The Regular Meeting of the McHenry City Council was called to order by Mayor Busse on Wednesday, August 7, 1985 at 8:00 P.M. in city Council hall. At roll call the following Aldermen were present: Bolger, Lieder, Mtgs. McClatchey, Nolan, Smith, Snell, Serritella, Teta. Absent: None. City Attendance staff in attendance were Supt. Halvensleben, Attorney Narusis, Clerk Gilpin, Park Director Merkel. Absent: Chief Joyce. Motion by Bolger, seconded by Nolan, to accept the minutes of the July 31, 1985 Regular Meeting as amended. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Bids were opened for the sale of two lots in Orchard Heights Subdivision. Only one bid was received. Louie C. Hager of 117 N. Hill Road, McHenry submitted a bid of $1,700 for Lot 20. No bids were received for Lot 14. Motion by Serritella, seconded by Snell, to accept the bid Sale of as presented from Louie C. Hager for Lot 20 at a purchase price of City $1,700. Property Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Attorney Narusis reported that approximately $1,500 in back taxes was due on the 27 acres of land which RDG had placed in escrow for park land as required in the annexation agreement with Winding Creek Subdivision. Attorney Narusis contacted Don Gerstad of RDG regarding payment of these back taxes but was told that RDG no longer had any interest in the property since August of 1984. He was given the name of Dan Leight who was the new purchaser according to Gerstad. When Attorney Narusis contacted Mr. Leight, he was told that he did not own the property but was just an agent. Leight felt that his client was not responsible for the back taxes. It was decided that the City should pay the back taxes and then Attorney Narusis should attempt to get reimbursement from the proper parties. Motion by Lieder, seconded by Nolan, to authorize the City Annexations Clerk to make payment of the back taxes in the amount of approxi- Winding Creek mately $1,500 and to instruct the Attorney to proceed with the neces- sary paper work to get reimbursement on the paid taxes from the rightful owners. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Donald Gerstad of Residential Development Group appeared Annexations before the Council to request that a bill submitted to him for annex- ation fees in the amount of $12,500 principal and $5,275.01 interest Winding Creek be waived. He reported that when Unit III of Winding Creek Subdi- vision is completed, RDG would develop no further property. Motion by Teta, seconded by Lieder, that all parties live up Annexations to the annexation agreement for Winding Creek Subdivision and that RDG be required to pay the principal and interest past due on the Winding Creek annexation agreement fees in the amount of $17,775.01. Voting Aye: Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: Bolger. Absent: None. Motion carried. Wednesday, August 7, 1985 page 2. Gerstad then asked the Council if it would consider accept- ing a donation of land in lieu of cash. Committees- Motion by Smith, seconded by McClatchey, to Auth. Public Property Committee to consider the suggestion Annexations accept donation of land in lieu of cash and that the back with a recommendation within 30 days and that Winding continue to accrue on the principal of $12,500 until Creek fee matter is finalized. Ordinances Motion by Smith, seconded by McClatchey, to annex the pro- perty at 801 Lillian Street, waive the retained personnel fee in this Annexations instance, and submit a bill to the Murphys for cost incurred by the City Attorney in drafting the annexation ordinance. Committees- Mayor Busse asked - that the Building & Zoning Committee Auth. study the matter of annexation fees for single lot annexations and submit a recommendation to the City Council at a future date. Liquor Motion by Smith, seconded by Serritella, not to increase the Control & number of liquor licenses and deny the request of McHenry Amoco at Licenses 3817 W. Elm Street for a liquor license. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Serritella, Teta. Voting Nay: Snell. Absent: None. Motion carried. Purchases- Motion by Nolan, seconded by Snell, to authorize and approve City Clerk a down payment to Cogebec, Inc. for computer hardware and application systems software for the City Clerk's office in the amount of $13,964.80. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Letters of Motion by Serritella, seconded by Snell, to accept the Waiter Credit & Sewer Improvements on the Cunat Property in Lot 2 of Kaufman Subdi- vision and release their letter of credit in the amount of $16,250. Water Sewer Voting Aye: Bolger, Lieder, McClatchey, Nolan, Misc. Smith, Snell, Serritella, Teta. Extensions Voting Nay: None. Absent: None. Motion carried. Ordinances Motion by McClatchey, seconded by Lieder, to accept 'the recommendation of the Zoning Board of Appeals and pass an ordinance Zoning Ords. amending the City of McHenry Zoning Ordinance concerning off-street parking. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Park Director Merkel reported that four price proposals had been received for renovation of the West Beach in Lakeland Park. They were as follows: O'Leary Excavating of Woodstock $3,800, J. Pease Construction of Richmond $4,000, Decker Construction of McHenry $4,700, J. Anzinger and Son of Hebron $5,890. Wednesday, August 7, 1985 page 3 Motion by Lieder, seconded by Nolan, to accept the proposal of O'Leary Excavating of Woodstock in the amount for renovation of the West Beach Park in Lakeland Park. Motion carried. low price Bid Opening & of $3,800 Awarding Mayor Busse asked confirmation of the following apppoint- ments: Robert Jessup as Vice -Chairman of the Zoning Board of Appeals, Richard Doherty Jr. as board member on the McHenry Public Library, and Ryan Schwalenberg as new Public Works employees. Motion appointment of Appeals. Public Property Purch. & Repairs by Lieder, seconded by Snell, to confirm the Mayor's Appointments - Robert Jessup as Vice -Chairman of the Zoning Board of Officials, etc. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by Nolan, seconded by Teta, to confirm the appointment of Richard Doherty Jr. of 502 N. Kensington Drive McHenry Public Library with his term to expire July 1, 1988. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Mayor's Appointments - to the Officials, etc. Motion by Bolger, seconded by Nolan, to confirm the Mayor's Employees hiring of Ryan Schwalenberg of 1905 N. North Avenue, McHenry as a new Public Works employee to be paid at the starting salary schedule of the Public Works Department. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Mayor Busse called for a recess at 9:40 P.M. The meeting reconvE!ned at 9:52 P.M. with everyone still in attendance. Motion by Nolan, seconded by Serritella, to approve the Block Parties request: of Madonna Pepe of 3609 W. Cornell Ct. for a block party to be held in the Millcreek Subdivision on August 10, 1985. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. The Finance Committee Chairman, Alderman Lieder, announced that a Public Hearing regarding the 1985-86 Tax Levy Ordinance would be held on Wednesday, August 21, 1985 at 8:00 P.M. in City Hall. Alderman Bolger reported to the Council that he had reviewed the Green Street Parking Lot to determine if a request by McHenry Savings Bank for use of 12 stalls for unlimited parking was feasible. Approp. & Levy Council Mtgs.- Spec., Pub. Hrg Motion by Smith, seconded by Teta, to grant the use of 12 Parking Regs. unmarked parking spaces for use by McHenry Savings Bank for a trial Lots period of six months in the Green Street Parking Lot. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by Smith, seconded by Snell, to authorize and approve Parks -Beer issuance of picnic beer permits as presented. Discussion took place on the numerous complaints being received on mosquito annoyance. Mosquito Motion by Lieder, seconded by Nolan, to authorize the Mayor Abatement and City Clerk to spend whatever money they feel is necessary to alleviate the mosquito problem after having conferred with Protec- tion Unlimited. Voting Aye: Bolger, Lieder, Nolan, Smith, Snell, Teta. Voting Nay: McClatchey, Serritella. Absent: None. Motion carried. Resolutions Motion by Bolger, seconded by Smith, to pass a resolution officially recognizing the service of Earl R. Walsh upon his retirement from the McHenry Plaindealer for 50 years of sports column journalism. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None.
