MONDAY, AUGUST 2, 1982 8 P.M.
The regular meeting of the McHenry City Council was called to
order by Mayor Stanek on Monday, August, 2, 19B2 at 8 P.M. At roll call,
the following aldermen were present: Meurer, Serritella, Smith, Wieser,
Datz, Harker, Nolan, Pepping. Absent: None. Also in attendance were
Supt. Halvensleben, ParkDirector Merkel, Clerk Gilpin, Chief Pasenelli.
Absent: Attorney Narusis.

Voting
by Serritella, Seconded by Datz, to accept the minutes
and the July 19, 1982 Regular meetings as presented.
Aye: Meurer, Serritella, Smi h, Wieser, Datz, Harker,
Nolan, Pepping.
Voting Nay: None.
Absent: None.
Motion carried.
Motion by Smith, seconded by Wieser,' to authorize the Public
Property Committee to look into acquisition of the Ralph Freund lot at
3902 Maple Avenue and report back with a recommendation at the next
meeting.
Voting Aye: Meurer, Serritella, Smith, Wieser, Datz, Harker,
Nolan, Pepping.
Voting Nay: None.
Absent: None.
Motion carried.
The Purchasing Committee was also authorized to look into the
purchase of a nurse truck and tractor for the ',Sewer Department and
report back at the next meeting.
Motion by Pepping, seconded by Harkdr, to comply with bonding
regulations and authorize Chapman and Cutler to render an opinion on
the Non -Referendum General Obligation (G.0) Bonds for use as public
benefit to participate in the extension of the water and sewer lines
to the McHenry Hospital site.
Voting Aye: Meurer, Serritella, Smith Datz, Harker, Nolan,
Pepping.
Voting Nay: Wieser.
Absent: None.
Motion carried.
Motion by Smith, seconded by Harker to authorize and approve
the issuance of picnic beer permits to the following: Johnsburg
Community Unit School District #12 on August �6th; M. Arnold on July
24th; Patrick Heald on August 28th; Americanh Legion Post 491 on
Sept. 4th; Kennebeck Family on Sept. 12th. (The American Legion will
serve beer and rhine wine.)
Voting Aye: Serritella, Smith, Dat?, Harker, Pepping, Wieser.
Voting Nay: Meurer, Nolan.

Motion by Wieser, seconded by Serritella, to change the closing
hours of taverns from 1 A.M. to 2 A.M. daily {except on, New Year's Eve
of each year when the closing hour would be 31A.M.

Voting Nay: Meurer, Nolan, Peppingl.

Motion by Wieser, seconded by Serritella, to eliminate the
$5.00 license fee for garage sale permits but retain the need for the
filing of applications and issuance of permit cards and receipts.

Motion by Smith, seconded by Serritella, to amend the original Garage Sale
motion and eliminate the requirement for issuance of garage sale permits Permits
altogether. Following discussion, Sprritella withdrew her second of the
amendment and Smith withdrew his amendment motion. Serritella then with-
drew her second of the original motion and Wieser withdrew his original
motion.
Mayor Stanek declared a 5-0inute recess at 9:52 P.M. The
meeting reconvened at 9:56 P.M. withi,everyone still in attendance.
Motion by Wieser, seconded by Pepping, to amend the Municipal Ordinance
Code and charge $10.00 for water shuft-off and turn -on fees at the Water turn
buffalo boxes. on fees

Motion by Wieser, seconded' by Harker, to amend the Municipal Ordinance
Code, Section 11-19 and change the annual fee for food dealer licenses City license
from $1.00 to $15.00. 1 fees

Motion by Wieser, seconded) by Nolan, to amend the Municipal Ordinance
Code, Section 11-39 and charge $15.00 annually for Restaurant Permit
Fees and eliminate the one-half year rate; and to charge Itinerant City License
Restaurants a fee of $50.00 which allows 5 days of operation with the fees
stipulation that if the itinerant restaurant has a City of McHenry
permanent address and is paying sales tax to the City, the fee will be
$15.00 annually.

Harker, Nolan.

Motion by Wieser, seconded by Pepping, to amend the Municipal Ordinances
Code, Section 11-51 to state that each milk vending, milk delivery truck City License
(retail) or person selling milk (retail) in the City shall pay an annual fee
license fee of $100 with the excepti'ion that those businesses or persons
selling milk in the city and paying ',sales tax to the city will be exempt
from paying the annual license fee Of $100.00

Harker, Nolan.

It was decided to authorize the city attorney to prepare a Authorization
definition for "Restaurant" as it should be applied to city licensing. City Licenses

Works and Park Departments to do nolwork on the Fox Ridge park
property until a recommendation is made by the Park Committee. Committees

Motion by Harker, seconded by Meurer,, to authorize the city to
contract with Lakeland Construction Company to,eliminate the drainage
problem and improve the area on the northwest scorner of Elm Street and
Meadow Lane at a price not to exceed $2,575.00.

Harker, Nolan.

Motion by Smith, seconded by Serritella to authorize the purchase
of two IBM Selectric III typewriters at a cost',of $828.00 each, one as
a replacement for the Clerk's office and the other as a new one for
the Public Works Department.

approve the city clerk's attendance at the 19$2 Municipal Clerks Institute
at the University of Illinois from October 25 thru 29.

Motion by Nolan, seconded by Harker, to authorize and approve the
use of Pearl Street Park by the Maranatha Assembly of God church for a
gospel music and preaching meeting on August 14, 1982.

Harker, Nolan.

Motion by Smith, seconded by Wieser, to set August 12, 1982
as the effective date for the newly adopted closing hours for city taverns
of 2 A.M. daily.

Motion by Wieser, seconded by Datz, to deny the request of the
Illinois Public Action Council for a solicitation permit in the city of
McHenry.

Motion by Pepping, seconded by Nolan, to authorize the installation Motions
of a four-way stop intersection at Dale and High Streets. Failed
Voting Aye: Meurer, Serritella, Nolan, Pepping.
Voting Nay: Smith, Wieser, Datz, Harker.
Absent: None.
There being a tie vote, Mayor Stanek cast a NAY vote and declared the
motion did not carry.
Motion did not carry.
Motion by Nolan, seconded by Serritella, to enter the following
statement into the records: "The McHenry City Council goes on record
supporting the customers of the Northern Illinois Utilities Company in
their desire to have improved, safe, potable water at all times without
interruption and an improved system. The McHenry City Council also goes
on record as strongly objection to the service presently being received
from the Northern Illinois Utilities Company."
