WEDNESDAY, JULY 19, 1989 8:00 P.M.
The Regular Meeting of the McHenry City Council was called to
order by Mayor Busse on Wednesday, July 19, 1989 at 8 P.M. at City Hall.
At roll call the following Aldermen were present: Bolger, Donahue,
Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Absent: None.
City staff in attendance were Director of Public Works Batt, Attorney
Narusis, Clerk Gilpin, Park Director Merkel, Chief Joyce, Finance and
Personnel Administ^ator Vitas, Director of Development Greenwood.
Under public statements and comments, Lon Smith of 1614 N.
Riverside Drive and an Attorney for the McHenry Preservationalists,
Robert Gordon of 180 N. LaSalle Street, spoke in oposition to putting
$10,000,000 in the Appropriation Ordinance for potential annexation east
of the Fox River and in opposition to the Fox Bay TIf Project. Gordon
presented petitions with 251 names on them who were opposed to the Fox
Bay Development proposal and any possible annexations of land east of the
Fox River. They requested that the City Council strike and delete any
references in the Appropriation Ordinance which referred to
infrastructure development and/or improvements and/or annexation of the
area known as Fox Bay. The petitions were handed over to the City Clerk
for filing with the City records.
Attorney Dan Curran, representing the McHenry Corporate Center,
addressed the Council concerning annexation, zoning and final plat
approval of the 279 acre parcel on South Route 31 which was seeking
annexation to the City. Several language changes were made in the
Annexation Agreement and the Guidelines for Business Park zoning were
amended.
Motion by McClatchey, seconded by Patterson, to pass an
ordinance providing for approval of an Annexation Agreement between the
City of McHenry, Illinois and Cosmopolitan National Bank of Chicago,
under the provisions of Trust Agreement No. 28571, Midwest Properties
Ltd. Partnership, Midwest Construction Inc., Prime Development
Corporation and McHenry Corporate Center subject to the language changes
and inserts as discussed at this meeting.
Voting Aye: Bolger, Donahue, Lieder, Teta, Smith,
McClatchey, Patterson, Serritella, Busse.

Motion carried.
Motion by Bolger, seconded by Serritella, to pass an ordinance
providing for the annexation of certain described real estate to the
existing corporate limits of the City of McHenry, Ill nois, and amending
the zoning ordinance of the City of McHenry to zone the real estate
annexed, commonly known as the McHenry Corporate Center property, as
presented.
Voting Aye: Bolger, Donahue, Lieder, Teta, Smith,
McClatchey, Patterson, Serritella.
Voting Nay: None.
Absent: None.
Motion carried.
Motion by Serritella, seconded by Bolger; to apPro:e the final
plat of subdivision for McHenry Corporate Center subject to making the
changes and additional items as discussed with respect to Exihibit B
which is the recommended guidelines for a proposed business park
ordinance for development of the Corporate Center.
Voting Aye: Bolger, Donahue, Lieder, Teta, Smith,
McClatchey, Patterson, Serritella, Busse.
Voting Nay: None.
Absent: None.
Motion carried.
Narusis explained that it was understood that the final plat for
the McHenry Corporate Center will not be recorded until a Letter of
Credit is presented and all easements are on file, although a letter
saying that the McHenry Corporate Center Final Plat of Subdivision for
Unit 1 had been approved conditionally will be issued to the developers
upon their request.
David Backhaus and his Attorney John Cowlin addressed the
Council to request a 90-day extension of an Annexation Agreement dated
July 16, 1979 for the 385 acre annexation of the Backhaus/Brackmann
Property known as the Winding Creek Development. David Backhaus wished
to develop the remaining property and therefore requested an extension so
as to work with the City on negotiations to complete that project.

Motion by Lieder, seconded by Donahue, to grant a 90-day
extension of the original Annexation Agreement for Backhaus/Brackmann so
that negotiations can be held between the City and Backhaus on future
development of this subdivision with the 90-day extension to begin from
July 16 to October 14, 1989.
Voting Aye: Bolger, Donahue, Lieder, Teta, Smith,
McClatchey, Patterson, Serritella.

Absent: None.
Motion carried.
Motion by Lieder, seconded by Donahue, to pass an ordinance
making the annual appropriation for fiscal year 1989-1990 as amended in
the amount of $28,812,500.
Voting Aye: Bolger, Donahue, Lieder, Teta, Smith,
McClatchey, Patterson, Serritella.
Voting Nay: None.
Absent: None.
Motion carried.
Motion by Patterson, seconded by Serritella, to pass Resolutions
honoring the following McHenry City Band Members: James Freund for 46
years of service; Robert L. Freund for 43 years of service; John
Cummings for 30 years of service and John Leighty for 26 years of service.
Voting Aye: Bolger, Donahue, Lieder, Teta, Smith,
McClatchey, Patterson, Serritella.
Voting Nay: None.
Absent: None.
Motion carried.
Motion by Smith, seconded by Patterson, to waive the permit and
Capital Development Fees for Riverwood and Parkland Schools for water
connections and to charge the School District the actual cost for the
meters and any direct installation costs and to approve the installation
of lower cost meters for the schools as recommended by Director of
Public Works Batt.
Voting Aye: Bolger, Donahue, Lieder, Teta, Smith,
McClatchey, Patterson, Serritella.

Absent: None.

approve payment of the following bills as presented with the exception of

approve payment of the following bills: George W. Kennedy Construction
Company $80,005.21 for the McHenry Shore Special Assessment Project;
Waste Management of McHenry County $14,559.38 for the Annual Spring
Cleanup Program; McHenry State Bank interest for the City of McHenry
General Obligation Bonds Series 1982 in the amount of $6,062.50; McHenry
State Bank interest for the City of McHenry Special Service General
Obligation Bond of 1982 interest in the amount of $23,845.00.

Alderman Teta, Chairman of the Building and Zoning Committee,
announced that a meeting would be scheduled for August 16, 1989 at 7:30
P.M. to discuss adding minor variations on the zoning checklist, change
the code for consistency on new driveway specifications, develop an
elevator ordinance and consider site and landscape plans as recommended
by Greenwood.
Alderman Lieder, Chairman of the Finance Committee, announced
that a meeting would be held August 7, 1989 at 7:30 P.M. to discuss
Fines for False Alarms, review employee benefits and encourage commercial
and industrial development.
Alderman McClatchey, Chairman of the Personnel Committee,
announced that a meeting was scheduled for August 2, 1989 at 7:30 P.M. to
discuss a position for the Development Department.
Alderman Smith, Chairman of the Street and Sidewalk Committee,
reported that they had met but arrived at no decision. The Committee is
waiting for more information frnm Batt and Greenwood regarding street
rjidth and sidewalk recommendations.
Mayor Busse announced that the final plat for the Oaks of
McHenry which was scheduled for tonight's meeting was continued to a
later date until all easement documents have been signed.
Motion by Patterson, seconded by Donahue, to extend the lease
for the Park Department quarters at 1219 N. Green Street on a month to
month basis beginning August 1, 1989 at the rate of $472.50 per month.

Motion by Lieder, seconded by Teta, to approve the Mayor's
hiring of Rhonda Lang -Rushing of 3709 W. John Street for a Senior Clerk's
position in the Finance and Personnel Department at a Grade 5 Step 112
salary ($17,823) effective July 24, 1989.

McClatchey, Patterson, Serritella.

Motion by Lieder, seconded by Smith, to approve the transfer of
Christine Newman from the Public Works Department to the Development
Department effective July 24, 1989 with the Development Department to
provide reception for the Public Works Department.
