JULY 22, 1992
The Regular Meeting of the McHenry City Council was called to order
by Mayor Busse on Wednesday, July 22, 1992 at 7:30 P.M. in the Council
Room of the Municipal Center. At roll call the following Aldermen were
present: Bolger, Donahue, Lieder, Locke, Adams, Smith, Patterson,
Serritella. Absent: None. City Staff in attendance: City Clerk
Gilpin, City Attorney Narusis, City Administrator Peterson, Director of
Public Works Batt, Director of Parks and Recreation Merkel, Director of
Building and Zoning Lobaito. Absent: Chief Joyce.
TEN MINUTE PUBLIC INPUT SESSION
During the Ten Minute Public Input Session, three people signed up to
speak: Joe Gausden on Annexation East of the River, Jim Higgins on
parkway lawn damage, and Jerry Benes on City planning.
Gausden, appearing as a representative of the McHenry Area Economic
Development Commission, addressed the Council and requested support for
contacting businesses east of the Fox River along State Route 120 for
annexation to the City. The Chamber of Commerce and the McHenry Area
Economic Development Commission felt it would be advantageous to the City
because of sales tax dollars that could be realized from those
businesses. He would solicit for unconditional annexation with no
promises of any kind, except there would be immediate police protection
from the City of McHenry.
Aldermen Lieder left the meeting at 7:40 P.M.
Motion by Bolger, seconded by Donahue, that the City support
Gausden's efforts to contact those businesses east of the Fox River along
both sides of Route 120 to promote unconditional annexation to the City
of McHenry.
Voting Aye: Bolger, Donahue, Locke,
Smith, Adams, Patterson, Serritella.
Voting Nay: None.
Absent: Lieder.
Motion carried.
Jerry Benes read from a letter sent to him by the Mayor explaining
when planning meetings would be held at the City Council Meetings for
interested citizens to attend. Benes asked that more information be
available to him on purchases of land and land developments that are
proposed to take place in the City.
Mr. Higgins did not speak during the Ten Minute Public Input Session,
but saved his comments for the time when the parkway lawn damage agenda
item came up for discussion before the Council.
INTRODUCE NEW EMPLOYEE
Building and Zoning Director John Lobaito introduced David Bartik,
who began work as a City Building Inspector on June 29, 1992. Lobaito
said Bartik had been in the construction field for many years, and has
been an asset to the Building and Zoning Department for the last month.
The Mayor and City Council welcomed Bartik to the City employment force
and wished him well during his tenure with the City.
CONSENT AGENDA
In addition to the ten items on the Consent Agenda, an additional
item for a block party request on Windhaven Court in Winding Creek for
Saturday, August 1, 1992 was added to the Consent Agenda.
Motion by Smith, seconded by Patterson, to approve the Consent
Agenda, as follows.

PARKWAY LAWN DAMAGE
Mr. Higgins and Mr. Calvin addressed the Council on June 22, 1992 and
asked for restoration of parkway damage at their residences because they
felt it was due to excessive salt being spread on the roadways and
falling onto their property. A soil analysis had been sent to Morton
Arboretum, and a letter from that company stated that no indication of
excessive salt was shown in the six samples that were taken from the
lawns of Mr. Calvin and Mr. Higgins.
Alderman Lieder returned to the meeting at 8:05 P.M.
Motion by Serritella, seconded by Smith, to deny the request of Mr.
Higgins and Mr. Calvin for repair to the two parkways in question, and
that the City should maintain the existing policy of not replacing grass
alleged to have been damaged by salt but only repair plow and mailbox
damage caused by snowplowing.

AWARD BID FOR DRILLING OF WELL #9
Three proposals were received for drilling of water supply well #9 on
July 14, 1992. The three bidders were Lane Western Company of Aurora,
$44,429.00; Wehling Well Works, Inc. of Beecher, $45,898.00; and Henry
Boysen Company of Libertyville, $48,993.00.
Motion by Smith, seconded by Donahue, to accept the low bid of Lane
Western Company of Aurora, in the amount of $44,429.00 for drilling of
Water Well #9, as presented.
Voting Aye: Bolger, Donahue, Lieder,
Smith, Adams, Patterson, Serritella.
Voting Nay: None.
Absent: Locke.
Motion carried.
FRONT STREET WATER MAIN ENGINEERING SERVICES AGREEMENT
On May 20. 1992 the City Council awarded a bid for the construction
of a 12" water main on Front Street to Yonke and Soper of Zion, in the
amount of $89,082.00. In connection with that project, Baxter & Woodman
submitted an engineering services agreement for it to provide general
construction, administration, and resident project representative
services during the construction phase of the Front Street water main at
a cost not to exceed $10,000. The City staff felt that installation of
the water main along Front Street was a relatively small project and the
staff could do the work, except for stake out. It was suggested that the
Director of Public Works, and the Superintendent of the Water Department
be involved with the inspection and payouts for this project, which would
save the City about $8,000.00.
Alderman Locke returned at 8:14 P.M. and left the meeting for the
evening at 8:15 P.M.
Motion by Patterson, seconded by Donahue, that the City not approve
the Engineering Services Contract with Baxter & Woodman for the Front
Street water main project, but that City staff be used to perform these
services with Baxter & Woodman being retained to stake out the water main
location.

MAYOR STATEMENTS AND REPORTS
The Mayor announced that discussion on the re -districting of the City
Ward Boundary lines would take place at the end of the next Council
meeting, which is July 29, 1992.
COMMITTEE REPORTS
Alderman Lieder, Chairman of the Finance Committee, reported on a
meeting held June 30, 1992. The first item discussed was an increase in
Liquor License fees.
Motion by Smith, seconded by Adams, to increase the liquor license
fees, effective April, 1993, as follows:
CLASS "A" BEER & LIQUOR - from $1000 to $1400;
CLASS "B" PACKAGED BEER & WINE - from $350 to $700;
CLASS "D" BEER & LIQUOR NON-PROFIT - to remain the same at $100;
CLASS "F" PACKAGED BEER & LIQUOR - from $950 to $1100;
CLASS "G" BEER & LIQUOR SERVICE BAR ONLY - from $600 to $700;
CLASS "H" BEER & WINE ONLY - from $500 to $700;
and that CLASS "G" and CLASS "H" remain as two separate licenses, and not
be combined.
Voting Aye: Donahue, Lieder,
Smith, Adams, Patterson, Serritella.
Voting Nay: Bolger.
Absent: Locke.

The Finance Committee also recommended that City license fees be
changed since many of the fees had not been increased for ten years.
According to State Statutes, coin operated machines must have a Public
Hearing before their increases can go into effect.
Motion by Serritella, seconded by Patterson, to approve the Finance
Committee's recommendation, to schedule a public hearing for increasing
coin operated machines and to increase the City license fees as follows:
RESTAURANT - from $15 to $30;
COIN MACHINES - from $25 to $50, with no pro -ration;
FOOD DEALER - from $15 to $30;
FOOD DELIVERY - from $25 to $50;
FOOD - MILK - from $45 to $0;
MILK DELIVERY TRUCK - from $100 to $200;
THEATER - from $40 to $80;
ROLLER RINK - from $40 to $50;
CARNIVAL - per day from $15 to $100;
SCAVENGER TRUCKS - from $100 per vehicle,
to include all trucks;
Voting Aye: Bolger, Lieder,
Smith, Patterson, Serritella.
Voting Nay: Donahue, Adams.
Absent: Locke.
Motion carried.
A recommendation by the Finance Committee to increase Building Permit
Fees from $.12 to $.16 per square foot, effective September 1, 1992, was
postponed until the Council can get information on building permit fees
for commercial, as well as residential building fees.
Concerning employee health insurance renewal, it was the Committee's
recommendation that the City Council give the Finance Committee
permission to begin preliminary work on next year's health insurance,
exploring all options that may be available. It was also suggested that
an employee representative from each department be appointed to work with
the Committee on this very sensitive and important issue.
Motion by Lieder, seconded by Serritella, to accept the
recommendation of the Finance Committee, and authorize the Committee to
begin preliminary work on employee health insurance, and to work with
employee representatives so everyone can be thoroughly informed prior to
renewal date.

Absent: Locke.
Motion carried.
The Finance Committee also discussed 1993-94 Budget Issues, and
reviewed the water/sewer rates. No action was taken on these two items.
Attorney Narusis was instructed to draft ordinances to incorporate
all of the fee increases as approved tonight.
COMMITTEE MEETING OF THE WHOLE
Mayor Busse reported on a Committee Meeting of the Whole held at 6:30
p.m. this evening, prior to the regular Council meeting.
The purpose of the meeting was to discuss the interim use of the Mass
Barn as a horse stabling operation.
Motion by Serritella, seconded by Adams, to allow continuation on an
interim basis of the horse stabling operation at the Mass Property, with
a sub -lease agreement to be presented to the Council for approval at the
next meeting, with the sub -lease to be no longer than June 30, 1993.

DEPARTMENT HEAD REPORTS
City Administrator Peterson reported that information from the County
Clerk's office regarding levy rates for 1991, payable as 1992 taxes was
received today. For the fifth consecutive year, the City's levy rate has
decreased. The decrease in levy rate amounts to 4%, from a rate of $.700
per $100 equalized assessed valuation to $.672 per $100 equalized
assessed valuation. The equalized assessed valuation in 1990 was
$193,865,832.00. In 1991, the EAV was $220,550,512.00. The lower actual
rates are due to a higher than expected equalized assessed valuation,
which is a result 'of new building activity, home improvements, and
reassessments.
In answer to a request for revision of the water sprinkling
restrictions to allow evening water sprinkling hours, it was decided not
to change the water restrictions at this time, since all residents are
now familiar with the permitted hours.
BOND PAYMENT
Motion by Patterson, seconded by Serritella, to authorize payment to
the McHenry State Bank for interest on the McHenry General Obligation
Bond Series 1982 in the amount of $1,862.50, and for interest on the
Special Service General Obligation Bonds of 9-1-82, in the amount of
$11,245.00.

NEW BUSINESS
The staff was authorized to set up another meeting with Country Club
Estates Subdivision to determine the interest in sewer installation on
Fairway, Ronda, and Skyway Drives.
Aldermen expressed thanks to the Public Works, Police, and Park
Departments for their assistance in making the 1992 Fiesta Day
celebration a success.
Alderman Smith, Chairman of the Building, Zoning, Planning, &
Development Committee, scheduled a meeting for July 27, 1992 at 7:00 P.M
to discuss pending issues in the Building and Zoning Department.
