Mayor Stanek called to order the Regular Meeting of the McHenry City Council on Monday, July 18, 1983 at 8:00 P.M. in city hall. At roll call the following aldermen were present: Bolger, Datz, McClatchey, Smith, Snell, Serritella. Absent: Nolan, Busse. City Staff in attendance Supt. Halvensleben, City Attorney Narusis, Clerk Gilpin, Chief Pasenelli, Park Director Merkel. Motion by Serritella, seconded by Datz, to approve the minutes of the July 6, 1983 Regular Meeting as presented. Voting Aye: Bolger, Datz, McClatchey, Smith, Snell, Serritella. Voting Nay: None. Absent: Busse, Nolan. Motion carried. Mayor Stanek presented checks to Supt. Richard Farmer as the Developer Donation money collected by the city for the school districts. A check for $12,200.00 was presented to elementary School District 15 and the same amount to High School District 156. Supt. Farmer accepted the checks on behalf of the schools and mentioned that each district had received to date $111,000.00 for the Developer Donation Funds of the City. On behalf of the school board and the children of the district he thanked the City Council for these monies. A check for $7,350.00 will be mailed to the McHenry Public Library as their share of the Developer Donations collected by the City. To date a total of $68,820.00 has been donated to the McHenry Public Library through Developer Donation contributions. Motion by Bolger, seconded by McClatchey, to authorize and approve entering into an intergovernmental agreement with elementary School District 15 and that. the Mayor and Clerk be authorized to sign said agreement. Voting Aye: Bolger, Datz, McClatchey, Smith, Snell, Serritella. Voting Nay: None. Absent: Busse, Nolan. Motion carried. Motion by Smith, seconded by Serritella, that the City Council act as the recreation committee in negotiating with a committee from the elementary School District 15 as relates to the intergovernmental agreement. Voting Aye: Bolger, Datz, McClatchey, Smith, Snell, Serritella. Voting Nay: None. Absent: Busse, Nolan. Motion carried. Robert L. Freund, former director of the McHenry city band and a present member of the city band addressed the Council regarding the letter sent by the Music Performance Trust Fund in connection with summer band concerts in the city park. Roman Koney, administrator of the Elgin Federa- tion of Musicians, was also in attendance. Freund outlined the background of the city band concerts and how the concerts were turned over to the Elgin Federation of Musicians local and how all the paper work had been turned over to that local instead of using city personnel and payroll. No action was taken. Motion by Smith, seconded by Snell, to authorize and approve the payment of up to $240.00 for hiring of the Fireball 8 Dixieland band to play during sidewalk sales on Saturday during Fiesta Days week. Voting Aye: Bolger, Datz, McClatchey, Smith, Snell, Serritella. Voting Nay: None. Absent: Busse, Nolan. Motion carried. Charles Hollenbach of 4304 W. South Street addressed the board and requested "No Parking Signs" be placed in front of his residence. Motion by Bolger, seconded by Serritella, to refer his request to the Street and Sidewalk Committee who should report back at the next meeting with a recommendation. Voting Aye: Bolger, Datz, Smith, Snell, Serritella. Voting Nay: McClatchey. Absent: Busse, Nolan. Motion carried. Elm Street, McHenry Revenue addressed the board to request the city's support of Industrial Revenue Bonds Bonds in the amount of $750,000.00 for expansion of his business in Tonyan Industrial Park. Motion by Bolger, seconded by Smith, to enter into a memorandum of intent to issue Industrial Revenue Bonds in the amount of $750,000.00 to John Miesen of Alpha Plastics. Voting Aye: Bolger, Datz, McClatchey, Smith, Snell, Serritella. Voting Nay: None. Absent: Busse, Nolan. Motion carried. Resolutions Motion by McClatchey, seconded by Datz, to pass a resolution Public Works regarding the policy on brush pickup in the City of McHenry. Misc. Voting Aye: Bolger, Datz, McClatchey, Smith, Snell, Serritella. Voting Nay: None. Absent: Busse, Nolan. Motion carried. Building Donald Gerstad, President of Residential Development Group, Permit appeared before the Council and submitted a letter regarding building and Requests occupancy permits for Winding Creek Unit #2. Motion by Bolger, seconded by Smith, that the Council waive the Building Subdivision Control requirement and continue issuing building permits in Permit Winding Creek Unit #2 on the condition that no occupancy permits will be Requests issued until all the subdivision improvements are installed with the exception of the installation of sidewalks which must be installed within one year after the first building permit was issued in Winding Creek Unit #2 which was May 16, 1983 and under the condition that a notice be placed on the building permits and recorded in the Recorders office stating that no occupancy permits will be issued until all of the final subdivision improvements have been installed. Voting Aye: Bolger, Datz, McClatchey, Smith, Snell, Serritella. Voting Nay: None. Absent: Busse, Nolan. Motion carried. Water Motion by Smith, seconded by McClatchey, to authorize and approve Line final payment of the Riverside/Venice Avenue Watermain Extension to Repairs & Northeastern Contracting Company in the amount of $966.09. Extensions Voting Aye: Bolger, Datz, McClatchey, Smith, Snell, Serritella. Voting Nay: None. Absent: Busse, Nolan. Motion carried. Motor Fuel Motion by Bolger, seconded by Datz, to pass a resolution allocat- Tax ing $27,000.00 of MFT Funds for use as the local share in the community Street Maint. development block grant awarded to the City for expansion and improvement & Repairs of the lift station and Green Street sewer line with said monies -to be used for resurfacing Green Street. Voting Aye: Bolger, Datz, McClatchey, Smith, Serritella. Voting Nay: Snell. Absent: Busse, Nolan. Motion carried. Mayor Stanek called for a recess at 10:05 P.M. The meeting reconvened at 10:19 P.M. with everyone still in attendance. Motion by Bolger, seconded by Datz, to annex the following Annexations islands of land in Ward 1: The Stilling -Adams property on the east side of Route 31 north of the Knox Park entrance and St. Paul's Avenue from Green Street west.
