JUNE 24, 1991
The Regular Meeting of the McHenry City Council was called to order
by Mayor Busse on Mpnday, June 24, 1991 at 8:00 P.M. in City Hall. At
roll call the following Aldermen were present: Bolger, Donahue, Locke,
Smith, Adams, Patterson, Serritella. Lieder arrived at 8:10 P.M.
Absent: None. City staff in attendance were City Attorney Narusis, City
Clerk Gilpin, Director of Public Works Batt, Chief of Police Joyce, City
Administrator Peterson. Absent: Director of Building and Zoning Halik,
and Director of Parks and Recreation Merkel.
During the Ten Minute Public Input Session, Jerry Benes of 200
Windridge Drive, addressed the Council concerning the purchase of 9-1-1
telephone equipment. He presented a newspaper article concerning the
county's purchase of 9-1-1 equipment. He also expressed concern about
the automatic 500 charge being made on everyone's phone bill for the
purchase of 9-1-1 equipment. It was noted that approval to collect 50Q
per phone customer per month was voted on by referendum at a general
election.
Motion by Serritella, seconded by Patterson, to approve the Consent
Agenda as follows:

- Appprove May Treasurer's Report;
- Approve May Budget Report;

Mayor Busse called to order a Public Hearing on the proposed 1991-92
Annual Appropriation Ordinance. The Mayor asked if anyone in the
audience had any written or verbal comments on the proposed Appropriation
Ordinance. There was no response. The City Clerk announced that no
written comments had been received in her office concerning the proposed
Appropriation Ordinance. The City Clerk announced that two corrections,
should be made to the Appropriation Ordinance as presented, increasing
the total amount by $3,500.00. There being no further comments, Mayor
Busse adjourned the Public Hearing at 8:10 P.M.
Motion by Patterson, seconded by Smith, to pass the Annual
Appropriation for Fiscal Year 1991-92 in the amount of $21,509,150.00, as
presented.

Smith, Adams, Patterson, Serritella.

Motion by Donahue, seconded by Serritella, to accept the Sanitary
Sewer Easement for Tonyan Industrial Park, crossing Lots 1, 19, 20, 36,
37, and 38 in Tonyan Industrial Park complex, as presented.

Smith, Adams, Patterson, Serritella.

Discussion was held on an extension of the Letter of Credit for
Malibu Estates. The existing Letter of Credit expires on June 30, 1991.
The developer has requested a one year extension. The original Letter of
Credit was posted in December of 1987 and the Council last granted a one
year extension in the fall of 1990. The Council felt sufficient time had
been granted for completion of the improvements in that subdivision. If
the improvements were not completed in four months, the City should call
the Letter of Credit and install the improvements itself.
Motion by Smith, seconded by Lieder, to grant an extension for the
Letter of Credit on Malibu Estates for four months, with an expiration
date of October 30, 1991.

Motion by Patterson, seconded by Adams, to pass an ordinance
automatically zoning newly annnexed territory at the lowest residential
classification of (E) Estate, except if territory is annexed by a
mutually agreed pre -annexation agreement.

Discussion was held on the awarding

The estimated cost of the project was $75,000.00. Alternate bids
were also received for completion of an employee picnic area, and for
sodding, rather than seeding, parking islands. During discussion it was
decided to eliminate the completion of the employee picnic area, but
leave the money in the bid as presented. It was the recommendation to
award a contract for landscaping to Berthold Nursery in the amount of
$61,893.09, which included Alternates "A" and "B".
Motion by Smith, seconded by Patterson, to award the contract to the
low bidder, Berthold Nursery, in the amount of $61,893.09; to eliminate
the completion of an employee picnic area but to leave the amount of
money in the contract; to work with elected officials on the timing of
installation of the plantings so as to get the best guarantee; and to
only award the bid to Berthold Nursery if they are willing to work under
the above conditions.

City Administrator Peterson explained that a grant application from
the Small Business Administration National Resource Development Program,
Tree Planting Initiative, was discussed at the Parks and Recreation
Committee's June 17, 1991 meeting. The tree planting grant is
administered by the Illinois Department of Conservation. The grant
program authorizes a $100,000.00 maximum grant, with a minimum 40% local
match of reimburseable costs. It was recommended that authorization be
given to seek grant funding for this tree planting initiative program and
to include in this grant request, landscaping of the Municipal Center,
and landscaping in various City parks. This program relates to tree
plantings only.
Motion by Patterson, seconded by Serritella, to authorize Park
Director Merkel to apply for the grant for the Small Business
Administration Natural Resource Development Program on a 50/50 match,
with the cost to the City to be $41,100.00 on an $82,200.00 grant
application request.

Mayor Busse announced the appointment of Randy A. Christensen of 5311
Abbey Drive, McHenry, to the Zoning Board of Appeals to fill the
unexpired term of Mathew Roberts.
Motion by Serritella, seconded by Patterson, to approve the Mayor's
appointment as presented.

Smith, Adams, Patterson, Serritella.

Alderman Patterson, Chairman of the Parks and Recreation Committee,
reported on the June 17th Committee Meeting. One of the items discussed
was a review of the cost estimate for lighting of the A.P. Freund Field
tennis courts. It was the recommendation of the Committee not to proceed
with lighting improvements at this time, but to include the cost for
repair and/or resurfacing of the courts along with lighting in next
year's budget.
It was the Committee's recommendation to authorize Mayor Busse to
select a City float for the Fiesta Day Parade on July 21.

Alderman Smith, Chairman of the Building, Zoning, Planning and
Development Committee, reported on a meeting held prior to this Council
meeting. It was the recommendation of the Committee to revise the
wording on the "Not Approved for Occupancy" stickers as proposed by the
Committee and the City Administrator.
Another item of discussion was foundation requirements for temporary
mobile business trailers for commercial use only., Applications had been
received from Cragin Federal Savings and from Home State Bank of Crystal
Lake for use of temporary mobile trailers until, and while, their
permanent buildings are being constructed.
Motion by Smith, seconded by Serritella, to allow Cragin and Home
State Bank to put in foundations for temporary mobile business trailers,
for use during a specified period of time, according to the instructions
of the Director of Building and Zoning.

Also on the Building, Zoning, Planning and Develop,ment Committee
agenda was discussion of the proposed Landmark Commission Demolition/
Preservation Ordinance. Alderman Smith reported that additional
information was requested from the Landmark Commission before any action
could be taken.
Motion by Serritella, seconded by Smith, to approve the picnic beer
permits as presented.

Smith, Adams, Patterson, Serritella.

Absent: None.

City Administrator Peterson presented a preliminary sign layout
designed by Legat Architects for the McHenry Municipal Center. It was
suggested that Legat be asked to submit additional sign layouts for
Council consideration.
A fence variation request was presented by Mr. and Mrs. Cavins of
4322 Clearview Drive. They requested permission to install a chain link
fence on the property line for their corner lot location.
Motion by Serritella, seconded by Patterson, to grant the variation
request for a chain link fence on the property line, as presented.

Discussion was held on accep ance of an alternate phone system as
submitted by Scan -Am of McHenry: w�i,q, were awarded the telephone contract
for the Municipal Center. IA ad of a Sieman's System, Scan -Am
suggested installation of a Macrotell System. The additional cost for
installation of the Macrotell System would be $3,900.00.

MacrotelT System as an alternate phone system for the Municipal Center at
a cost not to exceed $4,000.00.

There being a tie vote, Mayor Busse cast an "Aye° vote and declared the

Motion by Serritella, seconded by Patterson, to approve the block
party request of Marianne Torkelson at 400 Windhaven Trail for a block
party on Saturday, July 6, 1991.

Mayor Busse announced that the City had been awarded the 1989
Pedestrian Safety Achievement Award from the Chicago Motor Club for
having no serious pedestrian accidents for 1989 or for the last four
years.
A Public Works Committee meeting was scheduled for Tuesday, July 2,
1991 at 7:30 P.M. at City Hall to discuss various Public Works matters.
Discussion was held on asphalting the Court Street lot and the
easements behind the businesses on Green Street.
Motion by Bolger, seconded by Serritella, to authorize the asphalting
of the City's easement into the Court Street parking lot, as proposed by
Superintendent Batt.

The City Administrator was instructed to send a letter to the TCI
cablevision company instructing them to bury exposed cable lines which

The Meeting adjourned at 10:48 P.M.
