At roll call the following Aldermen were present: Bolger, Donahue, Locke, Smith, Adams, Patterson, Serritella. Absent: Lieder. City Staff in attendance: City Clerk Gilpin, City Administrator Peterson, Director of Parks and Recreation Merkel, Director of Building and Zoning Lobaito, Chief of Police Joyce. Absent: Director of Public Works Batt, City Attorney Narusis. TEN MINUTE PUBLIC INPUT SESSION Anton Rebel of 4009 Maple Avenue suggested that a Public Hearing be held to present both sides of the question concerning the petition that was filed to put a question on the November Ballot whether there should be one or two Aldermen per Ward. Lucy Fick, Board President of School District #15 introduced D. William Dodds, newly appointed Superintendent of the Elementary School District. Dodds said they were present at the meeting to listen to the Concept Plan presentation on the Fritsch property. He asked for continued cooperation between developers, the School Board and the City on all proposed annexation plans. Mary Martin of 1403 N. Court Street asked that something be done concerning the noise and loitering at Veteran's Memorial Park on Court Street after park closing hours. BUILDING PERMIT FEE INCREASES Director of Building and Zoning John Lobaito compiled data comparing permit costs between residential and commercial buildings. Lengthy discussion followed between the Aldermen. Motion by Donahue, seconded by Serritella, to retain the single family permit fees at 120 instead of 160 per square foot. Voting Aye: Locke, Donahue, Serritella, Smith. Voting Nay: Bolger, Patterson, Adams. Absent: Lieder. Motion carried. Motion by Donahue, seconded by Serritella, to refer the building permit fee increases back to the Finance Committee for discussion on commercial and industrial permit fees, and ask the Committee to make a recommendation. Voting Aye: Bolger, Donahue, Smith, Adams, Patterson, Serritella. Voting Nay: Locke. Absent: Lieder. Motion carried. FINAL PLAT - FOXVIEW HIGHLANDS The Plan Commission met August 13, 1992 to consider the Final Plat for the Foxview Highlands Subdivision. The Commission moved to approve the Final Plat, subject to several conditions. Developer Joe Dieschbourg was in the audience to answer any questions of the Aldermen. Motion by Smith, seconded by Bolger, to approve the Final Plat for Foxview Highlands Subdivision, contingent upon the Annexation Agreement being signed and annexation fees being paid, receipt of a letter of intent to grant an easement for a water main extension from Tonyan Industrial Park to Green Street, receipt of a Plat of Dedication for the water main extension, and approval by the City Attorney that all requirements had been met. Voting Aye: Bolger, Donahue, Smith, Adams, Serritella. Voting Nay: Patterson, Locke. Absent: Lieder. Motion carried. August 19, 1992 Page 5 CONCEPT PLAN FOR DEERPATH SUBDIVISON (FRITSCH PROPERTY) The Fritsch Farm Property contains approximately 523 acres, 444 of which are west of the Chicago Northwestern tracks located at the southeast corner of the intersection of Bull Valley and Crystal Lake Roads. The remaining 79 acres are located on the east side of the tracks, with frontage on Bull Valley Road. In attendance were Jack Fritsch, owner of the property, Jerry Harker, President of Centex Homes, their Attorney Fred Feinstein, and John Cottingham and William Sayer of Agriculture Investment Associates, Inc. Harker presented several displays which outlined the scope of the project. The current development plans include 508 single family units and 336 multiple family units for a total of 844 units. The plan also called for dedication of 191 acres for development an 18-hole public golf course, and dedication of 36 acres of wetlands. Harker said they had built two previous golf course residential developments, one in Elk Grove Village and another in Streamwood. They were very successful. It was noted that the idea of a golf course community has been one the City Council has considered for at least 15 years and is supported by the Parks and Recreation Department's Attitude and Interest Survey which showed good support for the development of a public golf course in the City. Two golf course Market Analysis Studies have been performed on the property by Centex which indicated the golf course could be a viable and profitable operation in the City of McHenry. Fritsch wished to annex both the 444 acre parcel, and the 79 acre parcel to the City. The 79 acre parcel east of the tracks is proposed for Business Park Zoning Classification. Properties on the west side of the railroad tracks are proposed as a Planned Unit Development. Harker said they are contemplating an 8-11 year buildout. They were requesting that a Special Meeting be held for detailed discussion on an Annexation Agreement and on the development of a P.U.D for this property. Motion by Serritella, seconded by Patterson, to schedule a Special Meeting for Wednesday, September 9, 1992 at 7:30 P.M. to discuss the Fritsch annexation proposal. Voting Aye: Bolger, Donahue, Locke, Smith, Adams, Patterson, Serritella. Voting Nay: None. Absent: Lieder. Motion carried. RECESS Mayor Busse called for a recess at 9:10 P.M. The Meeting reconvened at 9:28 P.M. with everyone still in attendance. NO PARKING ORDINANCE AROUND VETERAN'S MEMORIAL PARK Charles Adams and Mary Martin of Court Street were in the audience to ask resolution of a problem created adjacent to Veteran's Memorial Park by persons loitering and making noise in the park after closing hours. Motion by Adams, seconded by Smith, to pass an ordinance establishing No Parking restrictions on Court Street east of Veterans Memorial Park between Broad and Pearl Streets, and no parking on the south side of Broad Street between Court and Park Streets, between 10 P.M. and 4 A.M. Voting Aye: Bolger, Donahue, Locke, Smith, Adams, Patterson, Serritella. Voting Nay: None. Absent: Lieder. Motion carried. August 19, 1992 Page 6 WARD REDISTRICTING MAPS A tabulation on Aldermanic voting to select three to four ward redistricting maps from a total of nine was presented to the Council. Motion by Patterson, seconded by Bolger, to recess the Council meeting and reconvene in the Aldermen's Conference Room to review the maps. Voting Aye: Bolger. Voting Nay: Locke, Donahue, Serritella, Patterson, Adams, Smith. Absent: Lieder. Motion did not carry. Motion by Donahue, seconded by Serritella, to schedule a Committee Meeting of the Whole on Wednesday, September 23, 1992 to address the issue of Ward Boundary Redistricting Maps. Voting Aye:..Donahue, Locke, Smith, Adams, Patterson, Serritella. Voting Nay: Bolger. Absent: Lieder. Motion carried. MAYOR'S STATEMENT AND REPORTS The Mayor announced that the Bill Anest Zoning Petition before the County Board concerning a request for B-1 Zoning on the northeast corner of Bull Valley and Route 31 was approved by the County Board 23-1. Anest proposes to construct a service station and convenience food mart, which would also sell alcoholic beverages. The City submitted a letter to the County Board formally protesting approval of this zoning request. SOLICITATION REQUEST Motion by Patterson, seconded by Serritella, to deny the solicitation request of Furniture Ideas of Trinity, North Carolina, for a door-to-door permit to sell furniture in the City. Voting Aye: Bolger, Donahue, Locke, Smith, Adams, Patterson, Serritella. Voting Nay: None. Absent: Lieder. Motion carried. REMOVAL OF WATER RESTRICTION BAN Motion by Locke, seconded by Patterson, to eliminate the restriction on water use in the City of McHenry on September 1, 1992 or sooner, as recommended by the Staff. Voting Aye: Bolger, Donahue, Locke, Smith, Adams, Patterson, Serritella. Voting Nay: None. Absent: Lieder. Motion carried. CONCEPT PRESENTATION BY CUNAT BROTHERS City Administrator Peterson reported that a Petition for Zoning, Annexation, and an Annexation Agreement were filed with the City. The property is owned by a McHenry State Bank Trust and the beneficial owner of the trust is Cunat Brothers. The Petition seeks to annex and zone 22 acres of property just to the east of Petersen Park, commonly known as a portion of the King Farm on the south side of McCullom Lake Road. The usual procedure is to have a Concept Plan presented to the City Council prior to sending the matter to the Plan Commission and Zoning Board of Appeals. Per a phone call to Cunat's attorney John Roth, Roth said the Cunats wish to proceed directly to the Zoning Board and not present their concept plan to the Council. August 19, 1992 Page 7 Motion by Donahue, seconded by Locke, to contact Cunat's attorney John Roth, and schedule a meeting date with him for a conept plan presentation to the City Council on their proposed annexation. PARKS & RECREATION SUPERVISOR REPORT Recreation Supervisor Lorene Marcinek reported that the Fall Program Brochures had been sent and many new programs were being scheduled for the Fall Park session. The Council complimented her on the appearance of the brochure and on the many new programs she has helped develop over the last two years. WAIVE POOL FEE FOR FUND RAISER A fund raiser was planned at the Knox Park Pool on August 7 for Riverwoods elementary student Charlotte Loftus. The inclement weather postponed the event and a new date had been set for Friday, August 21, 1992. Motion by Locke, seconded by Patterson, to waive the rental fee for Knox Park Pool for the August 21, 1992 fundraising event. Voting Aye Voting Nay Absent: Motion carried. PARKWAY RESTORATION Bolger, Donahue, Locke, Smith, Adams, Patterson, Serritella. None. Lieder. The matter of parkway restoration for James Higgins at 4506 W. Front Royal Drive, and James Calvin at 4402 W. Ashley, was raised by Alderman Locke. Motion by Locke, seconded by Serritella, to repair or replace parkway damage done at the Calvin and Higgins properties by sodding or seeding, whichever was necessary. Voting Aye: Patterson, Serritella, Bolger, Locke. Voting Nay: Smith, Adams, Donahue. Absent: Lieder. Motion carried. ADJOURNMENT Motion by Smith, seconded by Adams, to adjourn.
