The Regular Meeting of the McHenry City Council was called to order by Mayor Busse on Wednesday, June 27, 1990 at 8 P.M. at City Hall. At roll call the following Aldermen were present: Bolger, Donahue, Smith, McClatchey, Patterson, Serritella. Teta arrived at 8:05 P.M. Absent: Lieder. City staff in attendance were Attorney Narusis, Clerk Gilpin, Park Director Merkel, Chief Joyce. Absent: Director of Public Works Batt and Building & Zoning Officer Halik. Moti on of the June 13, Voting Voting Absent: Motion carried. by Smith, seconded by 1990 Regular Meeting as Aye: Bolger, Donahue, Teta, Serritella. Nay: None. Lieder. Patterson, to approve the minutes presented. Smith, McClatchey, Patterson, McHenry Township Fire District Chief Chris Bennett addressed the Council with an activity update of the Fire Protection District. Mayor Busse thanked him for his report and complimented the Fire District for the excellent job they have been doing for not only the City of McHenry but the entire greater McHenry area. Mike Ladd, representing Brittany Builders, presented a final plat for approval of Bull Ridge Subdivision which is located in County territory but within the 1 1/2 mile jurisdiction of the City of McHenry. The property is located on the southwest corner of Route 120 and Ridge Road. Motion by McClatchey, seconded by Smith, to concur with the recommendation of the Plan Commission and approve the final plat of Bull Ridge Subdivision with the stipulation that street lights be installed at every intersection in the subdivision. Motion by Bolger, seconded by Donahue, to move the question. Voting Aye: Bolger, Donahue, Smith, McClatchey, Patterson, Teta, Serritella. Voting Nay: None. Absent: Lieder. Motion carried. Motion by Teta, seconded by Patterson, to approve the block party request of Marianne Torkelsen on 400 Windhaven Trail for July 14, 1990 as presented. Voting Aye: Bolger, Donahue, Smith, McClatchey, Patterson, Teta, Serritella. Voting Nay: None. Absent: Lieder. Motion carried. Motion by Smith, seconded by Donahue, to authorize and approve payment to Seagren/Shales in the amount of $14,527 for work done at the South Wastewater Treatment Plant as recommended by Baxter & Woodman. Wednesday, June 27, 1990 Page 2 Motion by Bolger, seconded by Patterson, to allow Bald Knob Resort to hook up to the fire alarm board at the McHenry Police Station and to notify Nelson Electronics that the Finance Committee has been instructed to study the matter of raising the $1 per month fee now being paid by Nelson Electronics to the City and since the five year contract with Nelson Electronics_for.maintaining the alarm monitoring panel at the Police Department expired May 8, 1985, any new hookups to the Police panel after that date will be compelled to pay the increase fee approved by the City Council. Absent: Lieder. Motion carried. Motion by Smith, seconded by Donahue, to approve the May Clerk's Report as presented. Voting Aye: Bolger, Donahue, Smith, McClatchey, Patterson, Teta, Serritella. Motion by Patterson, seconded by McClatchey, to authorize the City to apply for membership in the McHenry County Historical Society at a cost of $500. Motion by Teta, seconded by Donahue, to table the motion. Voting Aye: Bolger, Donahue, Teta, Smith, McClatchey. Voting Nay: Patterson, Serritella. Absent: Lieder. Motion carried. Motion by Smith, seconded by McClatchey, to permit the Boy Scouts to hand out Duck Race brochures during the fireworks show at Petersen Park with the proceeds from the Duck Race to benefit the McHenry Area Youth Commission. Voting Aye: Bolger, Donahue, Smith, McClatchey, Patterson, Teta, Serritella. Voting Nay: None. Absent: Lieder. Motion carried. Tom McCarthy and Ann Sommer of the Environmental Advisory Committee gave a report on composting facilities for yard waste. They contacted the City of Crystal Lake and the City of Woodstock to find out how they handle yard waste disposal. It was the recommendation of the Environmental Advisory Committee that in addition to the Fall Leaf Pickup Program now being planned by the City, that the City Council should consider having Waste Management place a 10-yard container at a location in the City that could be manned for four hours on Saturday which would allow city residents to come and empty their bags into the container and when the container is full, Waste Management would haul it away for $30 a load. Motion by McClatchey, seconded by Patterson, to proceed with implementing the Environmental Advisory Committee's recommendation and have Director Batt study the matter and come back to the City Council with a possible location for a large drop-off dumpster site and estimate costs for such a program. Park Director Merkel reported that he had numerous requests to use Whispering Oaks Park as a regular game site for soccer games. At the present time it is only used as a practice area. In that park, there are no washroom, water fountain or parking facilities, and no phones in case of emergencies. He asked the Council for direction as whether or not to designate Whispering Oaks Park as a game site. It was the consensus of opinion that Whispering Oaks Park should remain as a practice site only because there are no proper facilities to accommodate regular game scheduling. Motion by Bolger, seconded by McClatchey, to approve the low bid of Roewer Roofing for $1,500 to repair the roof at the McHenry Sewer Plant, as presented Voting Aye: Bolger, Donahue, Smith, McClatchey, Patterson, Teta, Serritella. Motion by Serritella, seconded by Donahue, to clarify a previous motion approving the final plat of Burning Tree Subd.i.vision by stating that thevariations on the road andright-of-way width, the guard rails, the sodding of ditches, the type C entrance and the engineering plans and specifications as submitted were approved by the City Council. Meeting adjourned at 10:30 P.M. i SPECIAL MEETING MONDAY, JUNE 18, 1990 8:00 P.M. The Special Meeting of the McHenry City Council was called to order by Mayor Busse on Monday, June 18, 1990 at 8 P.M. at City Hall. At roll call the following_ Aldermen were present: Bolger, Donahue, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Absent: None. City staff in attendance were Director of Public Works Batt, Attorney Narusis, Clerk Gilpin, Building & Zoning Officer Halik. The purpose of the Special Meeting was to discuss the application of the McHenry Public Library District for annexation into the City of McHenry. It was requesting that the property be zoned RS-1 and that a conditional use permit be granted to permit the construction of a public library facility on the premises. The subject property is comprised of approximately 11 acres of land located on the east side of Green Street north of Bull Valley Road across the street and just north of the location of the new McHenry Municipal Center. The application for annexation was being made by the McHenry Public Library District and Helen Knox Bush as trustee under the provisions of a trust agreement dated February 9, 1970 and known as Trust No. 100. In attendance representing the Library were Attorney Dan Curran of Holmstrom and Green, Executive Director Julia Johnas, Board President Katherine Casper, Board Treasurer Marilyn Lean, Marilyn Schaefer of the Library Citizen Advisory Committee, Mary Ann Knox, Helen Knox Bush, Julia and Glen Huska and Forest Wendt, Architect for the proposed new Library Building. The Annexation Agreement was reviewed paragraph by paragraph. The Library requested that upon adoption of the ordinance annexing the property, that the zoning ordinance would be amended at the same time classifying said property as RS-1 low density residential with a special use permit for a public and/or educational use in order to allow the construction and operation of a public library attendant services and administrative offices on the subject property. Concerning utility lines, Busse said that the City would be installing water and sewer lines to the new City Hall site. Curran said that the Library would be willing to pay their prorata share for extension of those water and sewer lines to their property which would be payable when construction starts on the Library Building. It was pointed out that if the Library building is built, the annexation fees should probably be waived since it is another taxing body. However, if the use ever becomes residential and is subdivided, an annexation formula of $500 per acre and $500 per unit with those fees to be increased 10 percent per year over the 20 year life of the Annexation Agreement should be paid to the City. This stipulation would be drafted and put into the Annexation Agreement. Concerning cost sharing on the extension of the sewer and water lines on a prorata basis, the Mayor suggested that the recapture be figured on a acreage basis. Motion by Patterson, seconded by Teta, to pass an ordinance providing for the approval of an annexation agreement as amended between the City of McHenry, Helen Bush as trustee under the provisions of Trust Agreement No. 100 and the McHenry Public Library District and to authorize the Mayor and Clerk to execute said agreement. Voting Aye: Donahue, Teta, Lieder, McClatchey, Patterson, Busse. Voting Nay: Bolger, Smith, Serritella. Absent: None. Morion carried. Motion by Lieder, seconded by Patterson, to pass an ordinance providing for the annexation of the subject property to the existing corporate limits and to zone the property RS-1. Voting Aye: Donahue, Teta, Lieder, McClatchey, Patterson. Voting Nay: Bolger, Smith, Serritella. Absent: None. Motion carried. Mayor Busse called for a recess at 9:07 P.M. The meeting reconvened at 9:18 P.M. with everyone still in attendance. Monday, June 18, 1990 Page 2 Kit Carstens of Prime Development, Construction Manager for the New City Hall, addressed the Council to discuss bidding documents and timetable for the bidding process. Timetable as announced is June 21, 1990 - advertise for bids; July 10, 1990, 11:00 A.M. - opening of the bids; July 18, 1990 - award bids at City Council Meeting; July 22, 1990, 10:30 A.M. - groundbreaking ceremonies at the new City Hall site. Following discussion and viewing of the plans and specifications a motion was made by Serritella, seconded by McClatchey, to approve the plans and specifications as presented and to advertise for bids on June 21, 1990.
