The Regular Meeting of the McHenry City Council was called to order by Mayor Stanek at 8 P.M. on Monday, August 15,1980. At roll call the follow- ing aldermen were present: Pepping, Nolan, Harker, Datz, Wieser, Adams, Schooley, Meurer. Absent: None. Also in attendance were Park Director Merkel, City Attorney Narusis, City Clerk Gilpin, Police Chief Pasenelli. Motion by Datz, seconded by Schooley, to accept the minutes of the August 4, 1980 Regular Meeting and of the August 6, 1980 Special Meeting as read with one correction. Voting Aye: Pepping, Nolan, Harker, Datz, Wieser, Adams„ Schooley, Meurer. Voting Nay: None. Absent: None. Motion carried. Motion by Schooley, seconded by Harker, to approve the final plat of Phase 1 of Lots 1 and 2 in the Commercial area of Riverside Terrace with the mayor and clerk to sign the plat contingent upon receipt of a letter of credit in the amount of $235,840.00. Voting Aye: Pepping, Nolan, Harker, Datz, Wieser, Adams, Schooley, Meurer. Voting Nay: None. Absent: None. Motion carried. Jerry Falcon of Falcon Development, developers of Riverside Terrace, presented a check in the amount of $11,500 as required in their annexation agreement for oversizing of the sewer lines to their property. Tony Varese and Chief Phil Gust of the McHenry Area Rescue Squad addressed the Council regarding a fund raising project on September 10, 1980 whereby the squad hopes to raise money for its continued operation. Mayor Stanek mentioned that since the bids had come in low for Knox Park development, the Council should consider putting up a Community Center at Petersen Park. Due to diminished sales tax returns compared to last year, it Monday, August 18, 1980 Page 2 was decided to wait until a later date for any action but the Council was asked to give it consideration. Mayor Stanek thanked Tony Pintozzi of International Decorators for his donation of painting the Knox Park barn. He expressed gratitude on behalf of everyone in the City for a job well done. Motion by Harker, seconded by Nolan, to authorize the mayor to hire the musical group "Moon" for a Back -To -School Dance in Pearl Street Park on Wednesday, August 27, 1980 at a cost of $400. Voting Aye: Pepping, Nolan, Harker, Datz, Wieser, Adams, Schooley, Meurer. Voting Nay: None. Absent: None. Motion carried. Discussion was held on the possibility of adding ten feet to the apron at the Pearl Street Band Shell. It was decided to undertake the project next spring or summer with completion before 1981 Fiesta Days. Motion by Datz, seconded by Harker, to authorize cleaning the creek _. on both sides of Oakwood Drive along with installing a pond in the area at an estimated cost of $4,000. Voting Aye: Pepping, Nolan, Harker, Datz, Wieser, Adams, Schooley, Meurer. Voting Nay: None. Absent: None. Motion carried. Motion by Meurer, seconded by Schooley, to approve payment of Estimate No. 6 to Wexford Group, Ltd developers of McHenry Lakes Estates, and submit the approval for payment to Elgin Federal Savings & Loan Association in the amount of $65,765.24 said payment recommended by Baxter & Woodman. Voting Aye: Pepping, Nolan, Harker, Datz, Wieser, Adams, Schooley, T Meurer. Voting Nay: None. Absent: None. Motion carried. Motion by Harker, seconded by Pepping, to authorize and approve the Monday, August 18, 1980 Page 3 reduction of the construction bonds for Winding Creek Unit 1 from $653,609 to $201,324 and for Boone Valley Commercial area from $88,496 to $16,815 as recommended by Baxter & Woodman. Voting Aye: Pepping, Nolan, Harker, Datz, Wieser, Adams, Schooley, Meurer. Voting Nay: None. Absent: None. Motion carried. Motion by Schooley, seconded by Adams, to authorize and approve payment of Estimate No. 9 to Keno & Sons Construction for sewage treatment plant additions in the amount of $90,285.50 as recommended by Baxter & Woodman. Voting Aye: Pepping, Nolan, Harker, Datz, Wieser, Adams„ Schooley, Meurer. Voting Nay: None. Absent: None. Motion carried. Motion by Adams, seconded by Nolan, to authorize the installation of curbs on the north side of John Street between Center and Third Streets as designated on a drawing presented to the Council with any minor modifications to be approved by the mayor. The matter was deferred until more detailed specifications could be obtained. Motion by Meurer, seconded by Adams, to authorize and approve the purchase of forms for the police department filing system from the low bidder, Otar Printers of Waukegan for $1,875.00. Voting Aye: Pepping, Nolan, Harker, Datz, Wieser, Adams„ Schooley, Meurer. Voting Nay: None. Absent: None. Motion carried. Motion by Nolan, seconded by Harker, to award contracts to all the low bidders on the Knox Park Development project as soon as written approval is received from Springfield. Page 6 It was noted that low bidder on the ball field fencinq was Best Line Fence Company of Barrington. In a letter dated August 12, 1980, that company asked to be released from its bid due to an error in calculations. The next low bidder fc►• ball field fencing was Hammond Fence Company of Hammond, Inc. in the amount of $10,727.00. Springfield was notified of the change and gave its approval. Therefore, Hammond Fence Company will be awarded a contract for ball field fencing instead of Best Line Fence Co. Motion by Schooley, seconded by Datz, to approve the July Treasurer's Report as presented. Voting Aye: Pepping, Nolan, Harker, Datz, Wieser, Adams, Schooley, Meurer. Voting Nay: None. Absent: None. Absent: None. Motion carried. Mayor Stanek called for a recess at 9:44 P.M. The meeting reconvened at 10:04 P.M. with everyone still in attendance. Motion by Datz, seconded by Harker, to defer the next Council Meeting to Wednesday, September 3, 1980, because Labor Day falls on the regular meet- ing date. Voting Aye: Pepping, Nolan, Harker, Datz, Wieser, Adams, Schooley, Meurer. Voting Nay: None. Absent: None. Motion carried. Motion by Nolan, seconded by Datz, to authorize the closing of the Monday, August 18, 1980 Page 7 a city clerk's office on Saturday, August 30, 1980 for the Labor Day weekend. Voting Aye: Pepping, Nolan, Harker, Datz, Wieser, Adams, Schooley, Meurer. Voting Nay: None. Absent: None. Motion carried. Motion by Meurer, seconded by Schooley, to return the bid bonds to all unsuccessful bidders on the Knox Park Development project. Voting Aye: Pepping, Nolan, Harker, Datz, Wieser, Adams, Schooley, Meurer. Voting Nay: None. Absent: None. Motion carried. Motion by Wieser, seconded by Schooley, to reject a door-to-door solicitation request from the Mental Health Association Bellringer campaign because none of the funds are returned to the McHenry area. Motion by Schooley, seconded by Meurer, to install 290 feet of 10 inch truss pipe on Clearview Drive in Lakeland Park subdivision at a cost of $1,528.30 to correct a drainage problem. Voting Aye: Pepping, Nolan, Harker, Datz, Wieser, Adams., Schooley, Meurer. Voting Nay: None. Absent: None. Motion carried. Motion by Pepping, seconded by Nolan, to authorize a merit raise for Gary Snell of the Public Works Department as approved by the Finance Committee. Motion carried. Schooley, Chairman of the Street & Sidewalk Committee, gave a report on the Main Street sidewalk reconstruction program. Motion by Pepping, seconded by Harker, to reaffirm the Council's decision to award the Main Street sidewalk construction replacement program to Wm. H. Tonyan & Sons, Inc.; based on the fact that the job needs to be completed quickly to avoid prolonged construction and interference with the businesses on Main Street as well as the increased vehicular traffic that is bound to be experienced when school starts shortly; also based upon the super- ior material quality that is provided in the Tonyan bid such as 6-bag mix as opposed to 5-bag; the fact that Tonyan's bid included sealing the concrete; the C & E bid made no mention of curbing; and also the city's attempts to resolve the differences between the Tonyan and C & E bid have been unsuccessful, because C & E did not respond to the city's attempts to discuss it with them; and finally, based upon the city's past satisfactory experience with the Tonyan firm.
