The Regular Meeting of the McHenry City Council was called to order by Mayor Stanek at 8 P.M. on Monday, August 4, 1980. At roll call the follow- ing aldermen were present: Pepping, Nolan, Harker, Datz, Wieser, Adams, Schooley, Meurer. Absent: None. Motion by Datz, seconded by Harker, to accept the minutes of the July 21, 1980 Regular meeting as read. Voting Aye: Pepping, Nolan, Harker, Datz, Wieser, Adams, Meurer. Schooley. Voting Nay: None. Absent: None. Motion carried. Motion by Wieser, seconded by Adams, to enter into a one year lease agreement with VFW ( Veterans of Foreign Wars) Post #4600 for use of the ball fields on their property at the cost of $1,500.00. Voting Aye: Nolan, Harker, Adams, Wieser, Meurer, Schooley, Datz. Voting Nay: Pepping. Absent: None. Motion carried. Motion by Harker, seconded by Nolan, to approve the Mayor's nomination of William Busse of 107 Augusta Drive, McHenry, to fill the unexpired term of Barbara Williams as a member of the McHenry Public Library Board, term to expire July 1, 1982. Voting Aye: Nolan, Harker, Adams, Wieser, Meurer, Schooley, Datz, Pepping. Voting Nay: None. Absent: None. Motion carried. Mayor Stanek called for a Special Meeting of the City Council on Thursday, August 7, 1980 at 7:30 P.M. for the purpose of discussing: 1. A grant application made by McHenry Shores for FAP (Facilities Area Planning) for a Regional Sewer Treatment Plant; 2. Flood Plain boundry regulations; 3. McHenry Lakes Estates deepening of the sewer line to Falcon Development; and 4. Any and all business which might come before the Council. Monday, August 4, 1980 Page 4 Motion by Nolan, seconded by Schooley, to return the bid bond of Curran Contracting Co. who was the unsuccessful bidder on the Green Street parking lot project. Voting Aye: Pepping, Nolan, Harker, Datz, Wieser, Adams, Schooley, Meurer. Voting Nay: None. Absent: None. Motion carried. Motion by Adams, seconded by Schooley, to ratify the action of the Park Committee and accept the low bid of Dura-Bilt Fence Co. of Volo in the amount of $3,172.35 for fencing the beach areain Petersen Park and also to authorize the addition of mesh and a top rail on 190 feet of the fencing. Voting Aye: Pepping, Nolan, Harker, Datz, Wieser, Adams, Schooley, Meurer. Voting Nay: None. Absent: None. Motion carried. Motion by Nolan, seconded by Datz, to authorize the purchase and installation of drapes for the Deputy Clerk's office from Havemeyer's of Volo for the low bid of $220.00 plus $31.40 for two rods. Voting Aye: Pepping, Nolan, Harker, Datz, Wieser, Adams, Schooley, Meurer. Voting Nay: None. Absent: None. Motion carried. Motion by Harker, seconded by Datz, to authorize the hiring of Krystal Klear Cleaning Service of McHenry for janitorial work in the city Clerk and Council Room portions of the municipal building. Motion by Wieser, seconded by Adams, to authorize the use of Freund Field and Petersen Park tennis courts by the McHenry Community High School tennis teams until their courts are reconstructed. Voting Aye: Pepping, Nolan, Harker, Datz, Wieser, Adams, Schooley, Meurer. Voting Nay: None. Absent: None. Motion carried. Monday, August 4, 1980 Page 5 Mayor Stanek declared a recess at 9:20 P.M. The meeting reconvened at 9:33 P.M. with everyone still in attendance. Motion by Nolan, seconded by Pepping, to pass an ordinance prohibiting the sale of drug paraphernalia in the City of McHenry and to publish the ordinance in pamphlet form. Voting Aye: Pepping, Nolan, Harker, Adams, Wieser, Meurer, Schooley, Datz. Voting Nay: None. Absent: None. Motion carried. Motion by Pepping, seconded by Harker, to amend the Wage & Benefit Ordinance relating to job reduction pay and overtime pay for salaried employees. Voting Aye: Pepping, Nolan, Harker, Adams, Wieser, Meurer, Schooley, Datz. Voting Nay: None. Absent: None. Motion carried. Motion by Schooley, seconded by Adams, to pass an Ordinance amending the Subdivision Control Ordinance relating to installation/Refceleration lanes and to publish the ordinance in pamphlet form. Voting Aye: Pepping, Nolan, Harker, Adams, Wieser, Meurer, Schooley, Datz. Voting Nay: None. Absent: None. Motion carried. Motion by Schooley, seconded by Pepping, to pass an Ordinance amending the Subdivision Control Ordinance relating to the prohibition of planting any trees in street right-of-ways and to publish the ordinance in pamphlet form. Voting Aye: Pepping, Nolan, Harker, Adams, Wieser, Schooley. Voting Nay: Datz, Meurer. Absent: None. Motion carried. Motion by Harker, seconded by Datz, to pass an Ordinance amending the Subdivision Control Ordinance relating to cable television and utility easements. Motion by Meurer, seconded by Schooley, to authorize the closing of Shore Drive from Rogers to Beach for a block party from 4 P.M. to midnight on August 24, 1980. Voting Aye: Pepping, Nolan, Harker, Adams, Wieser, Meurer, Schooley, Datz. Voting Nay: None. Absent: None. Motion carried. Motion by Nolan, seconded by Adams, to authorize the use of a city truck to haul sand to improve a beach in the West Shore Beach subdivision. Voting Aye: Pepping, Nolan, Harker, Adams, Wieser, Meurer, Schooley, Datz. Voting Nay: None. Absent: None. Motion carried. Mayor Stanek called for a Special Meeting and Public Hearing on Tuesday, August 26, 1980/for'de' purpose of discussing the parking meter moratorium and also any and all business which might come before the Council. Motion by Schooley, seconded by Meurer, to amending the Parking Ordinance relating to 15-minute loading zones, handicapped parking spaces and parking restriction removal as recommended by the Street and Sidewalk Committee. Voting Aye: Pepping, Nolan, Harker, Adams, Wieser, Meurer, Schooley, Datz. Voting Nay: None. Absent: None. Motion carried. It Alderman Wieser presented a request for additional bids on the reconstruction of sidewalks on the south side of Main Street. Mayor Stanek declared that construction of the sidewalks would be held in abeyance for seven days to allow the presentation of additional bids. Monday, August 4, 1980 Page 7 Alderman Pepping left the meeting at midnight. Motion by Harker, seconded by Wieser, not to change the Ordinance presently in effect regarding minimum rates for non-residential sewer users. Voting Aye: Harker, Wieser, Adams, Meurer. Voting Nay: Nolan, Datz, Schooley, Stanek Absent: Pepping. There being a tie vote, the Mayor declared the motion failed. Motion by Harker, seconded by Nolan, to pass an Ordinance amending the minimum rate for non-residential sewer users to $5.00 per month until such time as their metered water usage exceeds the minimum rate and then they would pay 75 cents per thousand gallons of metered water usage. Voting Aye: Harker, Nolan, Datz, Adams, Meurer. Voting Nay: Wieser, Schooley. Absent: Pepping. Motion carried. Motion by Adams, seconded by Wieser, to adjourn.
