WEDNESDAY, AUGUST 8, 1990
A Special Meeting of the McHenry City Council was called to
order by Mayor Busse on Wednesday, August 8, 1990 at 7:30 P.M. at City
Hall. At roll call the following Aldermen were present: Bolger,
Donahue, Lieder, Smith, Serritella. Patterson arrived at 7:35 P.M.
McClatchey arrived at 7:40 P.M. Teta arrived at 8:07 P.M. M. Absent:
None. City staff in attendance were Attorney Narusis, Clerk Gilpin, City
Administrator Peterson, Building & Zoning Officer Halik.
The purpose of the Special Meeting was to consider the
Annexation Agreements of Biscayne Highlands, Althoff Industrial Petition
and to conduct any and all business which might properly come before the
Council.
Motion by Donahue, seconded by Bolger, to grant the request of
Brake Parts Company for hook-up to the Police Alarm Board.
Voting Aye: Bolger, Donahue, Lieder, Smith, Serritella.
Voting Nay: None.
Absent: Patterson, Teta, McClatchey.
Motion carried.
The first matter to be discussed was the Biscayne Highlands
Annexation Agreement and related documents. Petitioner Donald. White was
in attendance with his attorney Steve Cuda. Lengthy discussion took
place on the matter of servicing the property with water facilities and
the question of recapture fees. It was determined that the concerns of
the Council and the petitioners were addressed in the Annexation
Agreement and final engineering plans.
Motion by McClatchey, seconded by Patterson, to pass an
ordinance approving the Annexation Agreement subject to the City
Attorney's approval of the language, and to authorize the Mayor and City
Clerk to execute the agreement.
Voting Aye: Bolger, Donahue, Lieder, Teta, Smith,
McClatchey, Patterson, Serritella, Busse.
Voting Nay: None.
Absent: None.
Motion carried.
Motion by Patterson, seconded by Smith, to pass an ordinance
annexing the Biscayne Highlands territory as presented.
Voting Aye: Bolger, Donahue, Lieder, Teta, Smith,
McClatchey, Patterson, Serritella.
Voting Nay: None.
Absent: None.
Motion carried.
Motion by Donahue, seconded by Teta, to pass an ordinance
classifying the Biscayne Highlands Property as RS-2 Single Family
District as presented.
Voting Aye: Bolger, Donahue, Lieder, Teta, Smith,
McClatchey, Patterson, Serritella.
Voting Nay: None.
Absent: None.
Motion carried.
The second matter on the agenda was consideration of a petition
for annexation and approval of an annexation agreement presented by J.
Althoff Association, Inc. In attendance were petitioner James Althoff
and his attorney Mark Saladin of Militello, Zanck and Coehn. The
petitioner was requesting annexation of 10 acres of land located on the
east side of Route 31 south, approximately 300 feet north of the
intersection of Dayton Street and Route 31 immediately north of the
Tonyan Industrial Park. He was requesting a zoning classification of I-1
Industrial District. The annexation agreement was reviewed paragraph by
paragraph. On Page 6, Paragraph 8, the last sentence was deleted since
there are no existing residences on the premises. Paragraph 9 was
deleted in its entirety since there are no recapture agreements
pertaining to this property. Paragraph 13 - the phrase in parenthesis
was deleted since no residential homes are now on the property.
Lengthy discussion took place on whether or not to charge
annexation fees and how much.

Motion by Bolger, seconded by McClatchey, that as a Council
statement of policy no annexation fees be charged for any industrial
property annexations.
Voting Aye: Patterson, McClatchey, Smith, Donahue, Bolger.
Voting Nay: Serritella, Lieder, Teta.
Absent: None.
Motion carried.
It was the recommendation o.fthe Councilthatthe Finance'& Building
& Zoning Committees take under consideration the establishment of annexation
fees and present their findings to the Council for action.
Motion by Patterson, seconded by Donahue, to pass an ordinance
approving the Annexation Agreement subject to the changes made at this
meeting and to authorize the Mayor and City Clerk to execute the
agreement.
Voting Aye: Bolger, Donahue, Lieder, Teta, Smith,
McClatchey, Patterson, Serritella, Busse.
Voting Nay: None.
Absent: None.
Motion carried.
Motion by McClatchey, seconded by Smith, to pass an ordinance
annexing the 10 acre Althoff property as presented.
Voting Aye: Bolger, Donahue, Lieder, Teta, Smith,
McClatchey, Patterson, Serritella.
Voting Nay: None.
Absent: None.
Motion carried.
Motion by Donahue, seconded by Teta, to pass an ordinance zoning
the Althoff property as I-1 Industrial District as presented.
Voting Aye: Bolger, Donahue, Lieder, Teta, Smith,
McClatchey, Patterson, Serritella.
Voting Nay: None.
Absent: None.
Motion carried.
Motion by Smith, seconded by McClatchey, to adjourn.
