MONDAY, AUGUST 3, 1987
A committee Meeting of the Whole was called to order by Mayor
Busse on Monday, August 3, 1987 at 8:05 p.m. in City Hall. The
following Aldermen were in attendance: Bolger, Lieder, Smith,
Teta. Absent: McClatchey, Nolan, Patterson, Serritella. City
staff in attendance were: Supt. Batt, Attorney Narusis, Adm.
Asst. Marth.
Mayor Busse announced that the purpose of the meeting was to
comply with the statutory requirement that the Ordinance providing
for a Local Improvement by Special Assessment, Project No. 31, be
referred to a committee for review and for a recommendation to be
made to the City Council.
The Mayor summarized the contents of the Ordinance as
authorizing and/or approving the following:
1. The construction of a sanitary sewer system for the
primary purpose of providing service to the McHenry
Shores and Idyl Dell Subdivisions.
2. The taking or acquisition of permanent sanitary sewer
and utility easements, along with temporary
constructions easements.
3. In connection with securing easements, the City
Attorney is authorized to institute proceedings for the
determination of the price to be paid for each
property, or damages to property not taken and for
acquisition of such property.
4. Approval of the Recommendation of the Board of Local
Improvements, including plans, specifications and
estimate of costs.
5. That the total cost of the local improvement project is
estimated to be $2,984,822, and shall be paid by
special assessment.
6. That each individual assessment shall be divided into
ten (10) equal installments with the first installment
due and payable on January 2, next after the date of
the first voucher issued on construction work done and
the second installment one year thereafter and so on
annually until all are paid. Any person may at any
time pay the whole assessment against any lot, piece or
parcel of Tand, or any installment thereof with
interest up to the date of the payment.
7. All installments shall bear interest until paid at a
rate not to exceed the greater of 9% annually or 70% of
the Prime Commercial Rate in effect at the time of the
passage of this Ordinance and shall run from the date
of the first voucher issued.
8. In anticipation of the collection of the installments
of the assessment, bonds shall be issued payable out of
the income of the combined sewer and water system of
the City, bearing interest at a rate not to exceed the
greater of 9% annually or 70% of the Prime Commercial
Rate in effect at the time of passage of this Ordinance.
9. The City Attorney shall file a petition in the Circuit
Court of the Nineteenth Judicial Circuit, McHenry
County, in the name of the City to ascertain what
property will be benefited, the amount of such benefit
and to levy a special assessment for the improvements,
in the manner prescribed by Taw.
Motion by Smith, seconded by Lieder, to recommend passage of
the Ordinance providing for a Local Improvement by Special
Assessment, Project No. 31, to the City Council.

Voting Nay: None
Absent: McCTatchey, Nolan, Patterson, Serritella.
Motion carried.
The following subjects on the special assessment were also
discussed:
- Public benefit portion;
- Assessment of houses straddling two lots, and a
house on one lot with a garage on an adjoining
lot;
- Duties of Commissioner of Special Assesment;
- Roads in Idyl Dell Subdivision;
- Resubdivision of smaller lots into one or more
lots;
- Timetable and procedures following passage of the
ordinance.
