The Regular Meeting of the McHenry City Council was called to order by Mayor Busse on Wednesday, July 15, 1987 at 8 P.M. at City Hall. Council Mtg. At roll call the following Aldermen were present: Bolger, Lieder, Attendance McClatchey, Nolan, Patterson, Smith, Serritella, Teta. Absent: None. City staff in attendance were Supt. Batt, Attorney Narusis, Clerk Gilpin; Park Director Merkel arrived at 9:30 P.M. Absent: Chief Joyce. Dave Hansen presented eight historic pictures which depicted the song "America the Beautiful" to the City of McHenry for display in the Donations Council Room. Mayor Busse accepted these pictures on behalf of the citizens of McHenry and expressed appreciation to Mr. Hansen for his donation. At 8:20 P.M. Mayor Busse reconvened the recessed Public Hearing of the Board of Local Improvements which was originally held on Wednesday, July 8, 1987 at the McHenry East Campus teaching theatre. At roll call the following members were present: Bolger, Nolan, Teta, Lieder, McClatchey, Smith, Patterson, Serritella. Absent: None. On the agenda at that July 8, 1987 were: 1) Presentation of the esitmate of cost by Dr. Hal Sundin 2) Public comments by the people in attendance 3) Deliberation by the Board of Local Improvements The first two matters on the agenda were handled at the Public Hearing and then it was recessed to this date for deliberations. The required action is that the Board of Local Improvements pass a resolution recommending to the City Council that it either adhere to the project as presented, abandon it or modify it. Motion by Lieder, seconded by Teta, to pass the Second Resolution of the Board of Local Improvements recommending that the City of McHenry proceed with the Sanitary Sewer System Local Improvement Project in accordance with the first resolution passed on June 3, 1987 by the Board of Local Improvements. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Patterson, Smith, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by McClatchey, seconded by Patterson, to adjourn the Board of Local Improvements Hearing at 8:38 P.M. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Patterson, Smith, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. At this point in the Regular Council Meeting Mayor Busse announced that the next order of business was for the City Council to accept the second resolution of the Board of Local Improvements and submit an ordinance to a Committee Meeting of the Whole for further deliberations. He called a Committee Meeting of the Whole for Monday, August 3, 1987 at 8:00 P.M. to review the Second Resolution and the proposed ordinance for approval of the sanitary sewer project in McHenry Shores to be known as City of McHenry Local Improvement Project No. 31. Resolutions Sewer Line Extensions Mayor Busse called to order a Public Hearing on the proposed City of McHenry Appropriation Ordinance for fiscal year beginning May 1, 1987 and ending April 30, 1988. The notice of this Public Hearing was Appropriation published in the Northwest Herald Newspaper on July 3, 1987. Ord. Hearing Motion by Smith, seconded by Nolan, to pass an ordinance adopting the 1987-88 Annual Appropriation Ordinance as presented. Ordinances Voting Aye: Bolger, Lieder, McClatchey, Nolan, Appropriation Patterson, Smith, Serritella, Teta. Voting Nay: None. Ord. Absent: None. Motion carried. Motion by McClatchey, seconded by Lieder, to adjourn the Public Hearing on the Appropriation Ordinance at 8:47 P.M. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Patterson, Smith, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Wednesday, July 15, 1987 Page 2 Motion by McClatchey, seconded by Serritella, to accept the minutes of the July 1, 1987 Regular Meeting as presented. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Patterson, Smith, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Brian Cunat of Cunat Brothers, Inc. addressed the Council and requested that the City of McHenry issue its Industrial Revenue Bonds in the amount of $5,000,000 for the purpose of financing acquisition and construction of an apartment complex to be known as Mill Street Apartments in the City of McHenry. Retained Personnel fees in the amount of $4,000 was stipulated by the Council with a $2,000 minimum balance to be kept on hand in that fund. Cunat explained that the intent was to construct between 65 - 100 apartment units on the 5 acres of land located on Mill Street. Resolutions Motion by Bolger, seconded by Serritella, to pass a resolution IRB'S authorizing the execution of Memorandum of Agreement for the Cunat Brothers Inc. project for the issuance of $5,000,000 Industrial Revenue Bonds. Motion by Teta, seconded by Nolan, to table the motion. Voting Aye: Nolan, Teta. Voting Nay: Bolger, Lieder, McClatchey, Smith, Patterson, Serritella. Absent: None. Motion failed. Ordinances Voting on the original motion: Voting Aye: Bolger, Lieder, McClatchey, Smith, Patterson, Serritella. Voting Nay: Nolan, Teta. Absent: None. Motion carried. Motion by McClatchey, seconded by Serritella, to pass an ordinance amending the Municipal Code by adding the following provision, as follows: "Section 11-209. Negligent Housing Management. No person having personal management or control of residential real estate, whether as a legal or equitable owner of residential real estate or as a managing agent or otherwise, shall knowingly permit by his or her gross carelessness or neglect, the physical condition or facilities of the residential real estate to become or remain so deteriorated that the health, welfare or safety of any inhabitant or other person is endangered or otherwise adversely affected thereby." Voting Aye: Bolger, Lieder, McClatchey, Nolan, Patterson, Smith, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Resolutions Motion by Smith, seconded by McClatchey, to pass a Resolution MFT appropriating the sum of $25,000 of Motor Fuel Tax Funds for the 1987 Sidewalk Program. Sidewalks Voting Aye: Bolger, Lieder, McClatchey, Nolan, Patterson, Smith, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Don & Lu's Children Shop of 1245 N. Green Street requested permission to sell merchandise on their sidewalk directly in front of the store on Friday, July 24, 1987. Motion by Smith, seconded by Nolan, to follow the recommendation of the Chamber of Commerce and allow any and all businesses one day of sidewalk sales on July 25, 1987. Smith withdrew his motion and Nolan withdrew her second. Requests- Motion by Nolan, seconded by Patterson, to deny the request of Misc. Don & Lu's for outside sidewalk sales on July 24, 1987. Voting Aye: Lieder, McClatchey, Nolan, Patterson, Smith, Serritella, Teta. Voting Nay: Bolger. Absent: None. Motion carried Wednesday, July 15, 1987 Page 3 A request by Robert Bitterman Jr, of the business establishment known as The Gambler requested permission to use a portion of the City of McHenry Court Street parking lot for an outdoor cookout on August 9. Motion by Patterson, seconded by Nolan, to grant the request of The Gambler for use of the City Parking lot and require them to pay the Special Temporary Beer License Permit fee and to require a $200 deposit with $50 being non-refundable for use of the facilities and that they be required to furnish dram shop insurance and public liability insurance to cover the City parking lot property and that the Superintendent of Public Works be informed when the parking lot will be closed and when it will be cleaned up and reopened to the Public. Motion by Bolger, seconded by Serritella, to table the motion. Voting Aye: Bolger, Lieder, Smith, Serritella. Voting Nay: Nolan, Teta, McClatchey, Patterson. Absent: None. There being a tie vote, the Mayor cast an Aye vote and declared the Tabled Motions tabling motion carried. The Mayor instructed the Parks and Recreation Committee to study Committees - The Gambler's request and report back at the next meeting. Auth. & Instru Motion by Lieder, seconded by Teta, to direct the Parks and Recreation Committee to draft a policy and procedures to allow profit making organizations to utilize City public property and present it at the next meeting. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Patterson, Smith, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Chuck Ruth of Alliance Contractors, who is a subcontractor for curb and gutter work in Brittany Heights Unit I, addressed the Council requesting a variation on the curb height in Brittany Heights Subdivision. His company installed a 2 3/8 inch curb in the subdivision instead of the 6 inch curb required by the Subdivision Control Ordinance. Baxter & Woodman informed the City that portions of the curb and gutter were not in compliance and the curb and gutter should be removed. Mr. Ruth was asking that the existing curb be allowed to exist and not have to be replaced. Motion by McClatchey to grant the variation for the curb Failed Motions height. Motion failed for lack of second. Motion by Bolger, seconded by Nolan, to go into executive session at 9:56 P.M. to discuss pending litigation. Motion by Bolger, seconded by McClatchey, to grant the variation request of Brittany Heights Subdivision, Unit #1, and accept the 2 3/8 inch curb that's now installed with the stipulation that the City Engineer be consulted concerning the possibility of lowering the center line of the street, and also, that the contractor be assessed the cost of the first milling of the street at today's cost. Voting Aye: McClatchey, Bolger. Voting Nay: Serritella, Patterson, Smith, Lieder, Teta, Nolan. Absent: None. Motion failed. Motion by Lieder, seconded by McClatchey, to schedule a Special Meeting on July 28, 1987 at 8:00 P.M. for the purpose of a Public Hearing on the Gerstad annexation proposal for Thornton Farm. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Patterson, Smith, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by Bolger, seconded by McClatchey, to approve the June Treasurer's Report as presented. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Patterson, Smith, Serritella, Teta. Voting Nay: None. It was the concensus of the Council that it was generally interested in the project and the Mayor should proceed with further negotiations. McHenry Township Fire Protection and it was decided to request 100 Motion by Serritella, seconded by Patterson, to authorize the Superintendent of Public Works to request bids for a new pick-up truck for the Public Works Department. Motion by Serritella, seconded by Teta, to authorize the purchase of five new spinner -type spreaders from Monroe Truck Equipment Company at a cost of $6,800 as recommended by the Purchasing Committee. Motion by Lieder, seconded by Serritella, to authorize the Superintendent of Public Works to make the following purchases: E & H Utility Sales - 1 trash pump $797 and water hydrant repair parts $1,040.18; Sidner Supply Company - valve boxes $720; Alexander Chemical Company - 4 tons of chlorine for the sewer plant $2,000.
