The Regular Meeting of the McHenry City Council was called to order by Mayor Busse on Wednesday, August 21, 1985 at 8 P.M. in city hall. At roll call the following Aldermen were present: Bolger, Lieder, McClatchey, Smith, Snell, Serritella, Teta. Absent: Nolan. City staff in attendance were Supt. Halvensleben, Attorney Narusis, Clerk Gilpin, Park Director Merkel, Chief Joyce. Mayor Busse called to order a Public Hearing of the McHenry City Council concerning the proposed Tax Levy Ordinance and proposed Levy increase for the 1985-86 tax year as required by State Statutes. Notice of this hearing was published in the McHenry Plaindealer on August 14, 1985. The amount of the property taxes extended on behalf of the City of McHenry for the preceding fiscal year 1984-85 was $854,463. The amount of the proposed levy for the current fiscal year of 1985-86 is $987,500. The percentage of increase of the current year proposed levy over the amount extended for the preceding year is 15.6 percent. Mayor Busse asked if any written comments had been presented to the City Clerk's office concerning the Tax Levy Ordinance. She replied that no written comments had been received in her office. Mayor Busse asked if anyone in the audience wished to make any comments on the proposed ordinance. Lon Smith of 1614 N. Riverside Drive questioned the percentage raise for the next fiscal year. Mayor Busse explained that the amount levied is always higher than the amount extended. The Council does have the opportunity to abate because the proposed tax levy is based on assessed evaluation and assessed evaluation is not known until the beginning of 1986. If the assessed evaluation comes in higher, the extended tax rates are lower. Last year the City levied for $919,000 and the final extension on the taxes was $854,000. He explained that of the total tax bill paid by the residents only 12 112 percent goes for City operations. Aldermen Bolger, McClatchey, and Smith felt that the Tax Levy Ordinance could be reduced. Alderman Bolger felt that the audit, insur- ance, retirement, police pension, and library funds could be reduced. Following lengthy discussion among the Aldermen, the Public Hearing was concluded at 8:28 P.M. Motion by Lieder, seconded by Serritella, to accept the minutes of the August 7, 1985 Regular Meeting as presented. Voting Aye: Bolger, Lieder, McClatchey, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: Nolan. Motion carried. Motion by McClatchey, seconded by Snell, to accept the minutes of the August 14, 1985 Regular Meeting as presented with one correction. Voting Aye: Bolger, Lieder, McClatchey, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: Nolan. Motion carried. Council Mtgs Attendance Council Mtgs Spec. Mtgs, Pub. Hrgs Approp. & Levy Motion by Lieder, seconded by Serritella, to pass the annual Tax Levy Ordinance of the City of McHenry for the fiscal year begin- ning May 1, 1985 and ending April 30, 1986 as presented in the amount Ordinances of $987,500. Voting Aye: Lieder, Smith, Snell, Serritella, Teta. Voting Nay: McClatchey, Bolger. Absent: Nolan. Motion carried. Motion by Bolger, seconded by Teta, to pass an ordinance for Approp. & Levy the levy and assessment of taxes for fiscal year beginning May 1, Ordinances 1985 and ending April 30, 1986 in and for the City of McHenry Special Service Area No. 1 in the amount of $108,840. Wednesday, August 21, 1985 page 2 Tom Harding, developer of Martin Woods, appeared before the Council to request and extension of time for widening and overlaying of Martin Road from Route 120 to Ringwood Road until June of 1986. The annexation agreement required that Martin Road be widened and overlayed by August of 1985. Street Motion by Lieder, seconded by Serritella, to grant the re- Maint & quest of Tom Harding and approve the extension for widening and over - Repair laying of Martin Road to June of 1986 and require that any maintenance on Martin Road be paid for by Harding up to $2,500 and that specifications for the widening of Martin Road be submitted to the City by March 1, 1986. Voting Aye: McClatchey, Smith, Snell, Serritella, Lieder. Voting Nay: Bolger, Teta. Absent: Nolan. Motion carried. Mayor Busse announced the reappointment of Bill Wilson and Don Wedekind to the Plan Commission with their terms to expire April 30, 1990, and the appointment of George Spyrnal to the Plan Commission to fill the unexpired term of Robert Mortell to April 30, 1988. Appt.- Motion by Teta, seconded by Lieder, to approve the Mayor's Officials appointments to the Plan Commission as presented. Voting Aye: Bolger, Lieder, McClatchey, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: Nolan. Motion carried. Mayor Busse announced the appointment of David Gelwicks to replace Michael Wieser on the Landmark Commission with his term to expire April 30, 1986. Appts.- Motion by Snell, seconded by McClatchey, to approve the Officials Mayor's appointment of David Gelwicks to the Landmark Commission as Landmark presented. Commission Voting Aye: Bolger, Lieder, McClatchey, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: Nolan. Motion carried. Frank Mazurek, of the McHenry Baseball Youth League, ad- dressed the Council concerning assistance in breaking up concrete dugouts at the V.F.W. field so that they can remodel the ball diamonds. Public Motion by Snell, seconded by Smith, to authorize and approve Works-Misc. the use of City manpower and machinery to assist the youth league in breaking up the cement dugouts. Voting Aye: Bolger, Lieder, McClatchey, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: Nolan. Motion carried. Mayor Busse announed that the McHenry Township Road Commis- sioner had requested City participation in a resurfacing project on Mc Cullom Lake Road from Route 31 to the railroad tracks as part of the Township summer road program. The cost to the City to pay for that portion of Mc Cullom Lake Road within city limits would be $23,781.20. Mayor Busse announced that this expense was not included in the budget or considered in the summer road program. Street Motion by Snell, seconded by Teta, to inform the McHenry Maint & Township Road Commissioner that the City of McHenry would not parti- Repair cipate in this road program this year (1985). Voting Aye: Bolger, Lieder, McClatchey, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: Nolan. Motion carried. Landmark Comm. Revenue Sharing Motion by Snell, seconded by McClatchey, to reinstate Patricia Lunkenheimer as a full time employee in the Park Department Employees effective September 1, 1985. Voting Aye: Bolger, Lieder, McClatchey, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: Nolan. Motion carried. Motion by Smith, seconded by Snell, to approve the appoint- ment of Clarence Hathorn as a crossing guard employee for the Police Employees Department. Voting Nay: None. Absent: Nolan. Motion carried. Mayor Busse called for a recess at 9:14 P.M. The meeting reconvened at 9:28 P.M. with everyone still in attendance. Under Mayor's statements and reports, Mayor Busse announced Insurance that the City's insurance coverage with Hartford had been extended for 60 days until November 7, 1985. Prior to that time, renewal proposals will be presented. He also reported that there would be a meeting Tuesday, August 27, 1985 at the McHenry County Highway Department for discussion of the proposed Bull Valley Road south by- pass to Chapel Hill Road. Resignations A letter of resignation was submitted by Richard C. Davis a dispatcher in the McHenry Police Department. The resignation was Employees accepted with regret. Alderman Teta, Chairman of the Building and Zoning Com- mittee, presented a report on a meeting held August 19, 1985 at city hall. Ordinances Motion by Teta, seconded by Snell, to authorize the City Attorney to draft an ordinance establishing retained personnel costs Annexations of $200 for single lot annexations where the owner has title and $400 where the property is in trust and to amend the retained personnel ordinance to delete the return of interest to the developer upon com- pletion of the project. Voting Aye: Bolger, Lieder, McClatchey, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: Nolan. Motion carried. Motion by Teta, seconded by Serritella, to accept the recom- Contracts mendation of the Building & Zoning Committee and authorize the Mayor Zoning Mattersand Clerk to sign a contract with Gann & Assoc. of Roselle, Illinois retaining that organization to review and assess the City of McHenry Zoning Ordinance. Voting Aye: Lieder, McClatchey, Smith, Snell Serritella, Teta. Voting Nay: Bolger. Absent: Nolan. Motion carried. Alderman Lieder, Chairman of the Finance Committee, announced that there would be a Finance Committee Meeting on Wednesday, September 4, 1985 at 7 P.M. to discuss the request of McHenry Woodstock Disposal for rate increases and to discuss the pur- chase of a new truck for the Public Works Department. Committees Alderman Bolger, Chairman of the Utilities Committee, requested that the Aldermen submit to the Supt. of Public Works the location of troublesome drainage problems in their areas so that an inventory can be made and corrections begun. The Superintendent of Public Works reported that two price proposals had been received for replacement of an air conditioner in the sewer treatment plant as follows: Althoff Industries - $885, C & C Heating & Air Conditioning - $758. Sewer Dept. Motion by Snell, seconded by Lieder, to accept the low price Repairs, etc. proposal of C & C Heating & Air Conditioning for purchase of a Rheem Air Conditioner at a cost of $758 contingent upon the assumption that it is the complete installation price including electrical work. Moton by McClatchey, seconded by Serritella, to call a Council Mtgs- Special Meeting on Monday, September 9, 1985 at 7:30 P.M. for discus- Special, Pub sion of a proposed annexation agreement of J.B. & Clara Subdivision p Hrg. on Route 31 south of the McHenry Hospital property. Voting Aye: Bolger, Lieder, McClatchey, Smith, Snell, Annexations Serritella, Teta. Voting Nay: None. Absent: Nolan. Motion carried. Motion by Smith, seconded by Snell, to approve the request Block Parties of Donn DeMarzio of 211 Huntington Drive for a block party on August 24, 1985 and the request of Orville Freund for a block party on Callista Street in Cooney Heights on September 1, 1985. Voting Aye: Bolger, Lieder, McClatchey, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: Nolan. Motion carried. Motion by Bolger, seconded by Teta, to authorize and approve Sewer Dept. - the payment of $458 to Foundation Engineering, Inc. for soil Repairs investigation work at the sewer treatment plant. Voting Aye: Bolger, Lieder, McClatchey, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: Nolan. Motion carried. Motion by Lieder, seconded by Bolger, to authorize the City Grants Clerk to advertise for bids on the commuter parking lot project as C & NW RR recommended by Baxter & Woodman. Voting Aye: Bolger, Lieder, McClatchey, Smith, Snell, Bid Auth. Serritella, Teta. Voting Nay: None. Absent: Nolan. Motion carried. Motion by Smith, seconded by Serritella, to authorize Sewer Sale of City Chief Gene Hester to dispose of the old sludge conveyor in the sewer Property plant and get the best offer he could for it. Voting Aye: Bolger, Lieder, McClatchey, Smith, Snell, Sewer Dept.- Serritella, Teta. Repairs Voting Nay: None. Absent: Nolan. Motion carried. Alderman Smith, Chairman of the Street & Sidewalk Committee, reported that Police had made a survey of cars parked around Pearl Street Park and an investigation revealed that 80 percent of the cars parked in that area were registered to out of town owners. Motion by Lieder, seconded by McClatchey, to go into Council Mtgs- executive session at 10:50 P.M. Exec. Session Voting Aye: Bolger, Lieder, McClatchey, Smith, Snell, Serritella, Teta.
