Mayor Stanek called to order the Public Hearing on the matter of Coun. Mtgs.
the proposed enlargement of the City of McHenry Special Service Area No. 1 Spec. Pub
on Monday, July 16, 1984 at 8:04 P.M. in city hall. At roll call the follow- Hearing &
ing Aldermen were present: Bolger, Busse, McClatchey, Nolan, Smith, Snell, Special
Serritella. Absent: Datz. City staff in attendance were Supt. Halvensleben, p
Attorney Narusis, Clerk Gilpin, Chief Pasenelli, Park Director Merkel. Members Service
Area
of the audience were Attorney Jeff Ladd, representing Northern Illinois Medical
Center; John Bobbe of Pioneer Center; Michael Wieser; Richard Svihlik, Assis-
tant Director of McHenry City ESDA; Greg Ignarski of Clark Outdoor Spraying.
The purpose of the Public Hearing was to consider enlargement of
the boundaries of the City of McHenry Special Service Area No. 1 which was
established by Ordinance No. 0-82-288. A certificate of publication was on
file in the City Clerk's Office verifying that the public notice had been
published in the McHenry Plaindealer on June 29, 1984. Written and oral
comments were to be presented at this hearing. Mayor Stanek asked the City
Clerk if any written comments had been filed in her office. She replied
that no written comments had been received in her office. Mayor Stanek
asked if anyone in the audience wished to present oral or written state-
ments on the matter. The only one to respond was Attorney Jeff Ladd,
representing Northern Illinois Medical Center. He explained that in the
process of building the new professional medical arts building,it became
necessary to trade off an equal amount of land from NIMED to the Northern
Illinois Medical Center so as to create a large enough parking area. Both
NIMED and NIMEC will still end up with the same exact amount of land in-
volved in the special service area. Under State Statutes Chapter 120,
Section 1301,it is required that a Public Hearing be held for enlargement
of the special service area district. The only property involved is owned
and surrounded by hospital property. Ladd said since there is some ambiquity
in the State Statutes because it did not anticipate this sort of particular
problem (it does anticipate enlargement or disconnection, but not a trade)
NIMED will be providing the City with a hold harmless agreement so there is
no question about the City's position on this matter. NIMED will also put
in a severability clause so that if for any reason that property is not held
tax exempt,the ordinance pertaining to the transfer would be nulle and void.
Attorney Narusis reported that he had reviewed the proposed ordi-
nance amending the boundaries of the special service area as presented by
NIMED and everything was in order.
Motion by McClatchey, seconded by Nolan, to passan ordinance
amending the boundaries of the City of McHenry Special Service Area No.
as presented and also authorize NIMED to provide the City with a hold
harmless agreement.
Voting Aye: Bolger, Busse, McClatchey, Nolan, Smith, Snell,
Serritella.
Voting Nay: None.
Absent: Datz.
Motion carried.
Motion by Snell, seconded by Busse, to adjourn the Public Hearing
at 8:10 P.M.
