The Regular Meeting of the McHenry City Council was called to order Council by Mayor Stanek on Monday, August 15, 1983 at 8:00 P.M. in city hall. At roll Meeting call the following aldermen were present: Bolger, Nolan, Busse, Datz, Smith, McClatchey, Snell, Serritella, City staff in attendance were Supt. Halvensleben, Attend - Attorney Narusis, Clerk Gilpin, Chief Pasenel1i, Park Director Merkel. ance Motion by Serritella, seconded by Nolan, to accept the minutes of the August 1, 1983 Regular Meeting as presented. Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Serritella, Smith, Snell. Voting Nay: None. Absent: None. Motion carried. Hal Paul addressed the council to request a concensus of opinion Annexations regarding his proposal to annex his property located just south of Nelson Electronics near the intersection of Route 31 and Bull Valley Road. It was a concensus of opinion of the council that he should proceed with the necessary petitions. Motion by Bolger, seconded by Nolan, that the council agree in Agreements principal with the proposal submitted by the Lakeland Park Property Owners' Land Association to have the City of McHenry accept and maintain all of the Acquisition association's properties contingent upon a favorable vote by members of the Lakeland Park Property Owner's Association. Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Serritella, Smith, Snell. Voting Nay: None. Absent: None. Motion carried. Motion by Smith, seconded by Serritella, to approve the final Plat plat of Tonyan Industrial Park Unit #3 contingent upon presentation of an Approvals appropriate letter of credit or performance bond. Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Serritella, Smith, Snell. Voting Nay: None. Absent: None. Motion carried. Motion by Nolan, seconded by McClatchey, to include Lot B in the Plat plating of Winding Creek Unit #3 as presented. Approvals Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Serritella, Smith, Snell. Voting Nay: None. Absent: None. Motion carried. Motion by Busse, seconded by Nolan, to authorize that the Huntington Court cul-dE!-sac in Lot B of Winding Creek Unit #3 be designated as a private Streets drive and not a public street. Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Serritella, Smith, Snell. Voting Nay: None. Absent: None. Motion carried. Motion by Smith, seconded by Datz, to concur with the Plan Commission's Plan recommendation and grant a variation on the lot depths of the following lots in Commission Winding -Creek Unit #3: Block 1, Lot 11; Block 2, Lots 20, 21, 22, 23; Block 3, Recommenda Lots 17, 18; Block 5, Lots 12, 13, 14, 15. tion Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Serritella, Smith, Snell. Datz, to approve the final plat of receipt of an appropriate letter of Busse, Datz, McClatchey, Serritella, ti Plat Approval Monday, August 15, 1983 Page 2 Letters of Motion by Datz, seconded by Busse, to authorize the release Credit of the $10,000 letter of credit for Boone Valley Units #12 and #13 as recommended by Baxter & Woodman in their letter of August 11, 1983. Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Serritella, Smith, Snell. Voting Nay: None. Absent: None. Motion carried. Sidewalks A question arose as to installation of a sidewalk and driveway for a residence owned by Residential Development Group at the corner of Crystal Lake Road and Greenbrier Drive. Vice President Jim Berg of RDG stated that the sidewalk and driveway would be installed before winter set in. Zoning Ord. Motion by McClatchey, seconded by Busse, to instruct the City Sign Permits Attorney to draw up a petition for presentation to the Zoning Board of Appeals regarding changes in the procedure for sign permit variations. Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Serritella, Smith, Snell. Voting Nay: None. Absent: None. Motion carried. Sign Motion by Smith, seconded by Bolger, to permit Residential Permits Development Group to erect three temporary signs for a period not to exceed 90 days at the following locations: A subdivision sign at the entrance to Millcreek Subdivision on Orleans off McCullom Lake Road, a directional sign on the east side of Route 31 across from McCulllom Lake Road and a construction sign on the corner of Orleans and Prestwick. Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Serritella, Smith, Snell. Voting Nay: None. Absent: None. Motion carried. )rdinances Motion by Bolger, seconded by Nolan, to amend the Subdivision Subd. Control Control Ordinance Section VIII, Article E, 6d, #5 to state wherE! plastic )rdinances PVC pipe is used, tracing wire must be located along the center line of the pipe and all house service connections must use special metallic taping saddles for future tracing purposes. Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Serritella, Smith, Snell. Voting Nay: None. Absent: None. Motion carried. Motion by Smith, seconded by Bolger, to revise the proposed 1983- 1984 Levy Ordinance by eliminating the school crossing levy and use a street lighting levy rate of .035 and lower the debt service rate to permit the tax rate to remain the same as last year which was .852. On the advice of the City Attorney Narusis, Mayor Stanek declared the motion out of order. Approp. & Levy Motion.by Smith, seconded by Bolger, to adjust the proposed Tax Ordinances & Levy Ordinance for 1983-1984 by eliminating -the school crossing levy and Hearings use a street lighting ley rate to permit the tax rate to remain the save as last year which was .852. Voting Aye: Bolger, McClatchey, Smith, Snell, Serritella, Nolan, Busse. Voting Nay: Datz. Absent: None. Motion carried. City Attorney Narusis reported to the Council on a lawsuit that was filed in 1979 by Shamrock Farms and some property owners residing west of Draper Road and Curran Road against the City of McHenry, Fred Meyer and Residential Development Group as purchasers of the Backhaus property. A Monday, August 15, 1983 Page 3 copy of the consent decree was given to each aldermen. It represented a settle- Lawsuits ment of the differences between the plaintiffs and the annexing parties which was contingent upon an amendment of the annexation agreement and ordinances relating to the use and zoning of certain property abutting on Curran Road. Motion by Nolan,seconded by Busse, to authorize the City Attorney to enter into the consent decree on behalf of the City of McHenry. Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Serritella, Smith, Snell. Voting Nay: None. Absent: None. Motion carried. Mayor Stanek called for a recess at 10:25 P.M. The meeting reconvened at 10:32 with everyone still in attendance. Motion by Nolan, seconded by McClatchey, to advertise for bids on a proposed Washroom/Storage Building in Petersen Park with an option for central and overhead heating. Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Serritella, Snel 1 . Voting Nay: Smith. Absent: None. Motion carried. Motion by Snell, seconded by Smith, to authorize and approve the issuance of picnic beer permits as presented. Voting Aye: Bolger, Nolan, Busse, McClatchey, Serritella, Smith, Snell. Voting Nay: Datz. Absent: None. Motion carried. Motion by Nolan, seconded by Snell, to authorize and approve the request for a St. Jude's bike-a-thon on September 24, 1983.
