HomeMy WebLinkAboutMinutes - 06/22/1992 - City CouncilREGULAR MEETING JUNE 22, 1992 The Regular Meeting of the McHenry City Council was called to order by Mayor Busse on Monday, June 22, 1992 at 7:30 P.M. in the Council Room of the McHenry Municipal Center. At roll call the following Aldermen were present: Smith, Bolger, Donahue, Locke. Lieder arrived at 7:50 P.M. Patterson arrived at 10:00 P.M. Absent: Adams, Serritella. City Staff in attendance were: City Clerk Gilpin, City Attorney Narusis, City Administrator Peterson, Director of Public Works Batt, Police Chief Joyce, Park Director Merkel, Building and Zoning Director Lobaito. Absent: None. TEN MINUTE PUBLIC INPUT SESSION Edward Ligeza of 1210 Capri Terrace addressed the Council concerning the water problems in McHenry Shores. He presented containers of discolored water and a rusty, stained filter which he said had been used to filter the water in his home. Mayor Busse informed him that the City Administrator and the Mayor had met with Leonard Lindstrom, Regional Manager for the Division of Public Water Supplies for the Illinois Environmental Protection Agency. The jist of the meeting was that Mr. Lindstrom said no letters were on file at the EPA in Springfield from any of the residents in the McHenry Shores area complaining about the water quality or quantity. The name and address of the EPA office in Springfield was given to Mr. Ligeza with instructions to circulate it to the people in McHenry Shores so that letters could be on file in Springfield which might enable the EPA to take action on the water problems in McHenry Shores. PUBLIC HEARING mayor Busse called to order a public hearing on the proposed 1992-93 Annual Appropriation Ordinance. The Appropriation Ordinance, along with an estimate of revenues, is to be filed with the McHenry County Clerk. The Appropriation Ordinance sets the upper limits for City spending during the fiscal year. The proposed 1992-93 Appropriation Ordinance is $16,325,500.00 compared to last years Appropriation Ordinance of $21,512,650.00. The principal difference in the Appropriation amount is due to the completion of the Municipal Center and defined capital expenditures in the Capital Development Fund. The public hearing was to allow participation by the citizens on the proposed Ordinance. The City Clerk reported that no written comments had been received in her office concerning the proposed ordinance. The Mayor asked those in attendance at the meeting if anyone wished to present oral or written comments on the ordinance. There was no response. Alderman Bolger commented that he felt some appropriation items could be lowered but overall, the proposed ordinance was acceptable. Motion by Smith, seconded by Bolger, to adjourn the Public Hearing at 8:47 P.M. Voting Aye: Bolger, Smith, Donahue, Locke, Voting Nay: None. Absent: Lieder, Adams, Patterson, Serritella. COUNTRY CLUB ESTATES SANITARY SEWER PETITION On January 8, 1992, the City Council considered the results of a survey sent to residents in the Country Club Estates subdivision asking if they were interested in proceeding with the installation of sanitary sewers in that subdivision. The survey results showed that 39 voted No and 30 voted Yes. The matter was dropped since the majority were not in favor of the project. Another petition was presented this month (June), showing renewed interest for installation of the sanitary sewers. June 22, 1992 Page 5 The new survey results showed a majority of residents favored reconsideration of the project. A number of people in the audience gave statements, pro and con, for the project. Following lengthy discussion, it was decided that more detailed information should be made available to the residents of that area before the Council took action. Motion by Smith, seconded by Bolger, to conduct another survey and/or meeting with the residents of the Country Club Subdivision and revote on the matter with one vote per lot to be cast by the property owners. Voting Aye: Smith, Bolger, Donahue, Locke, Lieder. Voting Nay: None. Absent: Patterson, Serritella, Adams. Motion carried. Mayor Busse called for a recess at 8:55 P.M. The Meeting reconvened at 9:07 P.M. PARKWAY LAWN DAMAGE James Higgins of 4506 Front Royal Drive and James Calvin of 4402 Ashley Drive claimed that their parkways had been damaged by salt which had been put on the roadways during the winter. It has been the policy of the Street Division and the City not to replace or repair parkway damage or lawn damage thought to be caused by salt. The City does repair damage done to parkways by the actual snowplow blade, and will repair or replace damaged mailboxes up to $50.00. Samples of the damaged lawns were sent to the Morton Arboretum to determine if the lawn damage was caused by salt, stress to grasses, or by some lawn disease. Alderman Locke asked that the City Attorney research State Statutes and report back to the Council on the outcome of similar experiences. It was decided not to take any action until the report from the Morton Arboretum is received by the City. PURCHASE OF THE MASS PROPERTY ON MCCULLOIA LAKE The Bank of Northern Illinois contacted the City to see if the City was interested in purchasing the Mass Property, which is west of the railroad tracks, adjacent to Petersen Park in the area of McCullom Lake. The parcels in question contain approximately 69 acres. These properties would expand the City's lake frontage on McCullom Lake by approximately 1200 feet. In considering an interest in the property, it appears this parcel would meet the criterion of the Illinois State Department of Conservation OSLAD Grant guidelines which provide for 50% matching funds for the purchase of the property through a competitive grant application up to a maximum of $400,000.00. If the grant is successful the City could receive $200,000.00 of the $400,000.00 purchase price. Motion by Locke, seconded by Bolger, to authorize the City to enter into a lease Agreement with the contract purchaser of the Mass Property, the CorLands Group, for a period not to exceed three years for the purchase of recreation and open space property, with the language to be approved by the City Attorney; to pass a resolution of support for a grant application to the Illinois Department of Conservation under its OSLAD Grant Program; and that the City enter into a contract for grant writing services from Conservation Services, Inc., at a cost not to exceed $1,200.00, with the grant application to be submitted by July 1, 1992. Voting Aye: Smith, Voting Nay: None. Absent: Adams, Motion carried. POLICE DEPARTMENT COPIER Bolger, Donahue, Locke, Lieder. Patterson, Serritella. Motion by Smith, seconded by Donahue, to approve the purchase of a Canon NP4050 copier at an estimated cost of $8,500.00. Voting Aye: Smith, Bolger, Donahue, Locke, Lieder. Voting Nay: None. Absent: Adams, Patterson, Serritella. Motion carried. June 22, 1992 KNOX PARK POOL REPAIRS Page 6 In March it was decided that the Knox Park Pool was in need of repairs to fix a number of cracks that had developed. Repairs were authorized in an amount not to exceed $4,000.00. As the work proceeded, the cracking was more extensive than previously thought, and an additional amount was needed to complete all the necessary repairs. Motion by Bolger, seconded by Donahue, to authorize and approve payment to William Tonyan and Sons in the amount of $5,591.00. for the repair of cracks in the Knox Park Pool. Voting Aye: Smith, Bolger, Donahue, Locke, Lieder. Voting Nay: None. Absent: Adams, Patterson, Serritella. Motion carried. PASS APPROPRIATION ORDINANCE Motion by Donahue, seconded by Locke, to pass an ordinance making the Annual Appropriation for the 1992-93 Fiscal Year in the amount of $16,325,500.00. Voting Aye: Smith, Bolger, Donahue, Locke, Lieder. Voting Nay: None. Absent: Adams, Patterson, Serritella. Motion carried. MAYOR'S STATEMENTS AND REPORTS The Mayor reported on a meeting held between the City Administrator, the Director of Public Works, and Leonard Lindstrom of the Illinois Environmental Protection Agency regarding the McHenry Shores water problems. An explanation was also given on the water restriction bulletins that were handed out door-to-door informing City residents of sprinkling regulations. Residents are allowed to sprinkle from 6:00 A.M.-10:00 A.M. according to their addresses. Alderman Locke requested that consideration be given to allow sprinkling during the evening hours. At this time no change was made in the water restriction bulletin, which had been previously distributed. Mayor Busse announced that Ward re -districting would be on the July 1, 1992 Meeting Agenda. COMMITTEE REPORTS A request from Mr. and Mrs. Kubiack concerning a zoning violation ordinance was referred to the Building and Zoning Committee for a recommendation. A Park Committee report on the June 16th meeting was deferred until the next meeting, due to the absence of the Chairman. DEPARTMENT HEAD REPORTS City Administrator Peterson reported that Howard Knox had approached the City to request cutting the hay on the Municipal Center property, west of the building. He offered to pay $100 for the hay. Motion by Smith, seconded by Donahue, to grant permission to Howard Knox to mow the hay field west of the Municipal Center, and to have him pay the City $100.00 for the hay. Voting Aye: Smith, Bolger, Donahue, Locke, Lieder. Voting Nay: None. Absent: Adams, Patterson, Serritella. Motion carried. Peterson reported that he had been appointed as a City of McHenry representative on the McHenry County Stormwater Management Committee. Their meetings are held on Wednesday nights. Since he is unable to attend on Wednesday due to Council meetings, he requested that the meeting night be changed, but the Committee has not conformed to his request. He felt it was important that the City be represented on this Committee and suggested approaching other communities for a possible change of the meeting date or else have another appointee assigned to this committee. June 22, 1992 Page 7 It was noted that the Bull Valley/Crystal Lake Road intersection improvements and reconstruction work will begin on June 29, and will take about 40 days to complete. Alderman Patterson arrived at 10:00 P.M. PARADE SIGNS AND DISPLAY OF ART WORK IN COMMONS AREA The City Clerk was authorized to have magnetic signs made for Aldermen Adams and Locke for possible use in the Fiesta Day Parade. She was also asked to work with local artists in having them display art work in the Municipal Center Commons area. NEW BUSINESS Alderman Lieder, Chairman of the Finance Committee, scheduled a Finance Committee Meeting for Tuesday, June 30, 1992 at 7:30 P.M. in the Aldermen's Conference Room to discuss raising various fees. A Park Committee Meeting was scheduled for Monday, June 29, 1992 at 7:30 P.M. in the Mass Barn Horse Stable at McCullom Lake. Aldermen Lieder and Locke asked Building and Zoning Director Lobaito to work on cleaning up an ongoing problem with a residence in Whispering Oaks. EXECUTIVE SESSION Motion by Locke, seconded by Bolger, to go into Executive Session at 10:10 P.M. to discuss personnel, property acquisition, and sale of City property. Voting Aye: Smith, Patterson, Bolger, Donahue, Locke, Lieder. Voting Nay: None. Absent: Adams, Serritella. Motion Carried. Motion by Bolger, seconded by Locke, to go back into Open Session at 10:50 P.M. Voting Aye: Smith, Patterson, Bolger, Donahue, Locke, Lieder. Voting Nay: None. Absent: Adams, Serritella. Motion carried. Alderman Donahue suggested that when constituents approach Aldermen with concerns, those concerns should be brought up by the Aldermen at the committee level, and then determine whether or not it should be placed on the agenda, rather than bring the complaints directly to the Council on meeting nights. She felt many problems could be settled at the Committee or Department Head levels and then Council Meeting time would not have to be used for those issues. HIRE NEW EMPLOYEE Motion by Smith, seconded by Locke, to approve the Mayor's recommendation to hire David Bartik of 25617 W. Ivanhoe Road, Wauconda, IL. as a new Building Inspector in the Building and Zoning Department to be paid at Grade 9, minimum step, $24,842.00, with his employment to begin on Monday, June 29. Voting Aye: Smith, Patterson, Donahue, Locke, Lieder. Voting Nay: Bolger. Absent: Adams, Serritella. Motion carried. LAND ACQUISITION Motion by Patterson, seconded by Locke, to City Administrator to negotiate for the purchase in Executive Session. Voting Aye: Smith, Patterson, Donahue, Voting Nay: None. June 22, 1992 Page 8 SALE OF OLD CITY HALL Motion by Bolger, seconded by Patterson, to set a minimum bid price of $350,000.00 for the Old City Hall building at 1111 N. Green Street and to re -advertise for bids on the building. Voting Aye: Bolger, Donahue, Lieder, Locke, Smith, Patterson. Voting Nay: None. Absent: Adams, Serritella. Motion carried.
