WEDNESDAY, AUGUST 17, 1988 8:00 P.M.
The Regular Meeting of the McHenry City Council was called to
order by Mayor Busse on Wednesday, August: 17, 1988 at 8 P.M. at City
Hall. At roll call the following Aldermen were present: Bolger, Nolan, Council
Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Absent: None. Mtg.
City staff in attendance were Supt. Batt, Attorney Narusis, Clerk Gilpin, Attendance
Park Director Merkel, Chief Joyce, Finance and Personnel Administrator
Vitas, Director of Development Greenwood.
Police Chief Joyce and Mayor Busse presented an award to Bill
Miller who has served the City of McHenry for 20 years as an Auxiliary Employees
Policeman. The Mayor expressed gratitude for his dedicated service to
the citizens of McHenry and the Police Department.
Nancy Fike, Chairman of the McHenry Landmark Commission, Landmark
presented Landmark Plaque No. 11 to Greg Dirkes, owner of the Whales Tail Commission
at 3425 W. Pearl Street. The building known as the Old McHenry Brewery
Building was built in 1868.
Ron Bosse gave a concept presentation of the McHenry County Annexations
Health Club which he plans to construct at 702 S. Route 31. Following
his presentation it was the consensus of opinion that he should proceed
to the Plan Commission and Zoning Board of Appeals for annexation and
zoning to the City of McHenry.
Motion by Teta, seconded by Nolan, to approve the block party
requests of Debbie Heisler on Creekside Trail - Saturday, September 17, Block
and for Laura Tobin on Valley Road - September 17, 1988. Parties
Voting Aye: Bolger, Nolan, Lieder, Teta, Smith,
McClatchey, Patterson, Serritella.
Voting Nay: None.
Absent: None.
Motion carried.
Motion by Smith, seconded by Serritella, to approve the
reduction in the Letter of Credit for Winding Creek 5 Unit 1 from its Letters of
present value of $1,048,165.00 to $158,125.00 subject to the receipt of Credit
an open end guarantee bond in the amount of $142,406.40 as recommended by
Baxter & Woodman.
Voting Aye: Bolger, Nolan, Lieder, Teta, Smith,
McClatchey, Patterson, Serritella.
Voting Nay: None.
Absent: None.
Motion carried.
The 1988-89 Levy Ordinance was presented to the Council in the
amount of $1,277,763.00. A Public Hearing on the Levy Ordinance will be
held August 31, 1988 at 8:00 P.M. in City Hall.
Motion by McClatchey, seconded by Bolger, to authorize and Special
approve partial payment to George W. Kennedy Construction Co. in the Assessments
amount of $256,158.00 for the McHenry Shores Sanitary Sewer System
Special Assessment Project as recommended by Baxter & Woodman.
Voting Aye: Bolger, Nolan, Lieder, Teta, Smith,
McClatchey, Patterson, Serritella.
Voting Nay: None.
Absent: None.
Motion carried.
Motion by Patterson, seconded by Smith, to authorize and
approve payment of the regular list of bills in the amount of Insurance
$159,459.88; for the supplemental list of bills in the amount of public Prop
$68,453.20; for the final installment to W MRMA for Risk Management Purchases
Insurance in the amount of $97,539.00 and to Condor Construction Co.
as partial payment for the salt storage facility in the amount of
$23,255.00 as presented.

Mayor Busse announced the sprinkling ban would be lifted
Water completely since the water 'towers and wells were up and running at full
Service capacity now. He also reported on a streetscape meeting held with the
Downtown Revitalization Committee on Monday, August 15, 1988 at City
Hall. It was decided to discuss the matter further during a Special
Meeting already scheduled for August 29, 1988 at 8:00 P.M. At that time
bids will be awarded for the Special Assessment Project and the street
scape discussion will also be added to that agenda.
The Park Committee presented a report on their meeting held
Wednesday, August 10, 1988 concerning developer donations for First
Addition to Winding Creek Unit 5. It was the Committee's recommendation
that the developer be required to donate five acres and $50,000 in lieu
of any other developer donation fee for parks. Don Gerstad of Gerstad
Builders addressed the Council and presented his views on the Park
Committee recommendation. Gerstad felt that what was being asked was in
excess of the Developer Donation Ordinance. Busse pointed out that in
annexation negotiations, the Council can make any arrangements it
wishes. Gerstad said that instead of the five acres and $50,000 he would
be willing to donate 7 1/2 acres or half of that in land and half in
fees. Lengthy discussion followed.
Motion by Patterson, seconded by Nolan, to approve the Park
Committee recommendation and incorporate into the annexation agreement
for First Addition to Winding Creek 5 the following recommendation: That
the developer be required to donate five acres and $50,000 in lieu of
any other developer donation fee for parks, the land to be located along
the northern border of the parcel to allow for further expansion with the
Failed future development of land north of this site, the exact location of the
Motions five acre parcel shall be determined after onsite inspection by the
Developer Director or Parks and approval of the City Council.
Donations Voting Aye: Nolan, Teta, Patteson.
Voting Nay: Bolger, Lieder, Smith, McClatchey, Serritella.
Absent: None.
Motion did not carry.
Motion by Serritella, seconded by Teta, to incorporate into the
annexation agreement for First Addition to Winding Creek 5 that the City
request the developer to give the necessary buffer as the Park Committee
Tabled needs at this point in time and whatever land that totals out to be
Motions (whether it be 7.5 acres or whatever) in lieu of any cash which our
ordinance states; and have that described as the Park Committee
recommends to be along the northern end of the property as a buffer for
further extension up north -- that is to say that the developer be
required to donate up to 7.4 acres but no cash. Following discussion,
Teta withdrew his motion and Smith seconded it.
Motion by Patterson, seconded by Nolan, to table the motion.
Voting Aye: Nolan, Teta, Lieder, Patterson.
Voting Nay: Bolger, Smith, McClatchey, Serritella.
Absent: None.
There being a tie vote, Mayor Busse cast an Aye Vote and declared the
motion carried.

Park Committee Chairman Patterson scheduled a Park Committee
Meeting for Tuesday, August 23, 1988 at 7:45 P.M. to discuss developer
donations for the First Addition to Winding Creek 5.
Mayor Busse called for a recess at 10:30 P.M. The meeting
reconvened at 10:40 P.M. with everyone still in attendance.
Alderman Teta, spokesman for the Environmental Advisory
Committee, reported on the Environmental Advisory Committee Meeting held
Tuesday, August 16, 1988 on the subject of leaf burning. He said it was
a very informative meeting and wished to publicly thank Dr. Maichle Bacon
from the McHenry County Health Department, Dr. Jacob Dumelle, Chairman of
the Illinois Pollution Board, McHenry Township Fire Chief Chris Bennett,
and Fire Inspector Steve Laing who is the Township's Code Enforcement
Officer and Dave Kozlowski of the McHenry County Defenders. The purpose
of that meeting was to discuss the health, safety and environmental
aspects of leaf burning in the City. The Environmental Advisory
Committee set another meeting for Tuesday, August 30, 1988 at 7:30 P.M.
in the Council Chambers to further discuss a method of leaf disposal.
Motion by Lieder, seconded by Patterson, to approve transfer of Ords.
Wag's Class "H" liquor license to to Marriott Family Restaurants who
recently purchased the Wag's chain at 4228 Id. Elm Street. Liquor
Voting Aye: Bolger, Nolan, Lieder, Teta, Smith, Licenses
McClatchey, Patterson, Serritella.
Voting Nay: None.
Absent: None.
Motion carried.
Motion by Smith, seconded by Serritella, to authorize and
approve the issuance of picnic beer permits as presented as well as a
permit for School District 15. Parks

Motion carried.
Motion by Smith, seconded by McClatchey, to go into executive Executive
session at 11:03 P.M. for the purpose of discussing property acquisition. Session

McClatchey, Patterson, Serritella.

Absent: None.
Motion carried.

session at 11:14 P.M.
