HomeMy WebLinkAboutMinutes - 09/11/1991 - City CouncilREGULAR CITY COUNCIL MEETING WEDNESDAY, SEPTEMBER 11, 1991 The Regular Meeting of the McHenry City Council was called to order by Mayor Busse on Wednesday, September 11, 1991 at 8:00 P.M. in the Council Room at 1111 N. Green Street. At roll call the following Aldermen were present: Adams, Bolger, Donahue, Lieder, Locke, Patterson, Serritella, Smith. City Staff in attendance were: Assistant to City Clerk Marth, City Administrator Peterson, Director of Building and Zoning Halik, Attorney Narusis, Director of Public Works Batt. Absent: City Clerk Gilpin, Director of Parks & Recreation Merkel, Chief of Police Joyce. PUBLIC INPUT: Former Alderman Gary Snell requested permission to hold a secon nnual Holy Apostles' Walkathon on Saturday, October 19th from 8:30 a.m. to 12:30 p.m. in the Fox Ridge area, using City sidewalks and park facilities. The first $10,480 raised this year will be donated to three local organizations: The Home of the Sparrow; Pads of McHenry County and Fish of McHenry. Any amount raised over this amount will benefit Holy Apostles' Building Fund. Motion by Patterson, seconded by Serritella, to allow Holy Apostles Church to hold their second Walkathon on October 19, 1991 (rain date October 26, 1991) in the Fox Ridge area using City sidewalks and park facilities. Voting Aye: Lieder, Locke, Donahue, Bolger, Serritella, Patterson, Adams, Smith. Voting Nay: None. Absent: None. Motion carried. No one else signed up for the ten minute public input session. CONSENT AGENDA: Motion by Patterson, seconded by Serritella, to approve the tollowi5g Consent Agenda as corrected. - Approved Minutes of September 4, 1991 Regular City Council Meeting as corrected by the City Clerk. - Approved Picnic/Beer Permits. Voting Aye: Lieder, Locke, Donahue, Bolger, Serritella, Patterson, Adams, Smith. Voting Nay: None. Absent: None. Motion carried. RESOLUTION RECOGNIZING CHAIRMAN OF THE ZONING BOARD OF APPEALS JAMES A. on by Donahue, seconded y Bolger, to pass a Resolution reco— gazing James A. Fouse for his many years of service upon his resignation from the Zoning Board of Appeals. Voting Aye: Lieder, Locke, Donahue, Bolger, Serritella, Patterson, Adams, Smith. Voting Nay: None. Absent: None. Motion carried. The Resolution will be presented to Mr. Fouse at a later meeting. NORTH ORCHARD SUBDIVISION PRELIMINARY PLAT: Discussion on the approval of the Preliminary Plat for North OrchardSubdivision located on Riverside Drive outside the corporate limits of the City was postponed to a future meeting when the owner could be present. The Aldermen had many questions that could not be answered by the owner's representative, Robert Schmidt of Brandenburg Development, Northbrook, IL. MUNICIPAL CENTER ENTRANCE SIGN: The Council had previously reviewed and chose a design for the unic pal Center main entrance sign. Price quotes were then solicited for the construction of the sign as follows: Concrete Foundation/Frett & Son $2,015.00 Masonry/Charles Heelein Construction 3,325.00 Precast Stone/Edwards Precast 3,500.00 Cast Bronze Aluminum Letters/Hughes Signs 1,745.00 Lighting of Sign/Carey Electric 1,895.00 Construction Management/Prime Dev. (10%) 1,248.00 Total Tri_ 8.66- September 11, 1991 Regular Council Meeting Page 2. The total amount of $13,728.00 is under the $20,000 budgeted for this project. Discussion by the Aldermen followed which consentrated on the lettering size. Most thought the six inch lettering for "McHenry Municipal Center" and four inch lettering for "333 S. Green Street" was too small and would be difficult to read by the public driving past, even though the proposed letter size was based on published sign standards. Motion by Smith, seconded by Serritella, to approve the construction of the Municipal Center entrance sign with letters to be eight inch (top line capitals) and six inch (bottom line capitals) and any additional cost being added to the quoted figure of $13,728.00. Voting Aye: Lieder, Locke, Donahue, Bolger, Serritella, Patterson, Adams, Smith. Voting Nay: None. Absent: None. Motion carried. The entrance sign also required a sign variation since it was not included in the Conditional Use zoning granted on the residentially zoned property that the Center is located on. Only apartment building identification signs and development signs are permitted in residentially zoned districts. Motion by Smith, seconded by Serritella, to grant a sign variation to the City of McHenry allowing construction of the Municipal Center monument -type sign. Voting Aye: Lieder, Locke, Donahue, Bolger, Serritella, Patterson, Adams, Smith. Voting May: None. Absent: None. Motion carried. ORDINANCE REGULATING PARKING: Since it is no longer necessary to limit parking in the rear of 1111 N. Green Street to City employees or limit parking in front of the building to fifteen minutes, an ordinance was presented to repeal these sections of Chapter 13, known as the Ordinance Regulating Traffic and Motor Vehicles. Motion by Patterson, seconded by Adams, to pass an ordinance as presented, repealing Section 13-1211 and 13-1226.8.2 relating to employee parking and fifteen minute parking at 1111 N. Green, and to reword Section 13-1228.3 relating to two hour parking on Green Street to now include the former fifteen minute parking in front of 1111 N Green. Voting Aye: Lieder, Locke, Donahue, Bolger, Serritella, Patterson, Adams, Smith. Voting Nay: None. Absent: None. Motion carried. SCHOOL DONATIONS - CUNAT BROS., INC: The Cunat Brothers had been paying school developer ona ion ees on eir Irish Prairie project under protest from April 26, 1989 to approximately May 11, 1991. They believed that efficiency and one -bedroom units had substantially less impact on schools then did single-family residences and were not assessed equitably until the recently passed Developer Donation Ordinance (5-1-91) which assessed no developer donations for schools on efficiency or one -bedroom units. Attorney Sam Diamond and John Cunat appeared before the Council present their request for a credit or reimbursement on the difference the amount of protested fees they paid per unit since April, 1989 to effective date of the current ordinance. Since a refund of fees from schools seemed unlikely, they were asking that credits be applied future building permits. to in the the to Discussion followed. Some members of the Council believed they had deliberated long and in depth in the past to come up with the school donation fee schedule based on the information they considered. They felt the 1989 ordinance was passed in good faith and refunding money now would set a bad precedent. A few Aldermen believed that the Cunats' request may have some merit and suggested that it be discussed at a separate meeting. September 11, 1991 Regular Council Meeting Page 3. Motion by Lieder, seconded by Locke, to direct Finance Chairman Leider to reconstruct the 1988-89 information used on the school developer donations' ordinance passed in April, 1989 and get it back to the Council as soon as possible. Voting Aye: Lieder, Locke, Donahue, Bolger, Serritella, Patterson, Adams, Smith. Voting Nay: None. Absent: None. Motion carried. MAYOR - STATEMENTS AND REPORTS: The Mayor introduced Richard Adamson of 1915 N. Orleans, enry, L., and recommended to the Council that he be appointed to fill the unexpired term of James A. Fouse on the Zoning Board of Appeals. Motion by Patterson, seconded by Adams, to approve the Mayor's appointment of Richard Adamson to the Zoning Board of Appeals, to fill the unexpired term of James A. Fouse to April 30, 1996. Voting Aye: Lieder, Locke, Donahue, Bolger, Serritella, Patterson, Adams, Smith. Voting Nay: None. Absent: None. Motion carried. The Mayor also announced that the Vice -Chairman of the Zoning Board, Donna Tobeck, agreed to temporarily assume the Chairmanship until a permanent Chairman can be appointed. COMMITTEE REPORTS: Alderman Bolger reported on the Public Works Come a mee ng a at 7:00 this evening to discuss an inquiry by a resident at 3420 Broad Street who requested that the City participate in financing a repair to a water service line break. Motion by Bolger, seconded by Serritella, to accept the Public Works' Committee recommendation and deny the request of the owner of 3420 Broad Street to participate in financing a repair to a water service line as repairs to service lines are the owners' responsibility and not the City's. Voting Aye: Lieder, Locke, Donahue, Bolger, Serritella, Patterson, Adams, Smith. Voting Nay: None. Absent: None. Motion carried. Alderman Lieder announced a Finance Committee Meeting for Wednesday, September 18, 1991 at 7:15 p.m. to discuss a donation by the Police Officers' Association. DEPARTMENT HEAD REPORTS: City Administrator Peterson announced a request or the High SchoolDistrict to again use the City garage from September 23 through September 27 to build their homecoming float. Alderman Bolger asked to make sure that they had adult supervision during this time. Peterson said he believed that they would have, but he would so inform the school. Peterson also reported on the ongoing status of the Municipal Center atrium floor tile stating that he believed a solution had finally been found to clean and seal the tile and grout, and hopefully maintenance would then be easier. Motion by Locke, seconded by Serritella, that no money be paid to the tile contractor until such time as the tile's appearance is in a condition that is acceptable to the Mayor and City Administrator. Director of Public Works Batt reported on the following Country Club Estates residents' survey regarding extending sewer lines there: 75 questionaires were sent out with 62 responses received as of 9-11-91. Of the 62 responses, 22 replied YES, 34 NO, 4 MAYBE and 1 NO ANSWER to the question "If all costs of installation of a sewer to service your property had to be borne by the property owner, would you be interested in discussing installation of sanitary sewers with City officials?" Batt stated that he would mail the survey results back to the property owners along with the meeting notice when the Council sets the follow-up meeting date with the residents. Serritella asked why the Knox Park Pool wasn't open through the Labor Day Weekend. Peterson responded that because the high school and college students go back to school the last week of August, they are unavailable during the day to open the pool. Serritella said that maybe a reduced time schedule for the pool could be arranged when the students are out of school for the day and certainly they would be available for the holiday weekend. Peterson said he had already spoken to Pete to see if some schedule couldn't be worked out next year to keep the pool open through Labor Day Weekend. It was the concensus of the Council to keep the pool open from Memorial Day to Labor Day. NEW BUSINESS: There was no new business to report except the Mayor stateU—MaF—apersonnel matter had come up that he wanted to report on in Executive Session. Motion by Bolger, seconded by Patterson, to go into Executive Session to discuss a personnel matter. Voting Aye: Lieder, Locke, Donahue, Bolger, Serritella, Patterson, Adams, Smith. Voting Nay: None. Absent: None. Motion carried. The Council went into Executive Session at 10:15 p.m. Motion by Bolger, seconded by Adams, to go back into Open Session at 10:25 p.m. Voting Aye: Lieder, Locke, Donahue, Bolger, Serritella, Patterson, Adams, Smith.
