WEDNESDAY, JULY 16, 1986 8:00 P.M.
The Regular Meeting of the McHenry City Council was called to
order by Mayor Busse on Wednesday, July 16, 1986 at 8 P.M. at City Hall. Council
At roll call the following Aldermen were present: Bolger, Lieder,
McClatchey, Nolan, Smith, Snell, Serritella, Teta. Absent: None. City Mtg.-
staff in attendance were Supt. Batt, Attorney Narusis, Clerk Gilpin, Park Attendance
Director Merkel, Chief Joyce.
Mayor Busse called to order a Public Hearing on the proposed
Appropriation Ordinance for fiscal year beginning May 1, 1986 and ending
April 30, 1987. People in attendance at this meeting were Don Gantt, Public
Harold Warren, Ken Farman, Leslie Farman, Allen Kopp, Mark Petersen and Hearing
Tony Oliver. Mayor Busse asked if anyone in the audience wished to make Appropri-
any oral or written statements concerning the proposed Appropriation ation
Ordinance. There was no response from the audience. He asked the City Hearing
Clerk if she had received any written comments to be presented at this
hearing. She replied that none had been received at her office.
Motion by Nolan, seconded by McClatchey, to pass the ordinance
making the annual appropriation for the fiscal year 1986-87 in the amount
of $14,227,200.

Motion by Snell, seconded by Teta, to adjourn the Public Hearing
at 8:06 P.M.

Motion by Smith, seconded by Nolan, to accept the minutes of the
June 18, 1986 and the July 2, 1986 Regular Meetings as presented.

Discussion was held concerning a recommendation from the McHenry
County Economic Development Committee regarding the adoption of a uniform
policy in support of future requests from Industrial Firms for property
tax abatement. The McHenry County Board has adopted a policy which
states that abatements are to be granted for a period of two years to
firms that meet statutory requirements set by State of Illinois, provided
that the tax due the McHenry County General Fund exceeds $250 per year.
Motion by Bolger, seconded by Teta, to instruct the City
Attorney to draft a tax abatement policy similar to the one adopted by Tax
the McHenry County Board which would be presented to the City Council for Abatement
approval at a later date.

Motion by Smith, seconded by Nolan, to grant the fence variation
request of Ken Farman at 3501 Vine Street as presented. Variations

Discussion arose concerning changing the name of portions of Street
Barreville Road located between Knox Park and McHenry Shores from Name
Barreville Road to Green Street within the City gf Mcenry. Attorney Change
Narusis was instructed to contact Nunda Township Supervisor Anita
Sherwood concerning this matter.

Motion by Smith, seconded by McClatchey, to grant the request of
Street Elf Company Developers for installation of street signs in the South
Signs Green Development in McHenry Shores as presented.

Motion carried.
Motion by Lieder, seconded by Teta, to authorize and approve
Chicago & Partial Payment Estimate No. 2 for work completed in connection with the
Northwestern Commuter Parking Lot grant improvements in the amount $63,350 to
Transp. Co. Zimmerman Construction Company as recommended by Baxter & Woodman.

Smith, Snell, Serritella, Teta.

Sewer Line Motion by McClatchey, seconded by Nolan, to authorize and
Repairs approve Payment Request No. 1 to William Zeigler and Son Inc. in the
& Extensions amount of $216,652 for the Riverside Drive sanitary sewer replacement
work as recommended by Baxter & Woodman.
Voting Aye: Bolger, Lieder, McClatchey, Nolan,
Smith, Snell, Serritella, Teta.
Voting Nay: None.
Absent: None.
Motion carried.
Herald Warren of Warren Associates addressed the Council and
presented a proposal for financing construction of the Southeast Sewer
Treatment Plant.
Motion by Nolan, seconded by Bolger, to instruct the City
Attorney to draft a resolution authorizing the issuance of $5,500,000 in
Resolutions Sewer Water Revenue Bonds for construction of a Southeast Sewer Treatment
Bonds Plant facility and other sewer improvements.
Voting Aye: Bolger, Lieder, McClatchey, Nolan,
Smith, Snell, Serritella, Teta.
Voting Nay: None.
Absent: None.

Motion by Smith, seconded by Serritella, to accept the June
Treasurer's Report as presented.

to enter into an agreement with Illinois Department of Transportation
and K-Mart developers for roadway improvements in the vicinity of the IDOT
proposed K-Mart/Dominics commercial development center.

Attorney Narusis reported that the law suit filed seven years
ago by Shamrock Farms against RDG and the City was up for settlement. A Lawsuits
revised consent decree had been handed down and he would recommend that
the City authorize him to accept the revised consent decree as presented.
Motion by Lieder, seconded by Bolger, to authorize the City
Attorney to enter into a revised consent decree as presented regarding
the Shamrock versus the Residential Development Group and City of McHenry
lawsuit.

The City Clerk suggested that the City adopt a policy that
$1,000 shall be paid in retained personnel fees for anyone requesting
planning, review, evaluation, advice, approval or acceptance of any
matters which would incur charges to the City for retained personnel
work. At the time the balance of the $1,000 reaches 1/4 of the original
amount deposited ($250), the City Council could demand from the
subdivider a sum of money that, in addition to the balance in said
specified account, should equal the amount originally demanded and
required by the City Council.
