The Regular Meeting of the McHenry City Council was called to order by Mayor Busse on Wednesday, June 21, 1989 at 8 P.M. at City Hall. At roll call the following Aldermen were present: Bolger, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Absent: Donahue. City staff in attendance were Director of Public Works Batt, Attorney Narusis, Clerk Gilpin, Park Director Merkel, Chief Joyce, Finance and Personnel Administrator Vitas, Director of Development Greenwood. Mary Kanter of 2608 Fair Oak Drive located on the east side of the Fox River expressed her disagreement with the City Council on its decision to hold an annexation meeting in executive session on Thursday night July 22, 1989. She felt the general public was entitled to know whenever the City is intending to extend its boundaries. Mayor Busse explained that the executive session meeting was not for annexation hearings per se but was for the purpose of meeting with our City Attorney to obtain legal consultation. All annexations are always done in open session, he said. Motion by Smith, seconded by Patterson, to approve the minutes of the two Public Hearings on May 31, 1989 and the June 14, 1989 Regular Meeting as presented. Voting Aye: Bolger, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: Donahue. Motion carried. Motion by Lieder, seconded by Bolger, to concur with the recommendation of the Zoning Board of Appeals and pass an Ordinance changing the classification and map amendment for a 4 1/2 acre parcel of land in Riverside Terrace from an RM-1 zoning classification to a C-3 classification as presented. Voting Aye: Bolger, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: Donahue. Motion carried. Carl Moon of Baxter and Woodman presented a preliminary proposed Sanitary Sewer System Master Plan which detailed where the service areas were for the two existing wastewater treatment plants and for a future proposed wastewater treatment plant in the Dutch Creek area south of Johnsburg Road at Route 31. Discussion was also held on alternate sewer connection analysis for the King Farm on McCullom Lake Road and territory at the northeast corner of Orchard Beach Road and Riverside Drive which are proposed new annexations. Moon said that the final master plan would be completed within the next few weeks. He will return to the Council with the final plan as soon as possible. Bob Kirchner of NIPC discussed the Clean Lakes Program Intergovernmental Agreement with the IEPA; and the agreement between the City of McHenry and NIPC for management of the Clean Lakes Program. The City had allocated a limit of $40,000 for the Phase I Study of McCullom Lake which was approved based on a 50/50 cost sharing grant under the Clean Lakes Program. Motion by Patterson, seconded by McClatchey, that the City should enter into an intergovernmental agreement with the State of Illinois Environmental Protection Agency (IEPA) in connection with the Clean Lakes Program Phase I Grant and also enter into an agreement with the Northeastern Illinois Planning Commission (NIPC) for management of the Clean Lakes Program Grant as amended. Voting Aye: Lieder, Teta, McClatchey Patterson, Serritella. Voting May: Bolger, Smith. Absent: Donahue. Motion carried. Director of Public Works Batt informed the Council that under the Ground Water Protection Act and the Underground Storage Tank regulations it was his recommendation to contract with Mankoff Equipment Co. to perform tank tightness tests on the three fuel tanks at the Municipal Garage. In addition, the Water Division discontinued using an underground fuel storage tank at Water Plant No. 2 in 1995. The tank was not properly abadoned at that time. Wednesday, June 21, 1989 Page 2 Motion by Teta, seconded by Patterson, to approve the Director of Public Works recommendation and contract with Mankoff Equipment Co. to perform tank tightness tests on the three fuel tanks at the municipal garage at a cost of $1,190 and to contract with Mankoff to remove the discontinued underground fuel storage tank at Water Plant No. 2 at a cost of $3,500. Voting Aye: Bolger, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: Donahue. Motion carried. Motion by McClatchey, seconded by Smith, to pass an ordinance increasing the number of Class "H" Liquor Licenses by one with issuance of the Class "H" License to Green Street Cafe when the applicant has satisfied the requirements as determined by the Mayor. Voting Aye: Bolger, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: Donahue. Motion carried. Action on the Recapture Strategy Statement in connection with the CDAP Grant for McHenry Corporate Center was deferred until the next meeting. John Smith from Smith Engineering submitted a letter requesting a variation relative to the width of roadways at the Martin Woods Unit II Project. The current ordinance calls for a 32 foot wide pavement width and they were requesting a pavement width of 27 foot edge to edge. Motion by Lieder, seconded by Bolger, to grant the variation request of Smith Engineering and permit a pavement width of 27 feet edge to edge in Martin Woods II Project. Voting Aye: Bolger, Lieder, Teta, Smith, McClatchey, Serritella. Voting Nay: Patterson. Absent: Donahue. Motion carried. Mayor Busse called for a recess at 9:40 P.M. The meeting reconvened at 9:50 P.M. with everyone still in attendance. Motion by Smith, seconded by Lieder, to pass an ordinance amending the parking hours on Court Street between Elm Street and Venice Drive as presented. Voting Aye: Bolger, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: Donahue. Motion carried. Motion by Teta, seconded by Lieder, to pass an ordinance amending Section 7-46 of the Municipal Code concerning Risers and House Service as presented. Voting Aye: Bolger, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: Donahue. Motion carried. Motion by Lieder, seconded by Serritella, to pass an ordinance amending Section VIII E.1 of the Subdivision Control Ordinance regarding street widths as presented. Voting Aye: Bolger, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: Donahue. Motion carried. Motion by Smith, seconded by Serritella, to pass an ordinance amending the Municipal Code regarding definitions in the Sewer Use Ordinance as presented. Voting Aye: Bolger, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: Donahue. Motion carried. Wednesday, June 21, 1989 Page 3 Motion by Lieder, seconded by Patterson, to pass an ordinance amending Chapter 7 of the Municipal Code, Section 7-25 prohibiting the burning of construction waste materials as presented. Voting Aye: Bolger, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: Donahue. Motion carried. Motion by McClatchey, seconded by Bolger, to pass an ordinance amending the municipal code sections 10-18, 10-19 and 10-20 concerning burning of rubbish and leaves as presented. Motion by Patterson, seconded by Serritella, to table the motion. Voting Aye: Lieder, Smith, Patterson, Serritella. Voting Nay: Bolger, Teta, McClatchey. Absent: Donahue. Motion carried. A Resolution authorizing Subordination of Classic Products debt (CDAP) of $58,000 was deferred to a future meeting. Mayor Busse presented the annual Appropriation Ordinance for fiscal year 1989-1990 in the amount of $38,493,400 for review by the Council with a public hearing on the ordinance to be held July 5, 1989 prior to the Regular Council Meeting. Any revisions or suggestions could be done at the public hearing. Motion by Smith, seconded by Bolger, to approve the Play Treasurer's Report as presented. Voting Aye: Bolger, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: Donahue. Motion carried. Mayor Busse announced his appointment for City representatives to the McHenry County Solid Waste Advisory Committee of John Vlcek, who is Chairman of the Environmental Advisory Committee, with Liz Nolan also of that Committee to be an alternate. Motion by Teta, seconded by Patterson, to confirm the Mayor's appointment of Vlcek and Nolan to the McHenry County Waste Advisory Committee. Voting Aye: Bolger, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: Donahue. Motion carried. Motion by Teta, seconded by Serritella, to approve the request of Sandra Heffelfinger for a block party on Saturday, June 24, 1989 at the corner of Glen and Bonner Drive. Voting Aye: Bolger, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: Donahue. Motion carried. Alderman Teta announced Committee meetings would now be held instead of the third Tuesday. that the Environmental Advisory on the fourth Tuesday of each month Motion by Patterson, seconded by Lieder, to authorize the Personnel Director to advertise internally and externally for a full time Park Maintenance position as previously approved by the Council. Voting Aye: Bolger, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: Donahue. Motion carried. Mayor Busse called for a Committee Meeting of the Whole on Monday, July 17, 1989 at 7:30 P.M. to determine if City residents in the Country Club Subdivision want to participate in a program for extending the water line into that subdivision through a special assessment project. Motion by Lieder, seconded by Bolger, to approve the issuance of picnic beer permits as presented. Voting Aye: Bolger, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Motion carried. session Patterson, to go back into Smith, McClatchey, Motion by Teta, seconded by Bolger, to authorize and approve the transfer of Michael Palmer from the Street Division to the Water Division as Water Operator I effective June 26, 1989 at a pay grade of Grade 7, Step 3. Voting Aye: Bolger, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: Donahue. Motion carried. Motion by Patterson, seconded by Bolger, to approve the transfer of Ryan Schwalenberg from the Street Division to the Building and Zoning Department as a Building Inspector effective June 26, 1989 at a pay grade of Grade 9, Step 2. Voting Aye: Bolger, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: Donahue. Motion carried. Motion by McClatchey, seconded by Lieder, to promote Patricia Lubben in the Police Department from a Junior Records Clerk to a Senior Records Clerk effective June 26, 1989 at a pay grade of Grade 5, Step 2. Voting Aye: Bolger, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: Donahue. Motion carried. Motion by Teta, seconded by Lieder, to approve the Mayor's hiring of Karen Krotz as a Department Secretary for the Development Department effective as soon as she can start with a pay grade of Grade 7, Step 1. Voting Aye: Bolger, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: Donahue. Motion carried. Motion by Bolger, seconded by Patterson, to establish the pay grade for Crew Leaders Andrew Lechner and Richard Stull in the Street Division at Grade 10, Step 2 with no overtime. Voting Aye: Bolger, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: Donahue. Motion carried. Motion by Smith, seconded by McClatchey, to adjourn.
