The regular meeting of the city council was called to order by Mayor Council Stanek on Monday, July 12, 1982 at 8 P.M. At roll call the following Meeting aldermen were present: Pepping, Harker, Datz, Wieser, Smith, Serritella. Absent: Nolan, Meurer. Attendance Motion by Pepping, seconded by Harker, to approve the minutes of the June 21, 1982 Regular Meeting; the June 22, 1982 Special Meeting and the June 24, 1982 Public Annexation Hearing as presented. Voting Aye: Pepping, Harker, Datz, Smith, Serritella,Wieser. Voting Nay: None. Absent: Nolan, Meurer. Motion carried. Motion by Wieser, seconded by Serritella, to concur with the Zoning Board Ordinance of Appeals recommendation and pass an ordinance granting two variations on a petition submitted by Henry E. Buch & Son for 1309 N. Park Street. Zoning Voting Aye: Pepping, Harker, Datz, Smith, Serritella, Wieser. Voting Nay: None. Absent: Nolan, Meurer. Motion carried. Motion by Pepping, seconded by Smith, to renew the agreement for one Developer year with Kildan III, developers of Woodcreek Subdivision, whereby they will pay 12% interest, payable quarterly as of August 1, 1982 on the Developer Agreement Donations money due the city in the amount of $32,400 and to renew the agree- ment for one year with developers of Martin Woods Subdivision whereby they will pay 12% interest payable quarterly as of March 19, 1983 on Developer Donations money due the city in the amount of $11,700. Voting Aye: Pepping, Harker, Datz, Smith, Serritella, Wieser. Voting Nay: None. Absent: Nolan, Meurer. Motion carried. Motion by Harker, seconded by Datz, to grant a one-year extension on Developer the overlayment of roads in Woodcreek and Martin Woods Subdivisions with Agreement! maintenance of the roads to be handled by the developers until final accept- ance by the city. Voting Aye: Pepping, Harker, Datz, Smith, Serritella, Wieser. Voting Nay: None. Absent: Nolan, Meurer. Motion carried. Motion by Smith, seconded by Serritella, to pass a Resolution amending Resolutii the bonds, indenture and loan agreement in connection with Industrial Revenue Industrii Bonds issued previously to Charles Margosian and Louis J. Rathje for the Revenue Boone Creek Plaza Project at the corner of Industrial Drive and Elm Street Bond and to authorize the mayor and clerk to sign said amending Resolution. Voting Aye: Pepping, Harker, Datz, Smith, Serritella, Wieser. Voting Nay: None. Absent: Nolan, Meurer. Motion carried. A concensus of opinion was requested from the Council regarding issuance Liquor of a liquor license to a proposed restaurant in the Boone Creek Plaza project Licenses should one be sought. The concensus of opinion of all aldermen was favorable except Wieser who passed. Motion by Harker, seconded by Pepping, to pass an ordinance increasing Ordinance the Class "F" liquor licenses by one for issuance to Sullivan Foods,3705 W. Liquor Elm Street, with the restriction that alcoholic beverages can only be sold Licenses at this location from 8 A.M. to midnight . Voting Aye: Pepping, Harker, Datz, Smith, Serritella, Wieser. Voting Nay: None. Absent: Nolan, Meurer. Motion carried. The License Committee was instructed to review the Alcoholic Beverage Committee Ordinance and make recommendations for updating various sections. Motion by Smith, seconded by Serritella, to authorize and approve nine Park Beer Picnic Beer Permits and one block party request as follows: Travenal Labs on Permits Block Party Monday, July 12, 1982 Page 2 July 24; Jack Wroblewski on July 17; Chester Gilbertsen on August 1; George J. Miller on July 18; Chroma Corp. on Sept. 18; Chuck Dixon on August 15; Childbirth and Parenting Assoc. of McHenry County on July 10; St. Pat's Parish on August 29; and the McHenry County Assoc. for the Retarded/Pioneer Center on August 20 and theblock party request by Mrs. Terry Franklin to close Bromly at the intersection of Kensington and Pyndale on Sunday August 15, 1982 at noon to 9 P.M. Voting Aye: Pepping, Harker, Datz, Smith, Serritella, Wieser. Voting Nay: None. Absent: Nolan, Meurer. Motion carried. The meeting was recessed at 8:50 P.M. The meeting reconvened at 9:03 P.M. with everyone still in attendance. Parks Motion by Harker, seconded by Serritella, to authorize Park Director Merkel to contact Donald Gerstad, president of Residential Develop - Easement ment Group, and request an easement over the company's land to enable the city to reach its park property and develop a ball field thereon for Fox Ridge Subdivision at the cost of development not to exceed $1,000. Voting Aye: Harker, Datz, Smith, Serritella, Stanek. Voting Nay: Wieser, Pepping. Absent: Nolan, Meurer. Motion carried. Senior Motion by Smith, seconded by Wieser, that the City of McHenry should Citizens not participate in the financing of a County Senior Citizens Council. Voting Aye: Wieser, Smith, Serritella. Voting Nay: None. Pass: Pepping, Harker, Datz. Ahs nt: Nolan, Meurer. Motion did no carry. Street Motion by Harker, seconded by Pepping, to approve the 1982 Summer Maintenance Street Maintenance program as recommended by the Street and Sidewalk Committee and instruct the clerk to advertise for bids. Voting Aye: Wieser, Datz, Smith, Serritella, Pepping, Harker. Voting Nay: None. Absent: Nolan, Meurer. Motion carried. Ordinance Motion by Pepping, seconded by Harker, to pass the 1982-83 Appro- Appropria- Priation Ordinance as recommended by the Finance Committee in the amount of tion $9,952,490.00. Voting Aye: Wieser, Datz, Smith, Serritella, Pepping, Harker. Voting Nay: None. Absent: Nolan, Meurer. Motion carried. Authoriza- Motion by Pepping, seconded -by Serritella, to authorize and approve tions the payment of $3,500 to the McHenry Area Economic Development Commission as budgeted. Monday, July 12, 1982 Page 3 The Public Property Committee was instructed to investigate possible solutions for disposition of two village buildings and three village lots that were acquired in the McHenry Shores annexation and report back to the Council. It was the Council's opinion that the City not withdraw from participation in a Class Action Suit filed in Chicago in regards to Work- man's Compensation overcharges by Insurance Companies. Motion by Datz, seconded by Harker, to authorize and approve a block party permit request by John Szekers of 5215 Dartmoor on August 14, 1982. Voting Aye: Pepping, Harker, Datz, Smith, Serritella, Wieser. Voting Nay: None. Absent: Nolan, Meurer. Motion carried. Motion by Wieser, seconded by Smith, to adjourn.
