MONDAY , JULY 18, 1988
The regular meeting of the McHenry City Council was called to
order by Mayor Busse on Monday, July 18, 1988 at 8 P.M. in City Hall. At
roll call the following aldermen were present: Bolger, Nolan, Teta,
Lieder, Smith, Patterson, Serritella. McClatchey arrived at 8:15 P.M.
City Staff in attendance were Attorney Narusis, Clerk Gilpin, Police Chief
Joyce, Supt. Batt, Finance and Personnel Administrator Vitas, Director of
Development Greenwood. Absent: Park Director Merkel.
Mayor Busse called to order a Public Hearing for the purpose of
discussing the proposed Appropriation Ordinance for Fiscal Year
1988-1989. He asked if anyone in the audience had any written or oral
statements to present regarding the proposed Appropriation Ordinance.
There was no response. He asked the City Clerk if any written comments
had been presented to her office regarding the Appropriation Ordinance.
She said none had been received.
After reviewing the proposed 1988-1989 Appropriation Ordinance
with the City Council, Mayor Busse adjourned the Public Hearing at 8:10
P.M.
Motion by Bolger, seconded by Nolan, to pass the Appropriation
Ordinance for Fiscal Year 1988-1989 as presented, in the amount of
$19,096,400.00.
Voting Aye: Nolan, Bolger, Lieder, Teta, Smith,
Patterson, Serritella.
Voting Nay: None.
Absent: McClatchey

Motion by Smith, seconded by Nolan, to pass a Resolution
authorizing the City to participate in a Joint State of Illinois
Purchasing Program as presented

Motion carried
Harold Warren of Warren Associates addressed the Council
concerning the proposed User Charge System for sewer rates. Alderman
Lieder, chairman of the Finance Committee, also submitted his proposal for
a User Charge System. Following lengthy discussion, it was decided to put
the matter on the August 3, 1988, regular Council agenda for further
action.
Discussion was held on the McHenry Zoning Board of Appeals'
recommendations concerning proposed changes in the City of McHenry Zoning
Ordinance. Don Gerstad of Gerstad Builders spoke to the Council in
opposition to proposed changes in lot size for RS-3 and proposed Minimum
Front Yard Depth changes.
Motion by Serritella, seconded by Smith, to concur with the
recommendation of the Zoning Board of Appeals and leave the "Minimum Lot
Area per dwelling unit in square feet" for RS-3 Districts in the Zoning
Ordinance at 7500 square feet.
Voting Aye: BoIg�t, Smith, McClatchey, Serritella.
Voting Nay: Noo n, Teta, Lieder, Patterson.
Absent: None.
There being a tie vote, Mayor Busse cast a May vote and declared the
motion did not carry.
Motion by Patterson, seconded by Nolan, that Table 4, Residential
District Requirements in the Zoning Ordinance be amended by changing the
"Minimum Lot Area per dwelling unit in square feet" to 9000 square feet
for all units in the kS-3 District.
Voting Aye: Nolan, Teta, Lieder, Patterson.
Voting Nay; Bolger, Smith, McClatchey, Serritella.
Absent: None.
There being a tie vote, Mayor Busse cast an aye vote ani declared the
motion carried.
Motion by Smith, seconded by Serritella, to concur with the
Zoning Board of Appeals recommendation and 'leave the "Minimum Front Yard
Depth in feet" at 25 feet in the Zoning Ordinance for RS-2, RS-3, RA-1,
RM-1 and RM-2 Zoning Districts.
Voting Aye: Bolger, Smith, Serritella.
Voting Nay: Teta, Lieder, Patterson, McClatchey, Nolan.

Motion by Teta, seconded by Patterson, that Table 4, Residential
Zoning Ords. District Requirements in the Zoning Ordinance be amended by changing the
Ordinances "Minimum Front Yard Depth in feet" to 30 feet in RS-2, RS-3, RA-1, RM-1
and RM-2 Zoning Districts.

Motion by Teta, seconded by Patterson, to concur with the Zoninq
Board of Appeals recommendation and amend the Zoning Ordinance on Table 2,
page 41 , under Items a, b, c,. and d; and on Table 2, page 42, under Items
9, 10, and 13 amending them from "X" to "R" with regard to the Reauired
Contents of Application Filings for Map Amendment requests.

Motion by McClatchey, seconded by Teta, to concur with the Zoning
Board of Appeals recommendation and amend the Zoning Ordinance on Table 5,
Group A, Permitted Uses in Alil Residential Districts, amending it by
deleting "golf courses" as a permitted use; and Table 5, Group B,
Conditional Uses in All Residential Districts, amending it by deleting the
word "private" from the reference to golf courses and country clubs.
Voting Aye: Nolan, Bolger, Lieder, Teta, Smith,
McClatchey, Patterson, Serritella.
Voting Nay: None.
Absent: None.

Motion by Bolger, seconded by Nolan, that the Zoning Ordinance be
amended on Table 20, Standards for Accessory Structures amending it by
adding the following footnote (e) as an exception to the "Minimum Setback
from Principal or Other Accessory Building in feet"; "(e) except a shed
having a floor area of less that 100 square feet and a height of less than
10 feet."
Voting Aye: Nolan, Bolger, Lieder, Teta, Smith,
Patterson, Serritella.
Voting Nay: McClatchey.
Absent: None.

Motion by Bolger, seconded by Nolan, that Paragraph G of Article
XIV of the Zoning Ordinance shall read as follows: "G. Expansion or
Alteration, Any expansion, enlargement or structural alteration o a
tionaI Use shall require an additional Conditional Use Permit. In
all cases, the application for such additional Conditional Use Permit
shall be addressed to the City Council, which may grant such application
without arty hearing or action by the Zoning Board or may refer such
application to the Zoning Board for public hearing acid action thereon
pursuant to the requirements of this ordinance as in the case of an
appplication for Conditional Use Permit."

Richard Paneralli, former president of the Village of McHenry
Special
Shores, addressed the Council and expressed concerns of approximately 20
Assessment-
people in the audience from McHenry Shores. The three main concerns were:
McHenry
sewer lines being installed down the side of the streets instead of in the
Shores
center; pipe sizes changed from 6 inch to 4 inch; and a request to waive
the Capital Development and Hook -on Fees for the Special Assessment
project. Mayor Busse explained that several public hearings had been held
to answer these questions but: if the people wanted another public hearing,
he would schedule one. Since the agenda for this Council meeting was
already filled, there would not be time to discuss their concerns during
this meeting. He suggested that during the recess, all could discuss it
and arrange for a future date which would be acceptable to all.
Mayor Busse called for a recess at 10:12 P.M. The meeting
reconvened at 10:34 P.M. with everyone still in attendance except Alderman
Serritella who left the meeting at 10:31 P.M.

Discussion was then held on the ten city lots which were put out
to bid. The bids were opened at the July 13, 1988 Council Meeting. One
Hundred Thirteen bids were received. It was noted that of the ten
parcels, all but one had exceeded the suggested minimum bid. Also,
regarding a parcel off an alley on Maple Avenue near the cemetery, it was
decided the City should obtain a 15 foot dedicated utility easement along
the northern boundary of the lot before the final contract is signed.
Motion by Teta, seconded by McClatchey, to pass Ordinances
accepting the high bids on eight of the parcels put out to bid and to Ordinances
reject the bids on the Orchard Heights lot and the lot at 5002 Oakwood Drive and to acquire a 15 foot dedicated utility easement for the lot nearSale oCity
