HomeMy WebLinkAboutMinutes - 08/21/1991 - City CouncilREGULAR MEETING AUGUST 21, 1991 The Regular Meeting of the McHenry City Council was called to order by Mayor Busse on Wednesday, August 21, 1991 at 8:00 P.M. in City Hall. At roll call the following Aldermen were present: Bolger, Donahue, Locke, Smith, Adams, Patterson, Serritella. Lieder arrived at 8:12 P.M. Absent: None. City Staff in attendance were: City Clerk Gilpin, City Attorney Narusis, City Administrator Peterson, Chief Joyce, Director of Public Works Batt, Director of Building and Zoning Halik. Absent: Director of Parks and Recreation Merkel. During the Ten Minute Public Input Session, Dr. Robert Cassidy, Superintendant of Elementary School District 15 addressed the Council concerning the petition before the McHenry County Regional Superintendent of Schools for deannexation of 920 acres from the Crystal Lake Elementary School District 47 to the McHenry Elementary School District 15. He asked that the Board give serious consideration before voting on a Resolution to support the deannexation. Mayor Busse welcomed Boy Scout Troop #131 and their leader, Mrs. Mary Haines, who were attending the City Council Meeting in order to earn merit badges. Voting Nay: None. Absent: Lieder. Motion carried. Alderman Lieder arrived at 8:12 P.M. Discussion was held on passage of a Resolution to support deannexation of property from Crystal Lake School District #47 to McHenry Elementary School District #15. At the May 29, 1991 Council Meeting, James Bakk and John Cottingham appeared on behalf of the Fritsch Farm property to report on the status of the deannexation petition filed with the McHenry County Regional Superintendant of Schools. This petition, if approved, would deannex 920 acres from School District #47 to School District #15. The Resolution, as presented, was drafted by James Bakk, Attorney for the petitioner. He requested that the Council pass this Resolution in support of the deannexation petition. This issue will be before the Regional School Board on Monday, September 9. August 21, 1991 Page 5 The purpose of the deannexation petition filed by Mr. 8 Mrs. James Finch and eight other registered voters in the area was to promote the "whole student concept" to make it possible for children to attend high school and grade school with their peers in one City, rather than having them attend grade school at Crystal Lake and high school at McHenry. The intention was to make the high school and grade school district boundaries coterminous. Officials from School District #15 expressed concerns over their ability to fund additional facilities to serve the children that might be generated by this property. They did not feel existing developer donation fees were adequate to pay for a new school facility but did conclude that revenues from the proposed property would be adequate to fund the ongoing maintenance and salary expenses of the school districts. Present in the audience for this discussion were Petitioner Janes Finch; Dostrict 15 School Board officials --Superintendent Dr. Robert Cassidy, President Lucy Fick, Board member Paula Eckstrom. Mr. Finch explained that he had lived on Crystal Lake Road for 12 years. Three years ago the School Board informed him that he was in Crystal Lake School District #47, and not McHenry School District #15. He has had to pay $2400 - $2600 tuition for the last three years to keep his son in McHenry elementary schools instead of sending him five miles on a bus to Crystal Lake. The petition evolved after Finch talked to other residents in the area about this situation. Ten registered voters then petitioned the County Regional Board to change the boundaries and make School District #156 boundries coterminous with School District #15. President Lucy Fick said that according to enrollment figures from Winding Creek subdivision, there are .72 children per house. If 800 homes were built, about 600 children would be generated and the school district would only receive $1,400,000 in developer donation fees from the City. That is only 24% of what a new school would cost. She said that the School Board supports the "whole student concept" but felt that Crystal Lake could do it and it wouldn't have to be McHenry. She asked that McHenry would like to do it but the City should somehow provide financial help to pay for construction of a new school if it supported this Resolution. Alderman Lieder felt it made sense educationally to have a child attend schools in their city but he said the City should not get involved in an education problem that the School District should handle. He didn't feel it was the City's responsibility to intervene in school issues such as this and no action should be taken by the Council. He felt the City would be overstepping its bounds in supporting such a Resolution. Alderman Smith disagreed with Alderman Lieder and felt the City should be involved. It was his opinion that children should be allowed to attend schools in the same city and it should be in McHenry schools, rather than Crystal Lake Schools. Alderman Adams noted that the Council would just be making a recommendation by approving the Resolution but the final decision would be made by the McHenry County Regional School Board. Mayor Busse pointed out that the Resolution only supports the deannexation and the Council is not trying to solve the actual impacts on the school districts. He felt this matter needed to be taken up with potential developers. The "whole student concept" is what makes sense in supporting this Resolution, he said. He also pointed out that the 920 acres would not all be developed as residential because much of the area is already zoned as a Business Park. According to the McHenry Comprehensive Plan, the areas along Route 31 are planned as Commercial or Industrial. Alderman Serritella felt it was logical to make the school district boundaries for #15 and #156 identical, becaiuse children should not have to ride a bus five miles twice a day to attend schools outside their city. August 21, 1991 Page 6 Alderman Bolger felt that if a Unit School District was possible, these boundry lines would be identical. Personally, he would be in favor of deannexing from District 47 to 15. But at the present time, he felt it was not in the City's juridiction to vote on this matter, and felt that the Council should take no action on the Resolution. Alderman Patterson felt that it was a school issue and not one for the City Council to take action on. Patterson asked why this Resolution was put on the agenda. Alderman Donahue said it was her understanding that the School Board had asked for the City's input. School Board President Fick said that was correct. City Administrator Peterson explained that when Bakk and Cottingham appeared before the Council on May 29 to give a report on the deannexation proposal, they were told that when it came time to bring this matter before the Regional Board, a Resolution should be brought to the Council for consideration. Motion by Patterson, seconded by Serritella, to table the Resolution. Voting Aye: Bolger, Donahue, Lieder, Locke, Adams, Patterson, Serritella. Voting Nay: Smith. Absent: None. Motion carried. Motion by Patterson, seconded by Locke, to approve the purchase of various pieces of safety equipment for performing proper confined space entry procedures for the Public Works Department in the amount of $7,326.77. Voting Aye: Voting Nay: Absent: Abstaining: Motion carried. Bolger, Donahue, Smith, Patterson, None. None. Adams. Lieder, Locke, Serritella. Motion by Lieder, seconded by Serritella, to enter into a 36-month lease for the purchase of a Canon NP8530 Copier, as presented. Following discussion, the Aldermen felt more information was needed and it could be presented at the August 22 Special Meeting. Therefore, Serritella withdrew her second and Lieder withdrew the motion. Alderman Smith reported that the Building, Zoning, Planning, and Development Committee met on August 19, 1991 to discuss 20 items. The meeting was informative rather than decision making and a copy of those minutes will be distributed to Aldermen at the next Regular Meeting. Works Batt reported that he had contacted the Transportation concerning the bumps on Elm Street Riverside Drive intersections. IDOT informed him the problem, but there was no money in the budget They will again put money into the budget next e intersections. The City did make minor repairs •eet at the Court Street intersection to improve It was announced that the Crystal Lake traffic study from Smith Engineering would be discussed at a staff meeting on Tuesday, September 3, 1991 at 10:00 A.M. in Director of Public Works Batt's office. Anyone interested was invited to attend that meeting. Batt reported on a problem on Hampton Court, which was discovered while they were making repairs to that roadway. There is a 300 foot section of road which needed to be excavated and restored because a running spring was found in the middle of that roadway. An additional cost of approximately $30,000 would be required to make necessary repairs because the street is now open and practically impassable. August 21, 1991 Page 7 Fegers Subdivision and Country Club Subdivision again asked that the City consider providing those subdivisions with snowplowing services for the 1991-92 winter season. At the City Council meeting on September 19, 1990, the Council voted to raise the fees for providing this service from $560.00 to $700.00 for Fegers Subdivision, and from $350.00 to $600.00 for the Country Club Subdivision. Motion by Smith, seconded by Serritella, to send a letter of agreement to Country Club and Fegers Subdivisions for snowplowing fees for the 1991-92 winter season, with the fees to remain the same as last year ($700.00 Fegers, $600.00 Country Club)• Voting Aye: Bolger, Donahue, Lieder, Locke, Smith, Adams, Patterson, Serritella. Voting May: None. Absent: None. Motion carried. Alderman Locke requested that the Public Works Department install directional signs to the Library at Crystal Lake Road.
