knox Pk. Dev. the purchase of one acre parcel of land adjacent to Knox Park from & Howard and Maryanne Knox at a cost of $5,000.00, and to also author- Pub. Prop. ize and approve the installation of a 5 foot cyclone fence on the Purchases & east and south portion of the property in question. Repairs Voting Aye: Bolger, Busse, Datz, McClatchey, Nolan, Smith, Serritella. Voting Nay: Snell. Absent: None. Motion carried. Don Gerstad, President of Residential Development Group, addressed the Council concerning acceptance of Boone Valley Unit 14 and Winding Creek Unit 1. _etters of Cred. Motion by Smith, seconded by McClatchey, to accept the & Boone Valley Unit 14 Subdivision upon receipt of the as built plans Subd. of Land for the subdivision. Voting Aye: Bolger, Busse, Datz, McClatchey, Nolan, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carrried. Motion by McClatchey, seconded by Smith, to accept Winding Creek Unit No. 1 Subdivision contingent upon receipt of a cash bond to complete the sidewalks and repair depressed curbs in the subdi- vision with the stipulation that all sidewalks must be in within a two year period of time. Voting Aye: Bolger, Busse, Datz, McClatchey, Smith, Serritella, Nolan. Voting Nay: Snell. Absent: None. Motion carried. _etters of Motion by Smith, seconded by Busse, to authorize the Credit release of a letter of credit in the amount of $23,375.00 for Boone Valley Unit No. 14 and the release of a letter of credit in the amount of $102,327.00 for Winding Creek Unit 1 contingent upon a receipt of a cash bond to complete the sidewalks and replace depressed curbs in Winding Creek Unit I. Voting Aye: Bolger, Busse, Datz, McClatchey, Nolan, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Schaupp for an accident that occurred in 1979. Aye: Bolger, Busse, Datz, McClatchey, Nolan, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. ewer Dept. Motion by Snell, seconded by Bolger, to authorize and .epairs, approve final payment request No. 4 for the Centrifuge Purchase and mprvt. Performance Test in the amount of $6,953.33 payable to International Piping Systems Inc. as recommended by Baxter & Woodman in their letter of September 12, 1984. Mayor Stanek declared a recess at 10:02 P.M. The meeting reconvened at 10:24 P.M. with everyone still in attendance. Bob Price, Don Stacey and Ed Hammer, representing GAS Inc. addressed the Council concerning a co-sponsorship agreement. Motion by Datz, seconded by Nolan, to enter into an agree- ment with Great American Salvage Corp. for a Co-sponsorship and Feasibilty Study Agreement and to authorize the Mayor and Clerk to sign said agreement. Voting Aye: Bolger, Busse, Datz, Nolan, Smith, Snell. Voting Nay: McClatchey, Serritella. Absent: None. Motion carried. The representatives of GAS, Inc. presented five potential demonstration sites for the GAS testing program. They were as follows: 1. Future sewerage treatment site on the Decker Property adjacent to Brittany Heights. 2. Charles Budreck Farm site. 3. Walter Bolger Farm site. 4. Tonyan Industrial Park site. 5. Shamrock Beef Cattle Farms site. Following discussion it was decided to eliminate No. 1 site and to authorize GAS Inc. to proceed with further testing on the remaining four sites. Motion by Snell, seconded by Nolan, to authorize GAS Inc. to contact the Illinois EPP, and proceed with further testing of the four sites in question ands report back to the Council at a later date for approval of a final' site. Voting Aye: Bolger, Busse, Datz, Nolan, Smith, Snell. Serritella. Voting Nay: McClatchey. Absent: None. Motion carried. Motion by Bolger, seconded by Datz, to accept the August Treasurer's Report as presented. Voting Aye: Bolger, Busse, Datz, McClatchey, Nolan, Smith, Snell, Serritella. Voting Nay: None. Absent: None. He presented for consideration the ZBA appointment of Philip W. Coatar of 917 Oakwood Drive to the Zoning Board of Appeals to fill the unexpired term of Mrs. Halverson. 4pptmts. Motion by Nolan, seconded by Datz, to approve the Mayor's )fficial, etc. appointment of Philip Coatar to the Zoning Board of Appeals to fill & the unexpired term of Kay Halverson who's term expires April 30, ZBA 1985. Motion by Datz, seconded by Bolger, to authorize Baxter & repairs, Woodman to draw up specifications for the restoration and repair of Imprvt. the aeration pipe on the aeration tank at the sewer plant. Mathews and inform him that his offer as stated in his letter of September 10, 1984 to the City Council is far apart from what the City could accept and therefore the Council suggest that he make a more sensible offer for Council consideration.
