HomeMy WebLinkAboutMinutes - 09/16/1992 - City CouncilREGULAR MEETING SEPTEMBER 16, 1992 The Regular Meeting of the McHenry City Council was called to order by Mayor Busse on Wednesday, September 16, 1992 at 7:30 P.M. in the Council Room of the Municipal Center. At roll call the following Aldermen were present: Bolger, Donahue, Lieder, Locke, Smith, Adams, Serritella. Patterson arrived at 7:40 P.M. Absent: None. City Staff in attendance: City Clerk Gilpin, City Administrator Peterson, Director of Parks and Recreation Merkel, Director of Public Works Batt, Director of Building and Zoning Lobaito, Chief of Police Joyce. Absent: City Attorney Narusis. TEN MINUTE PUBLIC INPUT SESSION Elmer Freund and James Higgins. requested that they be allowed to speak during the agenda item on parkway lawn damage instead of during the Ten Minute Public Input Session. Motion by Locke, seconded by Bolger, to allow Freund and Higgins to speak on the parkway lawn damage issue when it is brought before the Council as an agenda item. CONSENT AGENDA Motion by Bolger, seconded by Donahue, to approve the Consent Agenda as follows: (1) Approve August 24, 1992 Special City Council Meeting Minutes; (2) Approve August 27, 1992 Committee Meeting of the Whole Minutes; (3) Approve September 2, 1992 Regular City Council Meeting Minutes; (4) Approve Block Party request of Bruce Thacker of Highview Avenue — for September 19, 1992; (5) Approve reduction in Letter of Credit for Burning Tree, Unit 1 - $22,400; and establish Maintenance Warranty for $3,584.00; (6) Approve August Treasurer's Report, as presented; (7) Approve August Budget Report, as presented; (8) Authorize and Approve payment of August Bills, as presented; (9) Approve and Pass Resolution in recognition of Richard S. SPECIAL RECOGNITION AWARDS Director of Parks and Recreation Merkel Recognition to seven part-time employees of served for at least 10 years: Gary Gray Jensema - Preschool and Basketball, Jill S Team, Dan Boland - Track, Biddy Basketball, Shanahan - Swim Lessons and Swim Team, Supervisor. presented plaques for Special Park Summer Programs who have and Tim Gray - Tennis, Joan tone - Swim Lessons and Swim River Run and Football, Mike and Pat Wirtz - Softball Mayor Busse expressed appreciation to those individuals on behalf of the City Council and the citizens of McHenry for their dedication over the past years to the Youth and Adult programs in the community. September 16, 1992 Page 4 PARKWAY LAWN DAMAGE On August 19, 1992 the City Council passed a motion to restore or repair parkway damage along Front Royal and Ashley Drives for two locations. On August 20, 1992 Mayor Busse vetoed the Council action of August 19, 1992 and so notified the Aldermen by letter. Tonight, Mr. Higgins asked that he be allowed to read a statement at the Council meeting requesting that the Mayor's veto be overriden by the Aldermen. During the discussion, Mr. Calvin and Mr. Freund also made comments on the parkway issue. Motion by Patterson, seconded by Locke, that the City should spend no greater than $500 to restore the two parkways on City property. Voting Aye: Locke, Bolger, Serritella, Patterson. Voting Nay: Lieder, Donahue, Adams, Smith. Absent: None. There being a tie vote, Mayor Busse cast a "Nay" vote, and declared the motion did not carry. SIGN VARIATION REQUEST Little Caesar's Pizza Station located in the K-Mart store at 1900 N. Richmond Road, requested a variation in the allowable size of a sign to advertise their location in the City. The maximum allowable sign under the City's ordinance is 57 square feet. The sign being requested was for 68 square feet. Motion by Patterson, to approve the sign variation request at a size -- not to exceed 66 square feet. Motion failed for lack of a second. Motion by Donahue, seconded by Locke, to grant the sign variation request as presented, for a sign not to exceed 68 square feet. Voting Aye Voting Nay Absent: Motion carried. ADDITIONAL CONDITIONAL USE FOR SPOT AMUSEMENTS Kevin Mundt and his attorney John Roth addressed the Council to request expansion of a conditional use to include an area for expansion of Spot Amusements. A drawing of the business expansion was presented to the Aldermen at this meeting. Because of the lack of time to study the proposal, Aldermen asked that the matter be postponed to the next regular meeting. Mr. Mundt agreed to return at the September 30 meeting to make the presentation. WARD REDISTRICTING Alderman Smith read a statement in which he commented on a referendum that is to be voted on at the November 3 General Election. CHANGE ORDER - FRONT STREET WATER MAIN PROJECT The City is undertaking the construction of a 12" water main on Front Street to improve water distribution in the South end of the City. The Illinois Department of Transportation would not approve the engineering plans which included filling the drainage ditch in the right-of-way. As a result, the City has to seek a change order from the contractor. Motion by Locke, seconded by Lieder, to approve the change order to Yonke & Soper in the amount of $7320.00, as presented. Voting Aye: Bolger, Donahue, Lieder, Locke, Smith, Adams, Patterson, Serritella. Voting Nay: None. Absent: None. Motion carried. Mayor Busse called for a recess at 8:50 P.M. September 16, 1992 Page 5 STATE MANDATES REFERENDUM ACT - RESOLUTION The States Mandates Act has placed tremendous financial burdens upon municipalities to accomplish priorities established by the State of Illinois. There will be a formal question on the November Ballot concerning this matter. The Illinois Municipal League is asking residents throughout the State of Illinois to vote "Yes" on the non -binding advisory referendum to notify legislators that they should refrain from adopting new unfunded State mandates that would impose additional costs on local units of government and cause an increase in property taxes. Motion by Locke, seconded by Lieder, to pass a resolution that the City Council urge a "Yes" vote on the State Mandates Act Referendum. Voting Aye: Bolger, Donahue, Lieder, Locke, Smith, Adams, Patterson, Serritella. Voting Nay: None. Absent: None. Motion carried. BOAT LAUNCH - SOUTH RIVERFRONT PARK Director of Parks and Recreation Merkel made a presentation to the Council on the status of the Boat Launch project which began in 1988. Ken Fiske of Conservation Services who is working with the City on the project was also present to explain the Wetland Management Plan of Action. Six property restrictions or conditions of the permit were discussed in detail. Motion by Patterson, seconded by Locke, to approve the property restrictions or conditions of permit as presented, and instruct the Director of Parks and Recreation to submit those conditions to the Corps of Engineers for approval. Voting Aye: Bolger, Donahue, Lieder, Locke, Smith, Adams, Patterson, Serritella. Voting Nay: None. Absent: None. Motion carried. MAYOR - STATEMENT AND REPORTS Mayor Busse proclaimed the week of September 17 - 23 as Constitution Week in the City of McHenry, and urged all citizens to reflect during that week on the many benefits of our Federal Constitution and American citizenship. Mayor Busse announced that a meeting on Senate Bill 1828 would be held on September 23 at the DuPage County Fairgrounds concerning proposed impact fee restrictions for municipalities. He urged everyone to attend. A SAMP meeting will be held on Tuesday, September 29, 1992 at 7:30 P.M. in the Council Chambers of the Municipal Center. WARD REDISTRICTING ARTICLE IN NEWSLETTER The question arose as to whether an article should be published in the City Newsletter on ward redistricting and the number of Aldermen per ward. Motion by Serritella, seconded by Smith, not to use the City Newsletter for discussion of ward redistricting or the number of Aldermen per ward issue. Voting Aye: Bolger, Donahue, Lieder, Locke, Smith, Adams, Patterson, Serritella. Voting Nay: None. Absent: None. Motion carried. September 16, 1992 Page 6 Motion by Lieder, seconded by Patterson, to cancel the September 23, 1992 Committee Meeting of the Whole which was scheduled to discuss ward redistricting, and not to schedule any meetings on the matter until after the November Election. Voting Aye: Voting Nay Absent: Motion carried. MEETING SCHEDULES Bolger, Donahue, Lieder, Locke, Smith, Adams, Patterson, Serritella. None. None. A Finance Committee meeting was scheduled for Wednesday, September 30, 1992 at 7:00 P.M. to meet with employee representatives to establish a format for discussion of employee insurance benefits. A Building, Zoning, and Planning Committee Meeting was scheduled for Wednesday, September 23, 1992 at 7:00 P.M. to discuss various requests from the Church of the Holy Apostles. Motion by Smith, seconded by Lieder, to schedule a Special Meeting on Monday, October 5, 1992 at 7:30 P.M. to discuss the Fritsch/Centex Annexation proposal. Voting Aye: Bolger, Donahue, Lieder, Locke, Smith, Adams, Patterson, Serritella. Voting Nay: None. Absent: None. Motion carried. BENEFIT BAND CONCERT REQUEST Long John Silver's Restaurant on Elm Street requested permission to sponsor a band concert from 2:00 - 6:00 P.M. on September 19, 1992 to benefit the Hurricane Andrew victims. Aldermen felt the traffic congestion in that area, and limitation of pedestrian access to the site would cause a dangerous situation. Motion by Serritella, seconded by Smith, to deny the request for the band concert, as presented. Voting Aye: Donahue, Locke, Smith, Adams, Patterson, Serritella. Voting Nay: None. Absent: Bolger, Lieder. Motion carried. VARIATION FOR CONSTRUCTION MATERIALS AT WHISPERING POINT CENTER Gerstad Builders presented a request for a variation on exterior construction materials to be used for the condominium commercial buildings at Whispering Point Center on Crystal Lake Road in order to match the existing buildings which were built several years ago. Motion by Adams, seconded by Bolger, to grant the request of Gerstad Builders and waive the requirements of Municipal Code Chapter 7-13(b) concerning the use of exterior construction materials for the Whispering Point Condominium commmerical buildings. Voting Aye: Bolger, Donahue, Lieder, Locke, Smith, Adams, Patterson, Serritella. Voting May: None. Absent: None. Motion carried. EXTENSION OF WATER MAIN TO BISCAYNE HIGHLANDS Motion by Serritella, seconded by Bolger, to advertise for bids on extension of the water line to Biscayne Highlands from the Tonyan Industrial Park water main extended line. Voting Aye: Bolger, Donahue, Lieder, Locke, Smith, Adams, Patterson, Serritella. Voting Nay: None. Absent: None. rc"o^ carried. September 16, 1992 Page 7 COUNTRY CLUB ESTATES SEWER SURVEY City Clerk Gilpin was authorized to tally the results of the Country Club Estates sewer survey which was to be returned by September 14th. Results of the survey indicated 77 ballots were sent, 71 were returned. Voting for sewer installation: 42 Yes, 29 No. On the method of financing: Special Service Area 39, Special Assessment 20, No Answer 12. It was decided that the method of financing would be placed on the September 30, 1992 Regular City Council Meeting Agenda for discussion. EXECUTIVE SESSION Motion by Smith, seconded by Adams, to go into Executive Session at 10:30 P.M. to discuss personnel. Voting Aye: Bolger, Donahue, Lieder, Locke, Smith, Adams, Patterson, Serritella. Voting Nay: None. Absent: None. Motion carried. Motion by Serritella, seconded by Adams to go back into Open Session at 10:42 P.M. Motion by Locke, seconded by Lieder, to waive the two week notice requirement and authorize payment of unused sick days as per the City of McHenry Personnel Policy Manual, to Officer William Stahlman who recently resigned from the Police Department.
