WEDNESDAY, SEPTEMBER 9, 1981
The Regular Meeting of the City Council was called to order by Mayor
Stanek on Wednesday, September 9, 1981 at 8 P.M. (Labor Day was Monday, the regular
meeting date.) At roll call, the following aldermen were present: Pepping, Nolan,
Council
Datz, Wieser, Smith, Serritella, Meurer. Absent: Harker. Also in attendance Mtg. %
were: Supt. Weber, Attorney Narusis, Clerk Gilpin, Chief Pasenelli. Attend

Motion by Nolan, seconded by Datz, to accept the minutes of the August
31, 1981 regular meeting as read.
Voting Aye: Pepping, Nolan, Datz, Wieser, Smith, Serritella, Meurer.
Voting Nay: None.
Absent: Harker.

Motion by Nolan, seconded by Pepping, to accept the Zoning Board of
Ordi-
Appeals recommendation and pass an ordinance granting a Special Use Classification nance
to the Althoff Building at 804 Mill Street.

Motion carried.
Discussion was held regarding the (Eminent Domain) condemnation suit
filed by the City of McHenry to acquire the Decker property north of Bull Valley
Road adjacent to the proposed Brittany Heights Subdivision near Country Club Estates
Subdivision. The Jury Trial resulted in an award of $175,000.00 for the 30.15
acres of riverfront property which the City plans to utilize for passive park use.
Narusis reported that the City has 90 days from the date of the verdict, which
was August 28, 1981, to make payment in full of $175,000.00 plus 6% interest from
the date of the verdict to the date of the payment plus $49.00 filing costs. The
payment is to be made to the County Treasurer and at which time the interest stops.
Mayor Stanek explained there were two options for acquiring the money for land
acquisition: 1. By using the $200,000.00 grant money for development of Knox
Park which should be forthcoming early this fall; 2. By obtaining a G.O. (General
Obligation) Bond and putting it on the tax bill and borrow the money over a period
of time. Narusis explained that if the City did not purchase the property within
the 90-day time period, the property owner would probably file a law suit against
the City to recover the money he spent in defense of this law suit.

Motion by Wieser, seconded by Datz, to purchase the Decker property

Steve Larsen of Baxter & Woodman, city engineers, gave a report and
recommendation on the malfunction of the sewer lines along Boone Creek at the
Millstream Lift Station. Infiltration problems and new manhole covers were
also discussed.

Motion carried.
Discussion was held on the hiring of students through the high school
work program. Students must work a minimum of 15 hours per week and must be Employees
paid the minimum wage of $3.20 per hour. It was the concensus of opinion
that the Council should authorize the hiring of two students on this work
program for the Public Works and Park Departments.
Motion by Smith, seconded by Serritella, to authorize and approve the Authori-
zations
rental of a pocket beeper at $19.50 per month for use by the Superintendent
Public
of Public Works. Works

Motion by Pepping, seconded by Meurer, to authorize the City Clerk
Letters
to sign and record immediately a Public Notice as it relates to Falcon of credit'

Development Company for Riverside Terrace Subdivision.

Mayor Stanek read a letter from Richard Panerali, president of
the village of McHenry Shores in regard to possible annexation of that
McH. Village to the City of McHenry. A committee composed of Mayor Stanek,
Shores and Aldermen Nolan and Datz was appointed to investigate the proposal with
Annexa-
tion McHenry Shores officials and report back to the Council on their findings.
Mayor Stanek appointed Alderman Pepping to serve as the city's
McH.
County representative on the McHenry Economic Development Commission, the commission
EDC
being proposed by the McHenry Area Chamber of Commerce.
Motion by Nolan, seconded by Serritalla, to call a Special Meeting

on Tuesday, September 22, 1981 at 7:30 P.M. for the purpose of discussion,

consideration and possible action on job reorganization within city de-
partments.

Absent: Harker.

Aldermen Wieser and Smith, who were assigned to study the driveways
onto Elm Street between Park Street and Riverside Drive, reported no `driveways
should be eliminated in that area. They will check the business at the north -
Bridge west corner of Riverside and Elm, which now has two driveways because a gas
station was originally located on that property, to see if one of those
driveways could be eliminated.
Motion by Wieser, seconded by Smith, to adjourn.
