MONDAY, SEPTEMBER 15, 1980 8 P.M.
The Regular Meeting of the McHenry City Council was called to order
by Mayor Stanek on Monday, September 15, 1980 at 8 P.M. At roll call the
following aldermen were present: Pepping, Nolan, Harker, Datz, Wieser, Adams,
Schooley, Meurer. Absent: None.
Also present were Supt. Meyer, Attorney Bernard Narusis, City Clerk
Gilpin, Park Director Merkel and Police Chief Pasenelli.
Motion by Datz, seconded by Nolan, to approve the minutes of the
September 3, 1980 Regular Meeting as read.
Voting Aye: Pepping, Nolan, Harker, Datz, Wieser, Adams, Schooley,
Meurer.
Voting Nay: None.
Absent: None.
Motion carried.
Motion by Wieser, seconded by Pepping, to schedule a Public Hearing
on the McHenry Group Annexation proposal for Wednesday, October 15, 1980 at
Voting Aye: Pepping, Nolan, Harker, Datz, Wieser, Adams, Schooley,
Meurer.
Voting Nay: None.
Absent: None.
Motion carried.
The Public Hearing on the McHenry Lakes Estates third amendment to
the Annexation Agreement was called to order at 8:14 P.M. Dan Curran, Attorney
for petitioners Towne and Orleans, requested that the hearing be recessed
to another date since he was not prepared to present his proposal at this time.
Mayor Stanek asked if there was anyone in the audience who was appearing as an
objector at this public hearing. There were no indications from anyone in the
audience that they were objectors in this matter. Appearing with Attorney
Curran for the petitioners were John Smith, an engineer, and Howard Holtzman,
a land planner and architect.
Motion by Meurer, seconded by Nolan, to recess this Public Hearing
to Monday, October 27, 1980 at 7:30 P.M.

Motion by Schooley, seconded by Meurer, to grant a fence variation
to Dan Kennedy of 5521 W. Shore Drive, as outlined in his alternate design.

Meurer.
Voting Nay: None.
Absent: None.
Motion carried.
Motion by Wieser, seconded by Harker, to authorize the city attorney
to draw up amendments to the Fence Ordinance as recommended by the License
Committee.
Voting Aye: Pepping, Nolan, Harker, Datz, Wieser, Adams, Schooley,
Meurer.
Voting Nay: None.
Absent: None.
Motion carried.
Motion by Harker, seconded by Adams, to authorize and approve payment
of Estimate No. 10 to Keno & Sons Construction Co. for sewaqe treatment plan
additions in the amount of $47,438.10 as recommended by Baxter & Woodman.
Voting Aye: Pepping, Nolan, Harker, Datz, Wieser, Adams, Schooley,
Meurer.
Voting Nay: None.
Absent: None.
Motion carried.
Motion by Wieser, seconded by Meurer, to approve and authorize the
following tag days: Sept. 20, 1980 for the McHenry Hornets Junior Football
League and Oct. 18, 1980 for A.L.S. (Lou Gehrig's disease).

Motion by Wieser, seconded by Adams, to approve an increase of 50
cents per month for disposal service rates which would make the charge as of
October 1, 1980 $6.00 per month with no bag or container limit.

Meurer.

Absent: None.
Motion carried.
Lewis Hill, Chairman of the RTA, presented a plaque to Mayor Stanek
in appreciation for cooperation in assisting the RTA to provide increased
services for the city and county of McHenry. Hill announced that a new RTA
diesel engine had been named "The City of McHenry" in the city's honor.
Mayor Stanek called a recess at 9:21 P.M. The meeting was reconvened
at 9:36 P.M. with everyone still in attendance.
Motion by Schooley, seconded by Harker, to pass an ordinance
establishing no parking area in front of 1312 N. Riverside Drive from 6 A.M.
to 6 P.M.
Voting Aye: Pepping, Nolan, Harker, Datz, Wieser, Adams, Schooley,
Meurer.
Voting Nay: None.
Absent: None.
Motion carried.
Motion by Schooley, seconded by Adams, to pass an ordinance
establishing Loading Zone areas at 3308 W. Pearl St. and on the west side of
Riverside Drive south of Elm Street.
Voting Aye: Pepping, Nolan, Harker, Datz, Wieser, Adams, Schooley,
Meurer.
Voting Nay: None.
Absent: None.
Motion carried.
Motion by Schooley, seconded by Wieser to pass an ordinance establish-
ing cost sharing rates for sidewalk construction and repair on a 50-50 basis.

Motion by Schooley, seconded by Meurer to purchase materials and
install drainage tile to handle the water runoff from the south parking lot
in Petersen Park which results in a drainage problem on the west side of Oak
Street.

Meurer.

Motion by Schooley, seconded by Nolan, to authorize and approve
payment of 1980-81 annual dues for the Northeastern Illinois Planning Commission
(NIPC) in the amount of $466.
Voting Aye: Pepping, Nolan, Harker, Datz, Wieser, Adams, Schooley,
Meurer.
Voting Nay: None.
Absent: None.
Motion carried.
Alderman Nolan, Chairman of the Band Committee, was requested to
determine the amount of donation due to the Musicians Union for summer band
concerts and to report back at the next meeting.
Motion by Harker, seconded by Nolan, to authorize the mayor to
distribute up to an aggregate amount of $200 in bonuses to selected summer
help employees to acknowledge their excellent work during the summer months.
Voting Aye: Pepping, Nolan, Harker, Datz, Wieser, Adams, Schooley,
Meurer.

Motion carried.
Motion by Datz, seconded by Nolan, to designate 35 parking stalls
in the Green Street parking lot for permit parking at a rental fee of $10.00
per month, six days per week from 6 A.M. to 6 P.M. with the final determination
as to who will be alloted the permit parking stalls to be decided by the City
Council.
Voting Aye: Pepping, Nolan, Harker, Datz, Wieser, Adams, Schooley,
Meurer.

Absent: None.

Motion by Harker, seconded by Nolan, to pass an ordinance establish-
ing 2-hour parking in the 113 parking stalls remaining in the Green Street
parking lot and to publish the ordinance in pamphlet form.

Motion by Pepping, seconded by Datz, to accept a fee of $300 per
month from the Village of McCullom Lake as opposed to the $600 fee that was
originally proposed with the lesser fee to be effective October 1, 1980.

Motion by Schooley seconded by Harker, to approve the Treasurer's
August report as presented.
