The Regular Meeting of the McHenry City Council was called to order by Mayor Busse on Wednesday, August 20, 1986 at 8 P.M. at City Hall. At roll call the following Aldermen were present: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Absent: None. City staff in attendance were Chief Joyce, Attorney Narusis, Clerk's Assistant Marth, Supt. Batt arrived at 9:20 P.M. Absent: Park Director Merkel, Clerk Gilpin. Mayor Busse called to order a Public Hearing of the McHenry City Council concerning the proposed Tax Levy Ordinance and proposed levy increase for the 1986-87 tax year as required by the State Statutes. Notice of the hearing was published in the August 12, 1986 edition of the Northwest Herald. The amount of the property taxes extended on behalf of the City of McHenry for the preceding fiscal year 1985-86 was $946,970.00. The amount of the proposed levy for the current fiscal year of 1986-87 (exclusive of Special Service Area No. 1 Bond) as published was $1,043,400. The percentage increase of the proposed current year over the amount extended for the preceding year is 10.2 percent. Mayor Busse announced that the Finance Committee met prior to the Council Meet- ing to review the tax levy and made a change in the amount under the Police Department levy for Officer's salaries. The amount was reduced from $280,000 to $275,000. So the actual amount of the 1986-87 Tax Levy will be $1,146,400 (including Special Service Area No. 1 Bond). Mayor Busse asked if any written comments had been received by the City Clerk's Office concerning the Tax Levy Ordinance. Clerk's Assistant Marth replied that none had been received. Mayor Busse then asked if anyone in the audience wished to make any comments on the proposed Ordinance. There being none the Mayor concluded the Public Hearing at 8:17 P.M. Motion by Nolan, seconded by Lieder, to pass the Annual Tax Levy Ordinance of the City of McHenry for the fiscal year beginning May 1, 1986 and ending April 30, 1987 as presented with the one amendment of reducing the levy of Police Officer's salaries from $280,000 to $275,000, for a total tax levy amount of $1,146,400. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by McClatchey, seconded by Snell, to bring back the tabled Janko zoning matter which was tabled at the previous meeting of August 13, 1986. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. City Engineer Hal Sundin of Baxter & Woodman was present and stated, as written in his letter to the Council on August 18, 1986, that based on the design calculations he received and reviewed, the detention basin proposed for the Janko property would provide sufficient detention capacity for all of the multi -family development south of Mc Cullom Lake Road, including the runoff from the Hillcrest Apartments. Discussion and questioning took place on some of the major concerns expressed by the Aldermen, based upon objections by surrounding property owners. Dr. Sundin along with Attorney Curran and Michael Janko answered the questions and concerns of the Council. Motion by Bolger, seconded by Lieder, recommendation and pass the zoning variation redrafted to include: 1) that no parking area basin; and 2) that the detention basin be built struction of the first building. Appropriat. & Tax Levy Ordinance & Hearing Ordinances Ordinances Zoning Ordinance Wednesday, August 20, 1986 page 2 Attorney James Hecht and William L. Bolton appeared before the Council on a zoning variation request that was before the Zoning Board of Appeals on January 9, 1986. There was no affirmative recommendation made by the Zoning Board on this variation request which was to permit the maintenance at all time of a total number of dwelling units as are cur- rently in place, to wit, two buildings with 40 units each known as the "Garden Quarter Apartments", in the event of either or both of the exist- ing buildings suffer damage or destruction by fire of 50 percent or more of its full assessed value. The majority of the Councilmen felt that this problem was being addressed in the new proposed zoning ordinance and would be taken care of as far as rebuilding current non -conforming buildings. They felt that a zoning variation ordinance for this property was not needed especially since a loss had not occurred and may never occur. Attorney Hecht felt that the new proposed Zoning Ordinance was not really clear on this sub- ject in that the Council could approve or deny the request to rebuild and the Garden Quarter Apartments would still be classified as non -conforming which is making their insurance premiums substantially higher. Mayor Busse stated that it was the intent of the Council to correct the current non -conforming use status so that it would not penalize anyone or be a hardship on anyone should a catastrophic loss occur and he thought they had accomplished this with the new Zoning Ordinance. Mayor Busse also stated that he would contact John Gann to see if the wording should be changed to clarify the Council's intent. Failed Motion by Bolger to grant the variation request and pass an Motion Ordinance on the Garden Quarter property. Motion failed for lack of a second. Zoning Motion by Lieder, seconded by McClatchey, to defer action on the Matters Garden Quarter Variation Ordinance until such time as the Mayor contacts John Gann and determines if the wording on the new proposed Zoning Ordi- nance needs clarification regarding the section on non -conforming uses. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Serritella, Teta. Voting Nay: Smith, Snell. Absent: None. Motion carried. Barbara Lumber of Protection Unlimited presented the mosquito Mosquito abatement report for June and July, a copy of which is on file in the Abatement City Clerk's Office. She commented that above normal rainfall early in the season led to an over abundance of mosquitoes and since the City is the only municipality in the area treating the larval breeding sites, the neighboring mosquitoes are invading the City as well. She believed the August report would be somewhat better since we are below normal in rainfall for August. The only adulticides and barrier sprays that took place were for some of the functions in connection with Fiesta Days and Sesquicentennial festivities in the parks during July. Harold Warren of Warren Associates addressed the Council to update the Aldermen on the issuance of revenue bonds to finance a new sewer treatment plant. Mayor Busse called for a recess at 9:35 P.M. The meeting reconvened at 9:48 P.M. with everyone still in attendance. Mayor Busse announced that the Building and Zoning Officer, in reviewing plans for commercial and industrial buildings, noticed that sections which contained a building height table in the BOCA Building Code had inadvertently been deleted from the City's Building Code. He presented an ordinance reinstating these sections. Ordinances Motion by Teta, seconded by McClatchey, to pass the ordinance Bldg. & presented reinstating Sections 500 through 508 of the BOCA Basic Building Misc. Zng. Code in the City's Building Code. Voting Aye: Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: Bolger. Absent: None. Motion carried. Discussion took place on whether the City should require an Bldg. & Zng. architect's seal of approval on all single family residence plans. The Misc. matter was referred to the Building and Zoning Committee. Wednesday, August 20, 1986 page 3 Motion by Smith, seconded by Serritella, that until a decision Bldg. & Zng. is made by the Council, the Building and Zoning Officer shall not enforce M1sc. that part of the BOCA Code which requires an architect's seal of approval on single family residence plans. Motion by Nolan, seconded by Bolger, to: 1) annex an "island of Ord. land" containing parcels on both sides of Route 31 which is directly Annexations involved in the Route 31 State improvement from Pearl Street to just north on McCullom Lake Road and which will require the expenditures of Agreements City MFT and FAU funds for sidewalks through this area; 2) enter into an IDOT Street agreement with Illinois Department of Transportation for the Route 31 Maintenance improvement; and 3) pass the necessary MFT Resolution (in the amount of 32,409) and ordinances regarding encroachments, parking, and prohibiting MFT the discharge of sanitary and industrial wastewater into storm sewers. Resolutions Alderman Smith moved to amend the motion to exclude the cemetery land in the "island of land" annexation. Motion failed for lack of a Failed second. Co. the final payment of 342,604.96 to Zimmerman Construction Co. on the Commuter Parking Lot subject to the contractor supplying the requisite final waivers and completion of some minor items to the satisfaction of the Superintendent of Public Works. Resolutions Motion by Snell, seconded by Lieder, to pass a Resolution MFT authorizing and approving the expenditure of MFT funds in the amount of Street $25,016.55 which is an increase of $4,023.15 over the $20,993.40 which Maint. had been previously approved at the meeting of July 2, 1986 due to a wider extension of resurfacing of the City's portion of Mc Cullom Lake Road in participation with McHenry Township Road District. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Wednesday, August 20, 1986 page 7 Motion by Lieder, seconded by Snell, to: 1) enter into a con- tract with the low bidder, A.C. Pavement Striping, in participation with the Northwest Municipal Conference program for road crack sealing and 2) pass a Resolution authorizing and approving the expenditure of MFT funds in the amount of 325,000 for said project. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Superintendent Batt presented a proposal by a consultant on securing and testing farm land in the immediate vicinity for the City's use in sludge application since the City was at a critical stage not being able to secure land for this purpose. He said the City would soon have to haul the sludge to landfills in either Elgin or Lake County and pay a costly amount to do so. Alderman Bolger said he would like 10 days to see if he could find some farm land for this application rather than hiring the consultant right now. It was a consensus of opinion that Alderman Bolger be given 10 days to see if he can locate a site and report back at the next meeting. The City could then possibly work with the consultant to make sure the land complies with EPA standards and requirements. Motion by Bolger, seconded by Nolan, to authorize and approve payment of the Yapel l i Ketchmark audit bill in the amount of $10,000. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Contracts MFT Street Maint. Sludge Mgmt. Audit Motion by Smith, seconded by McClatchey, to authorize and Sewer approve Payment Request No. 2 by William Zielger & Son in the amount of Line $56,798 on the Riverside Drive sanitary sewer replacement, force main and Repairs lift station as recommended by Baxter & Woodman. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by Smith, seconded by McClatchey, to authorize and Auth. approve the Arthur Young partial billing, through May 1, 1986, that had been tabled at the July 18, 1986 Council meeting in the amount of $10,886. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by Nolan, seconded by Snell, to approve the issuance of parks picnic beer permits as presented. Beer Voting Aye: Bolger, Lieder, McClatchey, Nolan, Permits Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by Nolan, seconded by Snell, to approve Chief Joyce's Employees request to attend the Chiefs' Conference October 4 through October 9, 1986 in Nashville, Tennessee with expenses not to exceed $640.
