The Regular Meeting of the City Council was called to order by Mayor Stanek on Monday, August 31, 1981 at 8 P.M. At roll call the following aldermen council Mtg. were present: Pepping, Nolan, Datz, Wieser, Smith, Serritella, Meurer. Absent: Harker. Also in attendance were Supt. Weber, Attorney Narusis, Clerk Gilpin, Attend- ance Chief Pasenelli, Park Director Merkel. Motion by Serritella, seconded by Nolan, to accept the minutes of the August 17, 1981 regular meeting as read. Voting Aye: Pepping, Nolan, Datz, Wieser, Smith, Serritella, Meurer. Voting Nay: None. Absent: Harker. Motion carried. Richard Sherman of the auditing firm of Lester Witte & Company, Audit reviewed the 1980-81 fiscal year city audit and answered questions of aldermen regarding the audit. Motion by Pepping, seconded by Serritella, to accept the audit as prepared by Lester Witte & Company for the 1980-81 fiscal year. Voting Aye: Pepping, Nolan, Datz, Wieser, Smith, Serritella, Meurer. Voting Nay: None. Absent: Harker. Motion carried. Roger Muterspaugh and James Berg of Residential Development Group addressed the Council seeking preliminary approval of Winding Creek Unit 3. pp la In reviewing the plat, it was noted that the city would like some sort of access Approv7 al to the open space area west of Unit 3. Retention ponds were also discussed. Motion by Datz, seconded by Nolan, to approve the Preliminary Plat of Unit 3 with the stipulation that access be provided the city such as the 50 foot gas line easement shown on the plat. Voting Aye: Pepping, Nolan, Datz, Wieser, Smith, Serritella, Meurer. Voting Nay: None. Absent: Harker. Motion carried. A Public Hearing on the 1981-82 Tax Levy Ordinance was held with the following persons in the audience: Frances Olsen, Ernest Schooley, Shawn Mondel, Dan Lorek, Ricki Hoffman, Tony Oliver, Lynne Donarski, Carol Sek. Monday, August 31, 1981 Page 2 Chairman Pepping of the Finance Committee submitted a proposal for the 1981-82 Tax Levy Ordinance and explained the reasoning behind it. Motion by Pepping, seconded by Wieser, to pass the 1981-82 Tax Levy Ordinance in the amount of $984,300.00 with an estimated tax extension rate of .962 to cover the entire amount of $86,000.00 requested by the Police Pension Board. Voting Aye: Pepping, Nolan, Wieser. Voting Nay: Datz, Smith, Serritella, Meurer. Absent: Harker. Motion did not pass. Motion by Smith, seconded by Serritella, to pass the 1981-32 Tax Levy Ordinance in the amount of $984,300.00 with an estimated tax extension rate Tax Levy of .942 which allows $70,000.00 for the Police Pension Fund. Ordinance Voting Aye: Pepping, Nolan, Wieser, Datz, Smith, Serritella, Meurer. Voting Nay: None. Absent: Harker. Motion carried. Mayor Stanek nominated James Blum of 4618 W. Shore Drive and Alder McH. man Michael Wieser of the Utilities committee to serve as City of McHenry repre- Shores FPA sentatives on the McHenry Shores Sewage Treatment Facilities Planning Federal Grant Project No. C172048 Committee. Motion by Meurer, seconded by Serritella, to accept the appointments of Blum and Wieser, to the Planning Committee. Voting Aye: Pepping, Nolan, Datz, Smith, Serritella, Meurer. Voting Nay: None. Absent: Harker. Pass: Wieser. Motion carried. Motion by Serritella, seconded by Meurer, to authorize a salary in - Wages crease for Matt Rogers of the Public Works Department from $4.00 to $5.00 per hour for a 30 to 40 hour week as a mechanic. Voting Aye: Pepping, Nolan, Datz, Wieser, Smith, Serritella, Meurer. Voting Nay: None. Absent: Harker.. Motion carried. Monday, August 31, 1981 Page 3 Mayor Stanek instructed the Finance Committee to study a wage increase for Vernon Rouley of the Public Works Department and come back with a recommen- Commit- tee dation. Motion by Wieser, seconded by Nolan, to pass an ordinance amending the hours permitted for solicitation to read from 10 A.M. to 7 P.M. and to publish ordi- nance to ordinance in pamphlet form. solici- tation Voting Aye: Pepping, Nolan, Datz, Wieser, Smith, Serritella, Meurer. Voting Nay: None. Absent: Harker. Motion carried. Motion by Smith, seconded by Serritella, to pass an ordinance prohibit- Ordi- nance ing fishing and the launching of boats from city property at the Petersen Park parks Beach on McCullom Lake. Voting Aye: Pepping, Nolan, Datz, Wieser, Smith, Serritella, Meurer. Voting Nay: None. Absent: Harker. Motion carried. Motion by Smith, seconded by Serritella, to pass a Resolution authorizing Reso- participation of City Clerks in the Illinois Municipal Retirement Fund and lution setting the beginning date at May 1, 1937. Voting Aye: Pepping, Nolan, Datz, Wieser, Smith, Serritella, Meurer. Voting Nay: None. Absent: Harker. Motion carried. Motion by Meurer, seconded by Nolan, to authorize and approve payment in the amount of $5,971.46 to Hampton, Lenzini and Renwick, Inc. as partial pay- MFT ment for preliminary engineering services in connection with the Meadow Lane FAU project. Voting Aye: Pepping, Nolan, Datz, Wieser, Smith, Serritella, Meurer. Voting Nay: None. Absent: Harker. Motion carried. Mayor Stanek reported bid letting for the Meadow Lane project would be December 11, 1981 with probably awarding of bids the first part of January 1982. Mead- ow Lane Monday, August 31, 1981 Page 4 Motion by Smith, seconded by Datz, to authorize and approve payment to Free Flo Inc. in the amount of $2,750.00 for materials and labor in connection Authori- zation with a water line break at the northeast corner of the Green Street Bridge. Voting Aye: Pepping, Nolan, Datz, Wieser, Smith, Serritella, Meurer. Voting Nay: None. Absent: Harker. Motion carried. Authori- Motion by Nolan, seconded by Pepping, to authorize and approve the zation City Clerk's attendance at a Municipal Clerk's Institute at the University of Census Illinois Oct. 26 thru 30. Voting Aye: Pepping, Nolan, Datz, Wieser, Smith, Serritella, Meurer. Voting Nay: None. Absent: Harker. Motion carried. Mayor Stanek announced that the final Official 1980 Census for the City of McHenry was 10,908. Aldermen Smith and Wieser was asked to check driveways on Elm Street Rt. 120 from Park Street to Riverside Drive in connection with the Route 120 Bridge Bridge replacement project as to possible driveway revisions. Attorney Narusis was instructed to correspond with Attorney Militello regarding zoning questions in connection with possible construction of buildings Zoning for the developmentally disabled by the McHenry County Association for the Retarded. The Street and Sidewalk Committee was asked to study traffic conditions Commit- tees at the corner of Elm and Green Streets and come back with suggestions for improv- ing traffic flow. The Building and Zoning Committee was authorized to study the matter of setting fees for reissuance of building permits which have expired one year after the original date of issuance and report back with a recommendation, preferably before October lst. Motion by Wieser, seconded by Nolan, to go into Executive Session Executive Session at 11:17 P.M. for the purpose of discussing pending litigation. Motion by Wieser, seconded by Pepping, to direct Baxter & Woodman to investigate the cause of the sewer collection system malfunction in the vacinity Autho- rization of the Millstream force main lift station and report back to the Council with recommendations for its repair.
