The Special Meeting of the McHenry City Council was called to order by Mayor Busse on Thursday, June 22, 1989 at 7:30 P.M. at City Hall. At roll call the following Aldermen were present: Bolger, Donahue, Lieder, Smith, McClatchey, Patterson, Serritella. Absent: Teta. City staff in attendance were Director of Public Works Batt, Attorney Narusis, Clerk Gilpin, Director of Development Greenwood. Attorney Narusis said that according to the Open Meetings Act, the City Council has every right to meet in executive session for the purpose of legal consultation with the City Attorney to make sure that the Council understands the legal implications and ramifications of various annexation agreement negotiated items. Busse said this meeting was called as a working session and there were no developers in the audience and no negotiations were going to be carried on. He resented the implication from the press that this is a meeting to be held for negotiating and that the Council was somehow deviously trying to work out some sort of action in secret. He did not anticipate any action would come out of this meeting. The purpose of the meeting was for the City Council to consult with legal counsel for collectively reaching a general consensus on the terms and language of an Annexation Agreement before meeting again with developers. Busse suggested that rather than appear to the press as a violation of the Open Meetings Act, the executive session nature of the meeting be made a non -issue by conducting this meeting in open session instead of going into executive session. He also stated that if anyone desired to review the tape or read the minutes, a copy would be made available. The Council agreed. The first matter to be discussed was the Amoco Annexation Agreement. The document had basically been reviewed in total and only one matter was left to be clarified. That was the timing, installation and recapture for the water and sewer lines to the property. Attorney Narusis was instructed to add language to the Annexation Agreement to the effect that if there are more than two developers involved in the extension of water and sewer lines, the developers would pay for the installation equally shared or if there was only one installer involved, sail developer would pay the full share subject to recapture. Attorney Narusis said this was already stated in the agreement and did not need additional language. Discussion was then held on the McHenry Corporate Center Annexation Agreement. On Page 9, Paragraph 8A, Groups L and M were deleted; on Page 10, Paragraph 10 regarding annexation fees, $500 per acre plus $300 per residential unit with an escalation increase in fees of 10 percent annually after two years was inserted in the blank; On Page 12, Paragraph 15 language changes were made as well as on Page 13, Paragraph 16. On Page 13, Paragraph 17 would be deleted if an easement has been given to the Corporate Center from the Cunat's Irish Prairie Development. Language changes were also made on Page 15, 16, 17 and 21. Attorney Narusis was instructed to meet with Dan Curran, Attorney for Corporate Center, and revise the Annexation Agreement as discussed at this meeting. Revisions had to be made on some of the exhibits and several exhibits had not submitted to date by the Corporate Center. In other busines,z Alderman Lieder reported that he had been meeting with the School Districts on a Tax Abatement Program and will present their findings to the Council for approval within the next, few weeks. Mayor Busse reported that several other items were pending before the Council such as the request by the Backhaus people for the extension of the Annexation Agreement for Winding Greek Subdivision west to Curran Road. Fritsch also submitted a revised annexation agreement for staff review and Fox Bay is finalizing their documents for presentation to the Council for a public hearing in the near future. Other working session meetings will be scheduled to handle these documents. Motion by Smith, seconded by McClatchey, to adjourn.
