Mayor Stanek called to order the Public Hearing on Wednesday, August 6, 1980 at 7:30 P.M. on the recessed hearing regarding the proposed Annexation Agreement for Valleybrook Subdivision located at the southwest cornier of Bull Valley and Crystal Lake Roads. This Public Hearing was recessed from July 10, 1980. At roll call the following aldermen were present: Pepping, Nolan, Harker, Wieser, Datz, Adams, Schooley, Meurer. Also in attendance were: Attorney Narusis, City Clerk Gilpin, City Engineer Dr. Hal Sundin, Petitioners David Faestel and Ray Schmitt„ Petitioner's attorney Richard Zukowski, Plan Commission Member Lynne Donarski, Court Reporter Betty Rose Pigoni, Co -petitioner Charles Allen, Newspaper Reporters Tony Oliver, Ricki Hoffman and Steve Petersen and one unidentified man in the audience. Petitioner Faestel summarized what points had been agreed upon at previous hearings: 1. Developers would dedicate 100 foot ROW for bypass road within one year of the date of the Annexation Agreement or when the first plat: is executed, whichever comes first. 2. The bypass road would be a 36 foot road with 6 foot shoulders and full roadway construction so if the road was widened later the base would be there. 3. Developers would donate entire park land acreage to the city with no credits on developer donations. Park land to be deeded to the city within 5 years of the signing of the Annexation Agreement or upon -the date that a plat of subdivision is accepted that is contiguous to the park area, whichever is sooner. The developers request that they be notified as soon as the city determines how the park land will be developed so they can use the information in their marketing of the lots. 4. Developers agree to pay $50,000 in annexation fees with $12,500 being payable upon the execution of a final plat of subdivision for any portion of Tract A and $12,500 being payable on the annual anniversary dates thereafter. 5. Developers agree to dedicate roadway frontage on Bull Valley and Crystal Lake Roads to provide a 50 foot ROW from the centerline on their portion of the property with dedication to be made within one year of the date of the Annexation Agreement or when the first plat is executed, whichever Wednesday, August 6, 1980 Page 2 comes first. 6. Developers agree to conform to the Zoning Board and Plan Commission recommendations relating to berming and lot layout restrictions. 7. Developers agreed to do further testing on the z acre lots contiguous to the park land area whereby said testing would dictate the size and access - ability of those lots with the developer being fully aware that they may lose some lots in that area. 8. Developers would provide for a 5-foot easement over the high water level for a shoreline around the lake so open space would be provided completely circumventing the lake within the park land area. Points under discussion for this meeting were construction costs of the bridge and bypass road and the time frame for the construction. After lengthy discussion, the following points were agreed upon. 9. The developers would agree to pay $75,000 upon signing of the Annexa- tion Agreement with no strings attached. The city could do whatever it wanted with the money and there would be no obligation on the city's part as to when, where or if the bridge would ever have to be constructed. It was the Council's opinion that the money should be put in a separate fund and earmarked for bridge construction. 10. The developer would reimburse the city for any portion of the bypass road that the city built before the developers had it platted. Developers agreed to pay 8 percent interest on actual city costs of the road construction with 5 years interest free. Interest would begin to accummulate on the first day of the sixth year of the agreement. 11. City agrees to waive requirements on sidewalks, curbs and gutters on the R-1 and R-2 zoning districts. 12. There will be no freezes on any city ordinances or specifications. 13. If city water is available on the north side of Bull Valley road, the developer will bring the water mains across Bull Valley road for use in their subdivision. The option is totally with the developers to install water mains in their subdivision and if water mains are installed fire hydrants will also be required by the city. Dr. Sundin suggested that water mains be installed at the time the roads are built so they won't have to be cut later. Attorney Narusis suggested that in the case where the city decides to proceed with the bypass road and Wednesday, August 6, 1980 Page 3 the developers haven't platted, the developers would be given notice and their engineers would be requested to come up with plans within 90 days. The develop- ers said they would contact their engineers to see that it was a reasonable time request. It was the unanimous consensus/oopinion that the Council concurred with all the negotiation points as presented thus far. Motion by Adams, seconded by Wieser, to recess this hearing to September 17, 1980 at 7:30 P.M. for a Public Hearing and Special Meeting. Voting Aye: Pepping, Nolan, Harker, Wieser, Datz, Adams., Schooley, Meurer. Voting Nay: None. Absent: None. Motion carried. Meeting recessed at 9:24 P.M. City Clerk ✓ Mayor
