The regular meeting of the City Council was called to order by Council Mayor Stanek on Monday, August 3, 1981 at 8 P.M. At roll call the following Mtg. aldermen were present: Nolan, Datz, Smith, Serritella, Meurer. Absent: Pepping, Harker, Wieser. Also present were: Attorney Narusis, Clerk Gilpin, Chief Attend- ance Pasenelli, Park Director Merkel. Motion by Nolan, seconded by Datz, to accept: the minutes of the July 20, 1981 Regular Meeting and of the July 23, 1981 Special Meeting as read. Voting Aye: Nolan, Datz, Smith, Serritella„ Meurer. Voting Nay: None. Absent: Pepping, Harker, Wieser. Motion carried. Monday, August 3, 1981 Page 2 It was the concensus of opinion that the Mayor should reply to Arnold Sewer �ontract May's offer of a contract for sludge disposal by stating that the City is not interested in his service at this time. Motion by Smith, seconded by Datz, to enter into an agreement with kgree- Kildan III, developers of Woodcreek Subdivision, whereby they would pay 10% nent interest, payable quarterly as of August 1, 1981, on the Developer Donations money due the City as of July 31, 1981 in the amount of $32,400.00. Voting Aye: Nolan, Datz, Smith, Serritella, Meurer. Voting Nay: None. Absent: Pepping, Harker, Wieser. Motion carried. 'Motion by Serritella, seconded by Nolan, to grant a one-year extension as of August 1, 1981, on the overlayment of roads in Woodcreek Subdivision with maintenance of the roads to be handled by the developers until final acceptance by the City. Voting Aye: Nolan, Datz, Smith, Serritella, Meurer. Voting Nay: None. Absent: Pepping, Harker, Wieser. Motion carried. Motion by Datz, seconded by Meurer, to grant a one-year extension on it the overlayment of roads in Martin Woods Subdivision with maintenance of the roads to be handled by the developers until final acceptance by the City. Voting Aye: Nolan, Datz, Smith, Serritella, Meurer. Voting Nay: None. Absent: Pepping, Harker, Wieser. Motion carried. Motion by Smith, seconded by Serritella, to enter into an agreement with developers of Martin Woods Subdivision whereby they would pay 10% interest, payable quarterly as of March 19, 1982, on Developer Donations due the city in the amount of $13,500.00. Voting Aye: Nolan, Datz, Smith, Serritella, Meurer. Voting Nay: None. Absent: Pepping., Harker, Wieser. Motion carried. Monday, August 3, 1981 Page 3 Motion by Smith, seconded by Serritella, to deny the request of Martin Woods' developers to grant a one-year extension on the payment of $20,000.00 due the city on October 2, 1981 for park development. Voting Aye: Nolan, Datz, Smith, Serritella, Meurer. Voting Nay: None. Absent: Pepping, Harker, Wieser. Motion carried. Motion by Datz, seconded by Serritella, to authorize the Mayor and Clerk to sign a Statement of Understanding between the Disaster Service of Red cross McHenry County Chapter, the American National Red Cross and the City of McHenry Agreement, as presented. Voting Aye: Nolan, Datz, Smith, Serritella, Meurer. Voting Nay: None. Absent: Pepping, Harker, Wieser. Motion carried. Motion by Nolan, seconded by Smith, to concur with the recommendation of the Zoning Board of Appeals and pass an ordinance granting the variations ZBA ; requested in the petition of Barbara and Randal Wagner of 3701 W. Absent: Pepping, Harker, Wieser. Motion carried. Motion by Meurer, seconded by Serritella, to accept the conditions set forth by Gluth Bros. Construction company for completion of the water and sewer lines in McHenry Lakes Estates and to authorize the release of funds Agree- in the Elgin Federal Savings & Loan to Mr. Gluth along with a letter stating ment the balance of funds in First National Bank of Woodstock will be released to Mr. Gluth upon final acceptance of the work by the City. Motion by Serritella, seconded by Datz, to publish in the newspaper Tax as required by State Law that the City of McHenry anticipates the tax levy Levy for the current year will be $900,000.00 or more than 105% of last year's levy. Voting Aye: Datz, Smith, Serritella, Meurer,Nolan. Voting Nay: None. Absent: Pepping, Harker, Wieser Motion carried. Mayor Stanek called for a recess at 10:32 P.M. The meeting reconvened at 10:43 P.M. with everyone still in attendance. Motion by Meurer, seconded by Serritella, to authorize and approve Park Authori- zation the use of Pearl Street Park on Friday, August 14, 1981 by the Chamber of Commerce for a western dance with beer and food. Voting Aye: Datz, Smith, Serritella, Meurer, Nolan. Voting Nay: None. Absent: Pepping, Harker, Wieser. Motion carried. Motion by Meurer, seconded by Serritella, to pass a Resolution Resolution authorizing the position of mayor to be eligible for participation in the Illinois Municipal Retirement Fund as of January 1, 1972. Voting Aye: Datz, Smith, Serritella, Meurer, Nolan. Voting Nay: None. Absent: Pepping, Harker, Wieser. Motion carried. The Public Property Committee was instructed to study the request Committee of McDeli's on Elm Street for outside tables on the sidewalk. Authoriza- tion A special committee was appointed by Mayor Stanek to study the possiblity of establishing a bicycle route in the City. On the committee are Serritella, who was appointed chairman, along with members being Appointment Nolan, Smith, and Meurer. Monday, August 3, 1981 Page 8 Motion by Nolan, seconded by Meurer, to go into Executive Session at Executive Session 11:19 P.M. for the purpose of discussing -pending litigation. Voting Aye: Datz, Smith, Serritella, Nolan. Meurer. Voting Nay: None. Absent: Pepping, Harker, Wieser. Motion carried. Motion by Nolan, seconded by Datz, to go back into Open Session at 11:35 P.M. Voting Aye: Datz, Smith, Serritella, Nolan, Meurer. Voting Nay: None. Absent: Pepping, Harker, Wieser. Motion carried.
