MONDAY, JUNE 30, 1980 8 P.M.
The Regular Meeting of the McHenry City Council was called to order
by Mayor Stanek at 8 P.M. on Monday, June 30, 1980. At roll call the following
aldermen were present: Datz, Wieser, Adams, Schooley, Meurer, Pepping, Nolan,
Harker. Absent: None. Also present were Clerk Gilpin, Park Director Merkel,
Supt. Meyer, Attorney Narusis and Police Chief Pasenelli.
Motion by Adams, seconded by Datz, to accept the minutes of the June
16, 1980 Regular Meeting as read.
Voting Aye: Datz, Wieser, Adams, Schooley, Meurer, Pepping, Nolan,
Harker.
Voting Nay: None.
Absent: None.
Motion carried.
Motion by Nolan, seconded by Harker, to accept the minutes of the
June 11, 1980 Public Hearing on the Valleybrook annexation as presented.
Voting Aye: Datz, Wieser, Adams, Schooley, Meurer, Pepping, Nolan,
Harker.
Voting Nay: None.
Absent: None.
Motion carried.
Motion by Harker, seconded by Wieser, to table the fence variation
request of Margaret Kamy at 5524 Brittany Drive until the next regular meeting
of the City Council.
Voting Aye: Datz, Wieser, Adams, Pepping, Nolan, Harker.
Voting Nay: Meurer, Schooley.
Absent: None.
Motion Carried.
Motion by Nolan, seconded by Harker, to allow Mr. and Mrs. Kamy to
speak to the Council regarding their variation request of the fence ordinance.

Motion by Harker, seconded by Pepping, to approve Preliminary Plat
of Winding Creek Unit 2 with the additional requirement that a deacceleration
lane be included on Bull Valley Road.
Voting Aye: Datz, Wieser, Adams, Schooley, Meurer, Pepping, Nolan,
Harker.
Voting Nay: None.
Absent: None.
Motion carried.
Motion by Pepping, seconded by Nolan, that City Attorney Narusis
be instructed to prepare an amendment to the Subdivision Control Ordinance
providing specifications for right turn deacceleration lanes in connection
with all streets that empty onto collector roadways or wherever city engineers
suggest a deacceleration lane is justified.

Phillip Wheelock of Glacier Ridge Subdivision addressed the Council
regarding the possible annexation of 5 acres of land adjacent to Glacier Ridge.
It was the consensus of opinion that he could proceed with the regular
annexation documents.
Lenghty discussion took place concerning the use of utility ease-
ments by Community Cablevision for the installation of its underground cables.
Alderman Harker questioned the legality of cable TV using the rear utility
easements in Whispering Oaks without the permission of property owners.
William Kepper, president of Community Cablevision, was present to present
his company's side of the story. He noted that if the company is not allowed
to use the back utility easements, there are two alternatives. stop installa-
tion of cables and service to Whispering Oaks and Fox Ridge or use city street
and parkway easements. City Attorney Narusis explained that the city does
not have the power to give away anyone's property or to enlarge the purposes
for which easements were given. He said cable TV has the right, persuant
to the Franchise Ordinance given by the city, to make its installations
within the terms of that Ordinance in the public streets and rights -of -ways.

He felt that a definitive settlement of this issue can only be done by the
Courts. If individual property owners give Cablevision the right to use their
rear easements, the company can use them.
Mayor Stanek suggested that to ease this situation in the future,
an Ordinance be passed which would include a provision specifying that in
all new subdivisions, cable television is considered part of the utility ease-
ments. Harker suggested approaching each property owner in the area involved
with a legal document which the property owner could sign to permit cable
TV to trespass on their property. This should be done at each individual
address all the way down block, Harker concluded.
Motion by Harker, seconded by Nolan, to amend Section 5 Article XI
specifying that all commercial sewer accounts using other than water supplied
by the city and whose water is metered by another company, be charged for
sewer service at the rate of .75 cents per 1000 gallons of metered water with
a minimum monthly rate of $5.00 and that a surchange of 2.50 be charged for
each said account with the fee to be paid Northern Illinois Utilities for
supplying a metered water reading list of said accounts to be negotiated and
brought before the Council at a later date for Council approval.

Attorney Narusis gave a short report on the ICC hearing in regard
to the ORLEANS Street railroad crossing over the Chicago Northwestern tracks
in McHenry Lakes Estates. He expects a favorable ruling will be handed down
in 30-60 days.
Mayor Stanek called for a recess at 10:07 P.M. The meeting recon-
vened at 10:21 P.M. with everyone still in attendance.
Motion by Meurer, seconded by Wieser, to authorize and approve pur-
chase of an arc welder from Adams Bros. Steel Division for a price of $670.00.
Voting Aye: Datz, Wieser, Meurer, Pepping, Nolan, Harker, Schooley.

The City Clerk was authorized by the Council to purchase a replace-
ment vacuum cleaner for use in city hall.
Motion by Schooley, seconded by Wieser, to authorize the Chief of
Police to obtain prices on a new records filing system for the Police Depart-
ment.

Brittany Park subdivision.

Mayor Stanek read a letter from Police Chief Pasenelli commending
Radio Dispatcher Larry Ekeroth for his assistance in apprehending three
persons who had committed three burglaries in the city. Mayor Stanek expressed
thanks to Ekeroth in behalf of all the citizens of McHenry. The letter will
be made a permanent part of Ekeroth's personal file.
Discussion was held as to the location of a fence on the Petersen
Park Beach property. Mayor Stanek suggested placing the fence at the south
portion of the beach in a location further to the north rather than on the
boundry line.
Motion by Nolan, seconded by Wieser, to place the fence on the
southerly end of the beach property as suggested by the Mayor.

Motion by Nolan, seconded by Harker, to go in Executive Session at
11:54 P.M. for the purpose of discussing the Decker property and personnel.
