The Regular Meeting of the McHenry City Council was called to order by Mayor Busse on Wednesday, August 19, 1987 at 8 P.M. at City Council Mtg. Hall. At roll call the following Aldermen were present: Lieder, Nolan, Attendance Patterson, Smith, Serritella, Teta. Absent: Bolger, McClatchey. City staff in attendance were Clerk Gilpin, Chief Joyce. Absent: Superintendent Batt, Attorney Narusis, Park Director Merkel. Mayor Busse called to order a Public Hearing for the purpose of discussion of the 1987-88 Tax Levy Ordinance. He asked if anyone in Approp. & attendance had any comments to make. There was no reply. He asked the Tax Levy City Clerk if any written comments had been presented to the City Clerk's Hearing Office. She replied that one phone call had been received but that no written comments had been submitted. There being no questions or comments from the Aldermen, Mayor Busse adjourned the Public Hearing at 8:03 P.M. Motion by Patterson, seconded by Nolan, to accept the minutes of the August 5, 1987 Regular Meeting, the August 12, 1987 Regular Meeting and the Committee Meeting of the Whole minutes of August 3, 1987 as corrected. Voting Aye: Lieder, Nolan, Patterson, Smith, Serritella, Teta. Voting Nay: None. Absent: Bolger, McClatchey. Motion carried. Mayor Busse announced that Gary Schaefer of the Northeastern Illinois Planning Commission was scheduled on the agenda to discuss the Soil Erosion and Sediment Control Ordinance with the Council but he was unable to attend. At a recent Economic Development Commission meeting, the Commission requested that it be given the opportunity to review that ordinance before it was approved by the City Council. The Mayor suggested deferring passage of the ordinance until Gary Schaefer could meet with the EDC and answer some of their concerns. Since the Soil Erosion and Sediment Control Ordinance was a model ordinance drafted by NIPC, Schaefer felt he would like to meet with the EDC to answer their concerns directly. That meeting will likely be held sometime in September. Alderman Bolger arrived at the meeting at 8:27 P.M. Developer Gary Fairchild and his Attorney Steve Cuda addressed the Council to request approval of preliminary and final plats of Fairchild Estates as presented. The question of whether or not to require the installation of sidewalks in the subdivision was debated. Following lengthy discussion, it was the concensus of the Council that sidewalks be provided either now or at a later date when a Master Plan could be developed by the City Engineers and the Public Works Department. Motion by Teta, seconded by Nolan, to accept the recommendation of the Plan Commission and approve the preliminary and final plats of Fairchild subdivision provided the following conditions are met: 1) Building lines be corrected to 25 feet 2) Soil data be approved by Baxter & Woodman 3) Sanitary sewer easement to lot 9 be marked private 4) A covenant be inserted restricting fence lines in the 5) 6) 7) Voting drainage swale Waive the requirement for curb and gutter for this subdivision Surveyor's certificate be signed and dated Require that sidewalks be installed on Skyway Drive, Green Street and Fairway Drive either now if it meets with the City Engineer's and other subdivision requirements, or at some later time to be determined by the City, with a perpetual escrow fund to be created if sidewalks are not installed immediately and the amount of the escrow to be determined by City Engineers. Plats Wednesday, August 19, 1987 Page 2 Bldg. & Motion by Patterson, seconded by Smith, to grant the request of Zoning McHenry Eby Brown Company for installation of a 65 foot flag pole in Misc. front of their office on Elm Street and to waive all requirements for installation of that flag pole. Voting Aye: Bolger, Lieder, Nolan, Patterson, Smith Serritella, Teta. Voting Nay: None. Absent: McClatchey. Motion carried. Motion by Smith, seconded by Bolger, to approve the request of Letter Elgin Federal Savings Bank and grant a one year extension of their Letter of Credit of Credit to September 1, 1988 for installation of sidewalks and street Tights in McHenry Lakes Estates Unit 1, Phase III; and to approve reduction in said Letter of Credit from $43,285.50 to $4,595.00 as recommended by Baxter & Woodman. Motion by Smith, seconded by Patterson, to authorize the IDOT Superintendent of Public Works to inform the Illinois Department of Transportation (IDOT) that the City of McHenry has no problem with lowering the clearance above the normal pool level by 6 inches on the proposed Route 31/120 replacement bridge over Boone Creek . Voting Aye: Bolger, Lieder, Nolan, Patterson, Smith Serritella, Teta. Voting Nay: None. Absent: McClatchey. Motion carried. Ord. Motion by Teta, seconded by Serritella, to pass an ordinance approving the 1987-88 Tax Levy Ordinance as presented in the amount of Tax Levy $1,150,500. The meeting reconvened at 9:32 P.M. with everyone still in attendance. Mayor Busse reported that he had instructed Building & Zoning Administrator John Zabor to scale down the streetscape plan that was presented to the Council two months ago and to resubmit it for approval in the near future. Alderman Teta, Chairman of the Building & Zoning Committee reported on a committee meeting held August 17, 1987 re recodification of the Municipal Code book. All the items submitted for review were discussed and most were approved as presented. However, City Attorney Narusis' input was needed on several points such as the Health and Sanitation Code - who presides and enforces various sections of that Code, the County or the City. Another point was the excavation and tunneling of streets and the type of fees necessary to assure restoration work. Regarding Chapter 26 of the Municipal Code, the Committee felt the Council should review that chapter collectively. They also felt that Harold Warren of Warren and Associates should be invited to the meeting for his input on fixed fees versus usage fees so it can be compared to what is currently charged for water and sewer service. Joan Marth was instructed to insert the revisions as recommended by the Committee for presentation to the Council for approval. Mayor Busse requested that copies of Chapter 26 of the Municipal Code book be given to all Aldermen with their next agenda packets so they could review it and become familiar with that Chapter prior to a Committee Meeting of the Whole which will be scheduled in September to update and review that section. Alderman Lieder, Chairman of the Finance Committee, reported on a Finance Committee Meeting held August 19, 1987 prior to the Council meeting. The City of McHenry Retail Liquor License Association presented three requests to the City in a letter dated July 14, 1987. 1) The first concern of the Association was to improve communication with the Council as well as the Police Department. The Committee said it would find means to update the Association on the policies, rules and rights guarding their establishments and would answer any concerns presented by the Association. 2) The Association requested that closing hours for Independence Day and Thanksgiving be extended by one hour (from 1 a.m. to Wednesday, August 19, 1987 Page 6 2 a.m.) if they fall on a week day. It was reported that association members were always under the impression that closing hours for New Years Eve were automatically extended by one hour no matter what day it occurred. However, Mayor Busse commented that according to city ordinances, that was not correct. It was the recommendation of the Finance Committee to change the ordinance to extend closing hours by one hour for New Years Eve but not for Independence Day or Thanksgiving. Motion by Lieder, seconded by Teta, to pass an ordinance to extend the closing hours for New Years Eve by one hour if it occurred on a week day. Motion by Smith, seconded state "Extend the closing hours for what day it occurs." Voting on the Amendment: Voting Aye: Bolger, Lieder, Voting Nay: Teta, Patterson. Absent: McClatchey. Motion carried. by Bolger, to amend the motion to New Years Eve by one hour no matter Nolan, Smith, Serritella. Liquor Voting on the original motion which now reads "to pass an ordinance Control extending closing hours on New Years Eve by one hour no matter what day it occurs. Voting on the original motion: Voting Aye: Nolan, Bolger, Smith, Lieder, Serritella. Voting Nay: Teta, Patterson. Absent: McClatchey. Motion carried. The third request of the Association was that the phrase "Unless no patrons are in the building" be included in Section 4-23(2) so that the section would read "During said 15 minute period no employee shall be stationed behind the bar or any service counter used for the sale of alcoholic liquors unless no patrons are in the building." This would then allow family mem ers, cleanup people and employees to be in back of the bar immediately after the closing hour instead of having to wait 15 minutes to begin cleanup operations. Liquor Motion by Lieder, seconded by Nolan, to amend Section 4-23 (2) Control by adding "Unless no patrons are in the building" as discussed. Parks- Motion by Lieder, seconded by Smith, to authorize and approve Beer issuance of picnic beer permits as presented. Permits Voting Aye: Bolger, Lieder, Nolan, Patterson, Smith Serritella, Teta. Voting Nay: None. Absent: McClatchey. Motion carried. Motion by Lieder, seconded by Smith, to pass a resolution Resolution authorizing the City Clerk and Mayor to make application for a credit card which could be used as a credit reference for purchase order and phone ordering for the City of McHenry. Voting Aye: Bolger, Lieder, Nolan, Patterson, Smith Serritella, Teta. Voting Nay: None. Absent: McClatchey. Motion carried. Motion by Teta, seconded by Lieder, to authorize the City Attorney to draft an ordinance establishing a stop sign for westbound traffic on Woodhaven Trail at Brookwood Trail. Voting Aye: Bolger, Lieder, Nolan, Patterson, Smith Serritella, Teta. Voting Nay: None. Absent: McClatchey. Motion carried. Wednesday, August 19, 1987 Page 7 Alderman Serritella reported that a 20 h.p. motor had been seen on McCullom Lake which was in violation of the 7 112 h.p. regulation. A Police Officer was contacted and arrived at the scene but was unable to enforce the City Ordinance regarding horsepower of motors on McCullom Lake. Alderman Lieder left that meeting at 10:30 P.M. Alderman Smith reported on his request from Postmaster Joe Gerhardt to allow ten minute parking in front of the post office on the east side of Green Street. Following discussion, Alderman Smith was instructed to contact the Postmaster and inform him that two 10-minute parking places could not be installed in front of the post office unless the drop-off mail boxes were removed. He will report back at the next meeting. Motion by Bolger, seconded by Teta, to go into executive session at 10:33 P.M. to discuss personnel and property acquisition. Voting Aye: Bolger, Nolan, Patterson, Smith, Serritella, Teta. Voting Nay: None. Absent: Lieder, McClatchey. Motion carried.
