The Regular Meeting of the McHenry City Council was called to order by Mayor Busse on September 4, 1985 at 8:00 P.M. in City Hall. At roll call the following Aldermen were present: Bolger, Lieder, McClat- Council Mtgs chey, Nolan, Smith, Snell, Serritella, Teta. Absent: None. City staff Attendance in attendance were Supt. Halvensleben, Attorney Narusis, Clerk Gilpin, Park Director Merkel. Absent: Chief Joyce. Motion by Smith, seconded by Serritella, to accept the minutes of the August 21, 1985 Regular Meeting and the August 22, 1985 Committee Meeting of the Whole minutes as presented. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Discussion was held on the proposal of Residential Develop- ment Group regarding the final payment of fees assessed on Winding Creek Subdivision through an annexation agreement. Motion by Bolger, seconded by Nolan to accept the offer of Residential Development Group that instead of paying $17,708.57 as the final payment of the annexation agreement on the Backhaus Farm, Failed that they be granted per- mission to pay the principal of $12,500.06 Motions and to offer the City 15.27 acres of land in lieu of the'$5,208.57 interest due. Voting Aye: Bolger, McClatchey, Nolan. Voting Nay: Teta, Lieder, Smith, Snell, Serritella. Absent: None. Motion did not pass. Motion by McClatchey, seconded by Nolan to pass an ordinance amending the City's Flood Control Ordinance as presented. Ordinances Voting Aye: Bolger, Lieder, McClatchey, Nolan, Flood Plain Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by Lieder, seconded by Teta to pass a Resolution Resolution authorizing and providing for the issuance by the City of McHenry of its $500,000 Industrial Project Revenue Bond for Cunat Bros. project, Industrial approving the sale of the bond, the bond purchase agreement, the loan Revenue Bond! agreement, and -the assignment and agreement. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by McClatchey, seconded by Teta, to pass an Ordinance Ordinances amending the Retained Personnel Ordinance for annexation fees as pre- Annexations sented. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Alderman Nolan requested that the Park Committee study the Committees possibility of requiring persons seeking picnic beer permits to sub- mit their request for approval at least two weeks before the actual Parks -Beer date of the event. The Mayor referred the matter to the Park Com- mittee.. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by Smith, seconded by Serritella, to authorize and Water approve the payment of $10,366.20 to Henry Boysen Co. for partial Dept.- payment request No. 1 for the Water Supply Well No. 8 project as Improve. recommended by Baxter and Woodman. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Employees Mayor Busse announced the appointment of Kathleen M. Swindle of McHenry to fill the position of Dispatcher in the Police Dept., which was created through the resignation of Richard Davis. Motion by Nolan, seconded by Teta, to approve the Mayor's appointment of Kathleen Swindle as Police Dispatcher. Voting Aye: Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: Bolger. Absent: None. Motion carried. Proclamations Mayor Busse read) a Proclamation declaring that the period of September 22 - 28 be proclaimed as."Kinship Week" in the City of McHenry. He urged all citizens of McHenry to acquaint themselves with the principles and objectives of the Kinship Program and he com- mended the volunteers who share their time weekly working with youths who have a tremendous need for wide varieties of help, and who are lost each year to loneliness, drugs, juvenile institutions, frustrations, unhealthy lifestyles, and de -humanized values. Mayor Busse announced that off-street parking violation no- tices had been sent to a number of violators. The matter will be acted upon at the September 11, 1985 Regular Council Meeting. Bid Auth. Motion by Lieder, seconded by Snell to accept the re- commendation of the Finance Committee and advertise for bids for a Pub. Works new dump truck for the Public Works Dept. according to specifications Purchases prepared by the-Supt. of Public Works and the Mayor. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: Norte. Absent: None. Motion carried. Alderman Lieder, Chairman of the Finance Committee announced that a price structure proposal for scavenger fees as requested by McHenry Woodstock Disposal Co. will be presented at the next Council Meeting. Sewer Motion by Bolger, seconded by Smith, to accept the re- Misc. commendation of Baxter and Woodman and allow Brake Parts to dispense a minute quantity of chromium into the sanitary sewer system as well as a monitoring device on the sewer lines. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella. Voting Nay: Teta. Absent: None. Motion carried. Wednesday, September 4, 1985 Page 3 Motion by Smith, seconded by Nolan, to grant permission to Requests, Misc. Whale's Tail Restaurant to place two potted trees on the sidewalk in front of their establishment. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Mayor Busse announced that a meeting would be held at City Hall on Sunday, September 8, 1985 with the residents of Whispering Cablevision Oaks Subdivision to clarify the franchise agreement with Lakes Cablevision and to address concerns of the Whispering Oaks Residents regarding installation of cablevision in that subdivision. Mayor Busse called for a recess at 9:15 P.M. The meeting reconvened at 9:30 P.M. with everyone still in attendance. Mayor Busse announced that the liquor license for Phylly's Liquor Control Inn at 3914 Main Street had been transferred to Phyllis Garippo, wife & Licenses of the former owner, who had been killed in a car accident last week. Building Inspector Rosing was asked to check a violation at Building & the Jepsen Tire building on the corner of Park and Elm, and to also Zoning-Misc. check on a residential occupancy violation at Washington and First Violations Avenue. Motion by Teta, seconded by Snell, to go into Executive Ses- sion at 10:11 P.M. to discuss Personnel and Property Acquisition. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Tetra. Voting Nay: None. Absent: None. Motion carried.
