The Regular Meeting of the McHenry City Council was called to order on Monday, August 6, 1984 at 8:00 P.M. by Mayor Stanek in city hall. At roll call the following Aldermen were present: Bolger, Busse, Datz, McClatchey, Nolan, Snell, Smith, Serritella. Absent: None. City staff in attendance:Supt. Halvensleben, Clerk Gilpin, Chief Pasenelli,, Attorney Narusis, Park Director Merkel. Motion by Serritella, seconded by Datz, to accept the minutes of the July 30, 1984 Regular Meeting as presented. Voting Aye: Bolger, Busse, Datz, McClatchey, Nolan, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. Mayor Stanek announced the appointment of Daniel J. Levit of 5007 Dartmoor Drive, McHenry, to the McHenry Public Library Board with his term to expire July 1, 1987. Motion by Busse, seconded by Datz, to confirm the Mayor's appointment of Daniel J. Levit to the McHenry Public Library Board. Voting Aye: Bolger, Busse, Datz, McClatchey, Nolan, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. Motion by Nolan, seconded by Bolger, to authorize the Mayor to send a resolution to the RTA Board requesting that they comply with their previous committment to preserve the right-of-way on the north branch of the Chicago Northwestern Railroad from Ringwood to the Wisconsin State Line. Voting Aye: Bolger, Busse, Datz, McClatchey, Nolan, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. Discussion was held on -installing watermains into Knox Park and Petersen Park. The Park Committee was instructed to study the matter and return to the Council with a recommendation. Mayor Stanek announced that Burt Miner, owner of Royal Terrace Nursing Home, had offered $4,000.00fora portion of Lot C owned by the City adjacent to Royal Terrace. Motion by Bolger, seconded by Nolan, to authorize the sale of the 100 x 100 foot lot owned by the City of McHenry adjacent to Royal Terrace Nursing Home to be sold to Burt Miner, owner of the nursing home. Voting Aye: Bolger, Busse, Datz, McClatchey, Nolan, Snell, Serritella. Voting Nay: Smith. Absent: None. Motion carried. Dennis Karaskiewicz of Lakeland Park addressed the Council to request permission to hold a jam session at the Pearl Street Park on Sunday, September 23, 1984 from 12 Noon to 8:00 P.M. to benefit the Muscular Dystrophy Association. He stated he would obtain Dram Shop Insurance for that day in order to be able to serve beer during the eight hour period. Motion by Bolger, seconded by Smith, to approve Dennis Karaskiewicz's request to reserve Sunday, September 23, 1984 at Pearl Street Park to hold a benefit concert from 12 Noon to,8:00 P.M. con- tingent upon details being worked out with the Chief of Police to afford extra police protection if needed. Parks-Auth, Picnics Requests Failed Motion Parks - Auth, picnics Monday, August 6, 1984 Page 2 Parks, Motion by Smith, seconded by Bolger, to reserve the Pearl Auth, picnics Street on Sunday, September 23, 1984 for a Muscular Dystrophy Benefit Concert. Voting Aye: Bolger, Busse, Datz, McClatchey, Nolan, Smith, Snell, Serritella., Voting Nay: None. Absent: None. Motion carried. Motion by Smith, seconded by Snell, to authorize and approve Sale of the sale of an old tank truck owned by the City of McHenry to Vernon Property Rouley for the sum of $150.00 with the stipulation that he also be responsible for hauling the truck away. Voting Aye: Bolger, Busse, Datz, McClatchey, Nolan, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. Motion by Snell, seconded by Bolger, to authorize and approve Public Wk. the purchase of a pickup truck from Mitchell Buick at at cost of Purchases $7,450.09 and to also authorize the purchase of a two way radio and an accessory tool box as recommended by the Purchasing Committee. Voting Aye: Bolger, Busse, Datz, Nolan, Smith, Snell, Serritella. Voting Nay: McClatchey. Absent: None. Motion carried. Alderman Snell, Chairman of the Purchasing Committee, reported that the City Clerk had submitted several) prices for purchase of a re- placement water fountain in her office. During the Purchasing Committee Meeting information was brought forth on a better price which could be obtained from another company. The purchase of a water cooler will be put off until the other company is checked out. Chairman Busse of the Finance Committee reported that the Finance Committee had met and has drawnup a proposed Levy Ordinance which will be presented for discussion at the next meeting. Alderman McClatchey, Chairman of the Police Committee, reported that a meeting had been held to discuss alarms on the Police Board and dialer alarms. They will present a proposed ordi- nance at a future meeting to regulate these dialer alarms. Discussion was held on paying Police Officers for overtime work. No definite action was taken. Supt. Halvensleben reported that the 1984 Summer Street Program would be advertised for bids on August 10, 1984 with bids to be opened August 20, 1984. Motion by Busse, seconded by Datz, to accept the low bid of Sidewalks Decker Construction Co. of McHenry, Illinois, in the amount of $82,693.95 & for construction of 1.2 miles of intermittent sidewalk construction and IDOT parkway restoration with payment to made from FAU Funds as recommended by IDOT. Voting Aye: Bolger, Busse, Datz, Nolan, Smith, Snell, McClatchey, Serritella. Voting Nay: None. Absent: None. Motion by Serritella, seconded by Datz, to authorize and approve RB refunding the retained personnel money contributed by Edward Nuemann in the amount of $4,631.36 is retained personnel money for an Industrial Revenue Bond as requested in December, 1980. Voting Aye: Bolger, Busse, Datz, McClatchey, Nolan, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. Monday, August 6, 1984 page 3 Motion by Busse, seconded by McClatchey, to authorize the Building Building & and Zoning Officer to inforce the Zoning Ordinance regarding violations at Zon. Misc., Wahl Appliance and to proceed with the necessary steps to regulate the Violations matter. Voting Aye: Bolger, Busse, Datz, McClatchey, Nolan, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. Mayor Stanek read a proclamation where in he proclaimed the week Proclamation of September 16 thru September 22 as Cystic Fibrosis Week and urged all citizens to support the Northern Illinois Chapter of the Cystic Fibrosis Foundation through contributions of time and money to help fight the disease. Motion by Nolan, seconded by Busse, to authorize the Park Director not to waive any fees as per special request but to maintain a consistent fee policy. Voting Aye: Bolger, Busse, Datz, McClatchey, Nolan, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. Chairman Bolger, of the Utilities Committee, reported that a committee meeting would be held shortly to discuss delinquent sewer accounts where no water was present. Attorney Narusis reported that the lawsuit against the City of McHenry filed by Peter Tutera had been dismissed by a Judge in the Federal Courts in Chicago.
