AUGUST 15, 1990 8:00 P.M.
In the absence of Mayor Busse, Mayor Pro-tem Raymond Smith
called the meeting to order on Wednesday, August 15, 1990 at 8 P.M. in
City Hall. At roll call the following Aldermen were present: Bolger,
Donahue, Lieder, Teta, Smith, Patterson, Serritella. Absent:
McClatchey. City staff in attendance were Director of Public Works Batt,
Attorney Narusis, Clerk Gilpin, Park Director Merkel, Chief Joyce,
Building & Zoning Officer Halik, City Administrator Peterson.
During the 10 minute public input session, Anton Rebel of 4009
W. Maple Avenue expressed his concerns on sidewalk repair in the City,
empty gravel trucks going through residential districts and suggested
that the Council have one meeting a year so all of the people can get
answers to their questions. Tony Salgado, President of the Northfox
Condo Association, also addressed the Council during the 10 minute public
input session and expressed his concerns about the lack of screening
between the Northfox Condominium Complex and commercial properties
abutting the east side of the Northfox property.
Motion by Bolger, seconded by Patterson, to approve the minutes
of the August 1, 1990 Regular Meeting as presented.

Patterson, Serritella.

Ronald Bykowski, developer of the Chapel Hill Commercial Center
located near the intersection of Route 120 and Chapel Hill Road
approached the Council to request preliminary plat approval of the
Commercial Center. The subject property is located outside the City
limits but within the City of McHenry's 1 1/2 mile jurisdiction and
therefore must meet all of the City of McHenry Subdivision Control
Ordinance regulations. The McHenry Plan Commission reviewed and approved
the preliminary plat at its July 19 Plan Commission Meeting. Several
Aldermen expressed concerns about Lot 6 which is a U-shape parcel which
surrounds a well house owned by the Eastwood Manor Water Company and is
in a residential area. It appeared that Lot 6 was the only lot with
access to Country Lane through the residential subdivision. Bykowski
noted that he does not intend to build on Lot 6 at this time and did not
know how and when that parcel would be developed.
Motion by Bolger, seconded by Serritella, to Approve the
preliminary plat of Chapel Hill Commercial Center as presented:
Lengthy discussion continued.
Motion by Bolger, seconded by Serritella, to move the question
and close debate.

Motion by Teta, seconded by Patterson, to concur with the
recommendation of the Zoning Board of Appeals and pass an ordinance
granting the request of Grain Mall Center Ltd. (Brian Cunat) and
reclassifying the property at 4004 W. Elm Street from I-1 Industrial
District to 0-2 Office Park District conditioned upon the property being
developed as a single lot with no access directly onto Elm Street.
Voting Aye: Bolger, Donahue, Lieder, Teta; Smith,
Patterson, Serritella.

Motion by Donahue, seconded by Bolger, to concur with the
recommendation of the Zoning Board of Appeals at the request of James and
Susan Pasternok and to pass an ordinance reclassifying the property on
Route 31 approximately 250 feet south of the Warsaw Inn from RM-1
multi -family residential district to C-5 highway commercial district and
to grant a variation of the minimum lot width for the C-5 highway
commercial district from 200 feet to 128.15 feet.
Voting Aye: Bolger, Donahue, Lieder, Teta, Smith,
Patterson, Serritella.

Absent: McClatchey.
Motion carried.
Motion by Serritella, seconded by Donahue, to concur with the
Zoning Board of Appeals recommendation to grant the request of Frank and
Patricia Olesuk and pass an ordinance granting a minimum corner side yard
setback at 5206 W. Elm Street from 30 feet to 20 feet along the west
boundary of the subject property. A

Alderman Lieder left the Council Room at 9:00 P.M.
Don Meyer, representing Green Valley Subdivision, requested that
the Council approve an easement disclaimer for lot 84 in Green Valley I
since the City has no facilities located on that easement strip and does
not anticipate any future need for such an easement.
Motion by Teta, seconded by Donahue, to authorize execution of
the Easement Disclaimer as submitted.
Voting Aye: Bolger, Donahue, Teta, Smith,
Patterson, Serritella.
Voting Kay: None.
Absent: McClatchey, Lieder.
Motion carried.
Alderman Lieder returned to the Council Meeting Room at 9:05 P.M.
Ann Sommer, Vice Chairman of the Environmental Advisory
Committee, presented a report of the EAC Committee Meeting held July 31,
1990. The report was submitted as a matter of information to the Council.
Motion by Teta, seconded by Patterson, to accept W report of
the Environmental Advisory Committee and enter it into the Council
records.

Patterson, Serritella.
Voting Nay: None.
Absent: McClatchey.

Motion by Lieder, seconded by Teta, to approve the request of
Myron N. Sen of 202 Springbrook Court for a fence variation as presented.

of the Fireman of Company 1, McHenry Township Fire Protection District to
solicit on City Street corners on August 24 and August 26, 1990 for "Fill
the Boot Campaign" benefitting Muscular Distrophy Association.

Chief Joyce was asked to study the possibility of installing
