Mayor Stanek called the Special Meeting to order on Thursday, August 7, 1980 at 7:30 P.M. for the purpose of discussing the proposed Flood Plain Ordinance; discussing Step I Grant Application by McHenry Shores for a sewer treatment plant; discussing McHenry Lakes Estates request for reimbursement for oversizing sewer lines to McCullom Lake Road and Route 31; and for any and all business which might come before the Council. At roll call, the following aldermen were present: Pepping, Harker, Datz, Wieser, Adams, Schooley, Meurer. Absent: Nolan. Also in attendance were City Attorney Narusis, City Clerk Gilpin, City Engineer Dr. Hal Sundin and Park Director Merkel. Merkel reported on the bid opening for Knox Park development which were opened at 4 P.M. August 7, 1980. The following bids were received: Pool & Bathhouse: Wm. H. Regarding discussion on a proposed Flood Plain map for the City of McHenry, Clerk Gilpin reported that she had been in contact with the Federal Emergency Management Agency in Washington and was told that a letter was in the mail in reply to our City Engineer's comments and objections to the flood plain map proposed by the government. Since all the materials were not immediately available to the Council, it was decided to postpone discussion until a later date. Discussion was held on the Step I Grant Application by McHenry Shores for a Facilities Area Planning project. A letter of cooperation was requested by the EPA indicating that the City of McHenry would cooperate with McHenry Shores on this FAP project. Questions were raised as to whether the City of McHenry would lose its designation as management authority for the 208 project and whether the City would be giving up any degree of autonomy in agreeing to cooperate in the Step I planning. Another concern was if the City of McHenry embarked on construction of a sewer plant by itself, would it be required to do Step I planning with or without a grant or would the Step I planning done by McHenry `.shores accomodate a City of McHenry proposal. David Grimes, president of the Village of McHenry Shores, was in attendance along with his city engineer, George Hecht of Baxter & Woodman. Following lengthy discussion, Attorney Narusis was authorized to draft a letter to the EPA whereby the City of McHenry would not lose any of its options and cooperation on McHenry Shores Step I Grant application would apply to planning only and imply no future commitment for development. It will be Thursday, August 7, 1980 Page 3 presented to the Council for approval at the next meeting. A bill submitted by Joslyn & Green, a law firm for developers Milfred Towne and Howard Orleans of McHenry Lakes Subdivision, for the oversizing of sewer lines to McCullom Lake Road was discussed. The costs of oversizing were set forth as follows: Total additional construction costs $38,639.00 Extra dewatering costs 1,312.50 Attorney's fees in connection with recapture 3,500.00 Additional engineering costs 640.00 Total $44,091.50 Following discussion, motion by Wieser, seconded by Pepping, to reject the claim for legal fees in the amount of $3,500.00 Voting Aye: Pepping, Harker, Datz, Wieser, Adams, Schooley, Meurer. Votinq Nay: None. Absent: Nolan. Motion carried. Motion by Harker, seconded by Wieser, to reject the claim for engineer- ing fees in the amount of $640.00. Voting Aye: Pepping, Harker, Datz, Wieser, Adams, Schooley, Meurer. Voting Nay: None. Absent: Nolan. Motion carried. Mayor Stanek noted that in an agreement signed with McHenry Lakes Estates March 19, 1979, the developers agreed to pay $40,000.00 to the city 18 months after the date of the execution of the agreement "as and for a fee to permit the connection of sanitary sewer to the Lakeland Park pump- ing station." That payment will be due to the city September 19, 1980. Stanek was authorized'to write a letter incorporating the $39,951.50 bill from McHenry Lakes Estates with the $40,000.00 payment due to the city from those same developers. It was brought to the Council's attention that some of the oversizing of the sewer lines through McHenry Lakes Estates would accomodate more than just the Falcon Development subdivision of Riverside Terrace. There would be some recapture monies coming from other people or developments to the north and east of McHenry Lakes and Riverside Terrace. A $100 surcharge was put on each house in the Riverside Terrace subdivision so that when the lift Thursday, August 7, 1980 Page 4 station in Lakeland Park is at capacity, that money can be used to build a forced pumping station that can force sewerage down the railroad tracks to intercept the main trunk line to the south. In Baxter & Woodman's letter to the city dated July 22, 1980, suggested recapture charges were set forth to accomodate developments to the north of the property in question. Motion by Pepping, seconded by Schooley, to go in Executive Session at 10:03 P.M. -for the purpose of discussing pending litigation. Voting Aye: Pepping, Harker, Datz, Wieser, Adams, Schooley, Meurer. Voting Nay: None. Absent: Nolan. Motion carried.
