A Special Annexation Meeting of the McHenry City Council was called
to order by Mayor Busse on Monday, July 15, 1991 at 8:00 P.M. in City
Hall. At roll call the following Aldermen were present: Bolger, Lieder,
Donahue, Smith, Adams, Patterson, Serritella. Absent: Locke. City
Staff in attendance were: City Clerk Gilpin, City Administrator
Peterson, and Director of Building and Zoning Halik. Also in attendance
was Court Reporter Cheryl Barone.
Mayor Busse announced that the purpose of the meeting was to discuss
the terms and conditions of an annexation agreement between the City of
McHenry and petitioners Hoffstetter Properties, McHenry State Bank as
Trustee of Trust #4213 (Jepsen), McHenry State Bank as Trustee of Trust
#4432 (Wirfs), and Church of the Holy Apostles.
In attendance at the hearing for the petitioners were John
Hoffstetter, partner/owner; Father Sherry, Pastor of Holy Apostles
Catholic Church; Attorney Daniel Curran and Jim Condon of Smith
Engineering.
Attorney Curran reported that the Church of the Holy Apostles wishes
to construct a church on approximately 18.85 acres of land located on the
south side of Bull Valley Road, approximately 200 feet east of its
intersection with Crystal Lake Road. Initially, a building which would
temporarily act as the Church would be constructed on the site and later
used as a multi-purpose/social building. Plans call for the construction
of three buildings on the site, including a church/rectory,
multi-purpose/social building, and a school. A preliminary site plan was
presented for review.
Two ordinances presented for consideration were: (1) approval of an
annexation agreement, and (2) annexing and zoning the property "E" Estate
District with a conditional use permit for a church, rectory, school,
attendent services and administration offices, and granting a variation
from one principle building per lot.
Father Sherry reported that a 30,000 square foot building is
initially planned, with an entrance in the middle of the building on the
east side. To the right would be a large worship area, and to the left,
a large area for multi -purpose' use and office space. He said the
Rockford Diocese requires that 50% of the money for the project be in the
bank before construction can be started. The total cost of the initial
project would be $1.5 million which would include the purchase of the
land, construction of the building, and construction of a parking lot.
The construction timetable is to start in March of 1992 with occupancy
planned for the Fall of 1992.
Lengthy discussion took place on the availability and methods of
getting water and sewer facilities to the property. Following
discussion, the following six amendments were made to the annexation
agreement:
(1) If water and sewer lines are not available to the property
by March of 1992, the petitioners will be allowed to
utilize their septic and well systems for 36 months after
the sewer and water lines are available to the property.
(2) The petitioners will grant sewer and water easement rights
across their property to allow the installation of sewer and
water facilities. If in fact the water line is not
extended to the petitioners' west property line by other
developers, the City would commit its Capitol Development
fees to install the water lines to the petitioners' west
property line, or, in the alternative, the City would allow
the petitioner to install its own water system.
(3) The petitioners would be allowed to extend the water line
from its west property to serve their building. They
would, however, be obligated to extend the water line to
their east property line when notified by the City that it
is required. If, however, the City decided to extend the
water line to the hospital property, the petitioners would
be obligated to pay recapture fees with interest for the
extension of that water line from the middle of their
property to their east property line.

(4) That the complete site plan as presented, which would

Motion by Bolger, seconded by Lieder, to pass an ordinance providing
for approval of an annexation agreement between the City of McHenry and
Petitioners regarding the subject property proposed for the Church of the
Holy Apostles on Bull Valley Road, subject to review by the City Attorney
and to authorize the Mayor and City Clerk to execute said agreement when
approved by the City Attorney.

Motion carried.
Motion by Smith, seconded by Serritella, to pass an ordinance
providing for the annexation of the proposed Church of the Holy Apostles
property, and also amending the Zoning Ordinance of the City of McHenry
classifying the property as "E" Estate District with a conditional use
permit to allow the construction and operation of a church/rectory,
school, attendent services, and administrative offices on the subject
property, and granting a variation of the one principle building per lot
zoning regulation, subject to review by the City Attorney.
